    Stated client on the letter is British Gas. 

     

    I have been living in the same property for the last 10 years or so. Never moved and the debt is belonged to same address. I just dont know how they come up with this debt years later. 

     

    In that case, i won't be ringing them. Do i just ignore it? Can British Gas still place a default on my accounts? 

     

    I have a good payment history since then and i dont want it ruined because of this. 

     

    Btw, they have also sent me an email and asking me to contact them by replying to that email or call them. 

     

  2. Hi everyone, hope all ok here. 

     

    I have just received a letter from a debt collection agency asking me to pay a debt owed to British gas. 

     

    Upon checking my credit scores, i can see this debt shows up as settled and closed in 2016. Started in Dec 2015 and closed in July 2016 with £0 balance. 

     

    I have no recollection of owing anything to British Gas. It's a very small amount (around £40) but it has been bugging me. 

     

    Any idea if i should be paying this company?

  3. Did you make international calls in excess of the international allowance?

     

    We need more detail on why they think you should be paying, or at least why you feel you shouldn't be paying!

     

    Do they accept they gave you an international calls allowance? Have you exceeded it ?

    Yes they do accept that i have international minutes. I used to have 30 but increased to 60 and then to 138 followed by 180. I even receivd a text message confirming that. I asked for confirmation because i know this would happen.

     

    They still had not responded to my second complain letter. What should i do?

  4. I sent them a letter few weeks ago and the respond i had was that they couldnt do anything and that the bill was right as i made international calls.

    Please accept this email as an official complain. I would request this matter to be carefully investigated otherwise i will have no option but to take things further. I do hope you can help me solve this problem which has been going on for a long time.

     

    All my problems started about a year ago. I have been on T-mobile for quite a few years now and i am a loyal costumer who pays the bill always on time by direct debit. Last year, Tmobile charged me extra amount of around £400 for things i shouldn't have been charged and all done without my knowledge as i pay by direct debit. But after long phone conversation, i was refunded. Tmobile said that i made calls to 08 numbers and lyca mobiles. Who would know what numbers are lyca and what not! Anyone can just transfer their existent number and you wouldn't know.

     

    To cut the long story short, i told them i wanted to leave. They have given me a great package for £27 which was called the Full Monty (1000 minutes, unlimited text and internet). They also added extra international minutes as i do make calls to abroad. To began with my international minutes were around 60 or 90 and it was increased to 136 and then again further increase to ~180 minutes were made on another phone call to complain department. I was also told i would use my minutes to call 08 and lyca numbers without being charged extra.

     

    Now, each and every month Tmobile is charging me over £70 and claiming i made international calls. I argue and explain the situation, they look at the system and they say sorry and tell me they will credit it to next bill but when the next bill arrives, i dont get the refund promised and the same problem occurs again.

     

    This has been going on for months and i do suffer from Behcet syndrome which is a rare syndrome where the immune system attacks the good body cells and also cause cognitive problems which results in panic attacks. I have few other problems caused by the desease. The reason i am mentioning this is that i already suffer alot on a daily basis and stress is the last thing my immune system needs. I cannot afford spending £70 for a phone bill each month and the hours on the phone trying to get my money back. I am unable to work because of my ongoing health problems and i try to cut down on cots but thanks to Tmobile, this whole situation affects my everyday life.

     

    This has been going for a long time and i really don't know what to do anymore. They know i am right, they see it all in the system but fail to do anything about it. And this month they are telling me they cannot do anything because i made international calls and called lyca mobiles in UK. By the way, this whole contract was sent to me as a text message for me to confirm and keep a copy. So if this problems is not resolved within the next 7 days, i will be taking things further as i waited long enough.

     

    Could you please help me with this matter and get back to me within the next 7 days with an explanation. I am happy with the network as long as i am provided with the service T-Mobile promised me.

     

    I would appreciate your help on this matter.

  6. Hi;

     

    I am writin gon behalf of my friend who is very vulnerable and is affectively homeless.

     

    He has few serious life threatening conditions such as Behcet Desease, Plysystic Kidney Desease, blood pressure problems, panic attacks, anxiety and few others caused by the behcet desease (mouth and body ulcers are the common ones)

     

    He had applied for housing and was provided with a non-shared hostel room with sink and toilet. He had numerous of letters from his doctors, behcet specialist professors and his GP explaining the seriousness of his conditions as well as from his psychiatrist.

     

    He was told that he would be put on a emergency list and given a bidding number within 2 weeks. Its been over 3 months and they are asking him to provide all his hospital attendance letters and records from the hospital whenever he was seen and descharged.

     

    He went ahead with the hassle and get his papers from the hospitals. However, now they are saying it is not clear and they want more information. His doctors wrote many letters (4 pages long in fact) explaning the seriousness of his health problems and without him having his self accomodated place, he wont ever make any improvement becaus he also has neurologic complications and his mood always changes. And the stress makes his condition even worse.

     

    Is it right of the medical team of the council to request such documents from someone so fragile? And is there anything we can do to speed to process or make complain to certain department?

