  1. Fangface If they keep hassling you with phonecalls there is a letter you can send them asking them to stop hassling you on the phone...it's in templates i think. Also fire off a letter of complaint to the office for fair trading and let capquest know in your letter that you have reported them as lookingforinfo has suggested earlier.
  2. Hi Mike My 12 days were up today so they've defaulted...i knew they would when i got the 28 days letter. So now waiting for 19th march....at least now they have to have a court order if they want to enforce the debt presuming that it does exist and they can produce the cca.
  3. Hi Mike I'm at odds as to whether or not to send a SAR to Amex...having not heard from them in at least 5 years. I suspect that we're getting close to the 6 year mark and thats why they've sold the debt..if indeed that is the case to capquest. I checked my credit record and according to that I owed Amex £29....if that was the case I would've cleared that amount quite easily so I'm disputing that. Like I said I've had no correspondence from Amex for years now so I'm unsure wether or not I do owe them, my thinking was I paid it off years ago. Anyway I will wait to see what capquest come up with I have my complaint letter for trading standards at the ready...I'm not impressed with the bullying tactics of capquest at all!
  4. Got a letter from capquest last week, two letters in fact! They're saying they've put the account on hold and want ME to furnish them with statements and details of past payments...lol.....you couldn't make it up Anyway they've defaulted on the cca request...
  5. You need to send off a CCA request, plus a cheque or postal order for £1. Request letter is in the templates. Seems that debt approach the 6 years often get sold off to DCA's

  7. Hi Fangface I've just received one of those 28 days letters(in fact I got two!) from capquest following my cca request. They also asked for me to furnish them with payment details of receipts yeah right! ( even though I'm desputing the debt). They are obviously going to default on the cca request as they can't have anything in terms of agreement. I sent my cca request after one of their 'we're sending the baliffs in' heavy letters. Let me know of any developments in your case and I'll share mine. Salisburyowl
  8. Guess what? capquest have just sent me another 'give us 28 days letter' does the right arm know what the left is doing or what???????? I have no intention of supplying them with any information..if they want it...let them go find it. It's quite evident to me that they don't have any credit agreement of mine.....do I just lie back and wait for the next letter or should I fire off a letter? Any ideas? looks like they've defaulted on the cca request, I'm going to fill in a complaint form for the OFT tomorrow. Salisburyowl
  9. Well I received an interesting letter from capquest today 14th Feb 07 in response to the cca request that they received on jan 31st 07. Dear Mr Owl Furtherto recent contact with our office and your request for further information in relation to the above account, we would confirm that your account is now on hold for 28 days whilst we obtain the information required. If you have any proof of payments or correspondence that would assist with your query, please forward these documents, with a brief covering letter, to our collections department, so that we can resolve this matter as soon as possible. Yours sincerely collections administration department Now I gather from this that they haven't got the relevant paperwork so they can't produce it just yet. What should I do now? I have no paperwork or correspondence regarding this debt ( not that I would send it to them if I had any). Any suggestions????? Salisburyowl
  10. Hi there I received one of these heavy handed baliff type letters from capquest over a 'bought debt' one I thought had been paid off years ago. I sent my CCA request off ( recorded deliver of course) they got it on 31/1/07 so I'm just waiting now and as yet heard nothing!
  11. Hi there Got a letter 5 weeks ago from Capquest with some claim that they'd bought a debt from Amex. Thing is I haven't had an Amex card for years now, since 2001 in fact. I rang them disputing that the debt actually existed as I was convinced I'd paid Amex everything I owed them before chopping up my card. I hadn't received any correspondence at all from Amex since 2001 so was puzzled when a request for nearly £700 pounds appeared from Capquest. 2 weeks ago I received a nasty threatening letter about baliffs calling and telling me that the value of any goods seized would offset only 10% of their true value against the debt. I sent off a CCA request which was delivered together with my £1 cheque on 31/01/07 and I know they have 12 working days to comply with the CCA rquest and 1 calender month after that before they commit an offence. Question is what happens if they send something to me after the 12 day period but within the calender month period? Incidently I did a credit check and found out there was a debt to Amex for £39. I can't believe I didn't pay off £39 but more to the point how did it balloon into nearly £700 ? Any suggestions how to proceed? Many Thanks!
  12. Hi Willow and Andrew Many thanks for your replies, they are very much appreciated. What happens if they pass the 12 day mark but send something during the calender month? Also if they do not send anything after 12 working days and then 1 calender month and have commited an offence, what happens then? Do I do anything?????   15. Hi Boo Many thanks for quick response and support. I will send off the SAR in the morning - recorded delivery of course. I have been reading lots of other threads so I have a fair idea of the process. I know there is probably some information on the site already but does anyone know how much I would have to pay to file a claim at court (assuming it's under £5000). The pennies are a bit tight and I may have to borrow it if it's a lot.
  16. Hi Everyone I'm itching to get started on my claim against the Halifax. I've printed off my SAR ready to send off, however before I do I need to check 2 things. a) Will they close my account ( I have a parachute account set up in readiness)? b) Will they withdraw my overdraft? I can't afford to clear it in one go. Would I be able to pay it off in chunks? Should I send my SAR off and see what happens, can anyone advise. Thanks in anticipation Salisburyowl

Have just read my credit report.......and there is a reference for Amex Default balance £29 Current balance £694 Defaulted on 9/11/2001 File updated for period to : 07/01/07 Am I right in thinking I need to send a SAR out to Amex....I'm interested as to why I've had no contact from them all these years and why my balance has increased by £665......I'm sure I could have cleared £29 pounds worth of outstanding balance...even then.....hmmmm No mention of capquest on my credit report....would they appear? Is it a good sign or not? Any help is gratefully received.

  20. Hi everyone to cut a long story short I had an amex card over 5 years ago, maybe slightly longer. Paid it off ( or so i thought) and haven't heard anything from amex in over 5 years. About 3 weeks ago out of the blue I got a letter from capquest saying i owe the nearly £700 and they have bought the debt off amex. I rang them to say there was no debt to pay as far as i was aware. ( I no longer have any paperwork after 5 years and there has been no contact from amex at all). The other day I got a letter telling me that because i hadn't responded to the first letter that they were going to send the baliffs around and that the worth of what they collect will only be worth 10% of it's true value against the debt. Consequently I sent then a cca request by recorded delivery and await the response. Is it worth sending a SAR to amex or should i wait for the response from capquest?
  21. Hi everyone I've been registered for some time but only just decided to put text to paper. I received a letter about 2 weeks ago from Capquest demanding money. They claim to have bought a debt from Amex of nearly £700. I used to have an Amex card many years ago but have had no dealings with Amex for at least 5 years, maybe longer. I have no paperwork regarding any agreement with Amex as I believed that any outstanding balance was paid off. Now this letter has started me to have 2nd thoughts about wether or not the debt was paid off....it must have been. Amex wouldn't allow a debt of such a high amount to remain uncollected for such a long period of time surely? I have had nothing in writing to suggest that Amex were selling this debt (if indeed it exists) to capquest. Anyway last week I received a nasty letter from capquest mentioning court, sending in baliffs etc as I had chosen not to respond to their first letter ( I actually rang them and queried that the debt actually existed). After reading several posts on this site I sent capquest a cca request (together with my £1 cheque and sent it recorded delivery). I am right in thinking that capquest have 12 days from receipt of my letter to provide me with the cca? What happens if I do get it? What should I do if I don't ? Any advice would be gratefully received
