  5. Hi I wonder if anyone can give some advice please I had a personal loan in 2006 for around £6000 which regularly paid for two years. Unfortunately 2008 I was diagnosed with cancer and had to go to hospital for various ops etc As 1 was unable to work I fell behind with the payments and was defaulted. I then set up a repayment plan with the dept collector of £5 a month in which I paid for around three years I then stopped paying when I discovered that the credit collect had to prove the dept. I then received court summons from Cabot in he post in late 2016. I defended the claim by asking them to prove it letter. The summons was the discontinued by the court and I have not heard anything else from them until last week, they have now sent me all the documents that I have asked for signed loan agreement and statements etc In the mean time my cancer has now progressed and I have been diagnosed terminal 1. my question is have they now got a good case and will I have to pay. 2. should I write to them and tell them, about my illness and give them copies of the hospital letters Kind regards William
  6. Hi shane247 Well its just that I had just over £500 in return direct debit charges applied to My account in June of this year..... So I first rang my local branch to ask for the return of the said charges and They said no. I then rang customer relations to complain and I said that I will take natwest to Court if I don’t get the charges refunded... They said no So I then rang mr cunnane who is the manager of customer relations and I told him That I would like the charges refunded to my account and that I will not stop Complaining and that I would if necessary go to the next level until I get the charges refunded. Three days later the £500 was refunded to my account hope this helps regards william.
  7. or you can give John Cunnane 020 8236 8007 ( Customer Relations manager) and ask him for your money back, i did and i got it .... let us know how you got on good luck.

  9. hope this helps Name xxxxxxxxxxxxx Address xxxxxxxxx Address xxx Countyxxx Post code Cobbetts LLP Ship canal House date xxxxxxxx2006 King Street Manchester M2 4WB Your Ref: xxxxxxxxxxxxxxxxxxx Particulars of claim Dear Sir or Madam: IN THE NORTHHAMTON COURT Claim No: xxxxxxxxxxxxxxxx Account Name: xxxxxxxxxxxxxxxxxx Account number: xxxxxxxxxxxxxxxx Sort Code: xxxxxxxxxx I acknowledge the receipt of the defence posted on behalf of National Westminster Bank plc. 1. The Claimant has an account ("the Account") with the Defendant which was opened on or around xxxxxxxxxxxxxx 2. During the period in which the Account has been operating the Defendant debited numerous charges to the Account in respect of purported breaches of contract on the part of the Claimant and also charged interest on the charges once applied. The Claimant understands that the Defendant contends that the charges were debited in accordance with the terms of the contract between itself and the Claimant. 3. A list of the charges applied is attached to these particulars of claim. 4. The Claimant contends that: a) The charges debited to the Account are punitive in nature; are not a genuine pre-estimate of cost incurred by the Defendant; exceed any alleged actual loss to the Defendant in respect of any breaches of contract on the part of the Claimant; and are not intended to represent or related to any alleged actual loss, but instead unduly enrich the Defendant which exercises the contractual term in respect of such charges with a view to profit. b) The contractual provision that permits the Defendant to levy such charges is unenforceable by virtue of the Unfair Contract Terms in Consumer Contracts Regulations (1999), the Unfair Contract Terms Act 1977 and the common law. 5. Accordingly the Claimant claims: a) the return of the amounts debited in respect of charges in the sum of £xxxxxx and £ xxxxxx interest. c) Court costs £xxxxxxx d) Interest pursuant to section 69 County Courts Act as set out on the attached list of charges or at such rate and for such periods as the court deems just. I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative I believe that the contents of these particulars of claim are true

  14. hi thats the letter that i received so i sent this one.. Data Protection Act 1998 subject access request Data Protection Radbroke Hall Knutsford Cheshire WA16 9EU Account no xxxxxxxxxxxx Sortxxxxxx Dear Mr Townsend Date 3 June 2006 With reference to your letter dated 25 May 2006 I am returning the £10.00 cheque that you sent back to me. Please note that my Data Protection Act request started from the date that you received my cheque on the 15 May 2006 and I expect the information requested to be sent within 40-days of that date. Should there be any further attempts to delay compliance, I will be left with no alternative but to escalate this matter into an official complaint to the Information Commissioner and/or the County Court under s.7 and/or s.13 Data Protection Act. Please supply me with a complete list of transactions and charges relating to my bank account from the last six years. Alternatively a complete set of bank statements for that period will be acceptable. In addition, I require information on any or all occasions where a person has looked at my account and intervened to either stop or permit a transaction because I had gone over my limit, or indeed sent a letter due to any incidence resulting in charges applied to my account (as opposed to any automated systems that are in place). If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request. I request this information because I have noticed that your bank has registered a default notice on my experian credit report for £595.00, and I am puzzled to how these charges have been made. If I find that from investigation from my bank statements that the default amount has been made from unlawful bank charges then I will require that you refund these charges and remove the default Yours sincerely williamh you can just edit the bits you want regards williamh.

  17. Hi all Can anyone help me with this one please..? 2 weeks ago I handed in a request for bank statements, I actually gave the request to member of staff and I made a note of her name…. I said you can take £10.00 from my account or if you wish I can give you a cheque now. She said there is no need to give her a cheque and if the bank wants any money they will take it from my account (I gave them authority to do so in my letter) Well I received this letter from the bank today Dear Mr. williamh DATA PROTECTION ACT 1998 I write to you with regards to you recent letter requesting subject access under the data protection act 1998. There are two options available to you I will be happy to arrange for the bank statements that you have requested to be sent out directly, the fee for this is £5.00. Alternatively, if you require a full subject request (SAR) the fee for this is £10.00 Blah blah Yours sincerely Natwest So my question is do I send 5 or 10 pounds? And do I still keep to my time limit of 40 days? Kind regards William.

  20. Hi all First of all I would just like to say what a truly fantastic forum this is and how helpful you all seem to be …........... I only discovered it last week and I am now up most nights (much to the wife’s disgust) just reading and learning Well a few years ago I was in the middle of a well you might call a sticky period .due to trying to sell my business because of ill health. So you can guess the banks had a field day with me despite being a good loyal customer for over 15 years. The worst case being charged £25.00 for a cheque issued to one of the credit reference agencies marked unpaid please represent and the cheque then being bounced again at another £ 25.00 charge… I thought £50.00 charge for a £2.00 cheque this cant be right From 2003 to 2004 I was charged constantly for going over drawn At one stage I asked Barclays to close my account when I was £10.82 in credit, but because of other charges they refused to close the account and as a result they still continued to charge me interest and a few unpaid direct debit charges in which very quickly became a debt of £595.00 and a default resisted against me My latest situation financially is very good my new business is booming and I am in very good health….. So I am very eager to get my money back from the banks. Mainly “BARCLAYS” then “NATWEST” and last but not least “THE ABBEY” So today 5/ 5/2006 I popped into my current bank (natwest) and gave them a copy of the request for statements letter Needless to say I will keep you informed of all developments Best regards William.