     

    I believe this is just unacceptable of them to promise him a bidding number in 2 weeks and not even bothering to keep him updated and then after 3 months, asking him to provide more documents when he already provided everything possible (even by the doctors)

     

    If they need extra information, arent they supposed to contact the hospitals themselves and request the information or maybe talk to his doctors?

     

    I would be grateful if you could shed some lights on what we can do.

  7. Hi everyone;

     

    I have been on 3 network for more then 8 years now with few additional contracts on the same network.

     

    In January, my Sony Xperia S was taken for repair to a 3 shop, it had random restarts, freezing, yellow spots on the screen and loose back cover. 4 days later the phone was back and i received a text to go collect it. They done a hard reset and sent the phone back without the back cover.

     

    I notified the store that the cover was missing, and they asked me to go back there following week. I work full time so i went back within 2 weeks and cover still wasnt there. 4 months went on, i called costumer services once every month. Finally, decided to take the un-repaired mobile back to the shop for repair on the 10th June. They never called me or informed me with the status even though i have been to the shop 3 times to check the progress.

     

    Finally, when i called the three costumer service on 25th August, they told me the phone was at the store since 23rd July and i should go collect it. Apparently, they replaced it with a refurbished one. So i collected it on 2th August. But guess what? The back cover was still missing.

     

    Frustrated, i called 3 to complain and cancel my contract. They wont let me without paying the early termination fee. I signed up for a contract with them and they failed to provide me with the service i signed up for.

     

    I have been without a mobile phone for the last 7 months which i have been paying. They stole (literally) my back cover and wont give it back to me.

     

    Since they failed to provide me with the service, do i have the rights to cancel the contract? If so, how can i do it?

    I dont want to pay any fee.

     

    Also, while on the phone to this rude guy at the complain department, he tried to talk to me about an ipad contract under my name without even confirming with me. I tol him he had no rights to mention me the ipad contract while i am disputing an account.

     

    Can anyone help me where do i stand with this? I even asked for early upgrade possibilities and they said i had to pay fee for that as well.

     

    10 years i have been with them and this is how they treat me! T-mobile replaces the faulty phones the next day and they even do collection from your house. They take your faulty phone and replace with a new one the next day. I am never coming back to three ever again and pulling out all my family members and friend i subscribed to three once their contracts ends.

     

    Any help on this matter will be appreciated. Thanks in advance.

  8. During my research i have come across with this:

     

    Unlawfull deduction of wages:

     

    Sections 13 to 27 of the Employment Rights Act 1996 (ERA 1996) set out the provisions that protect workers from unauthorised deductions from their wages. *

    * *

    Protection against unauthorised deductions *

    Section 13 of ERA 1996 prohibits deductions from a worker’s wages unless: *

    The deduction is required or authorised by statute or a provision in the worker’s contract; or

    The worker has given their prior written consent to the deduction.

     

    According to this, i should still be eligible for the full 6 weeks of pay. I have been told that from the date of sick leave, i have only 3 months to dispute. In my case, i have only till 22nd July to issue employment tribunal!

     

    I have a feeling that they are trying to get past the 3 months period so they dont have to deal with the subject matter!

     

    Can anyone suggest me what to write on a letter as i need to start grievence process asap.

  9. I have recovered from the surgeries. However i still have sudden and sharp pain under need my appendicities scar throughtout the day. My doctor sending me off for a ultrasound scan before he can comment on it. Also i am very stressed! My sleeping paternt went upside down. I am scared when i get back to work, i will fail attending work on time for a while, although this is not my concern at the moment.

     

    I still dont know what to do! My employer is the only reason i am in such a bad state mentally and financially! Any help on what i should be telling them? How can they expect me to afford travel costs untill next pay day when they cant even pay me the sick pay i am entitled to?

  10. No it wasnt an accident. The metal plates in my ankle were given me trouble and they had to be removed. Unexpected part was that after recovering from that surgery, i had appendicities and couldnt work for further 6 weeks! And everything went upside down as i started struggling to pay bills. If my employer made the promised sick pay, i wouldnt have been in this situation.

  11. Hello everyone;

     

    I have been working for this company for almost 5 years. I had an accident 2 years ago and had my ankle broken and went on a sick leave for about 3 months and i was given 6weeks full sick pay followed by SSP.

     

    This year however i needed to have another surgery and had the plates removed from my ankle as they were giving me trouble. I went on a sick leave 4 days before April. And after 7 weeks of recovery i had appendicities and had a surgery to remove my appendix and was signed of for firther 7-8 weeks.

     

    According to my employer, the rules for the sick pay has been changed as of April 2012 and they only pay 2 weeks full now. However, as i left just before the change, i believe this shouldnt affect me!

     

    When i went on a sick leave i depended on that sick pay. Made all my plans around this amount so i wouldnt struggle!

     

    But now i am being chased by my creditors because i couldnt afford to make the payments to those companies!

     

    My HR insists that she will have to arrange a management meeting before she can get back to me! I am sure she has all the power and she doesnt need any meeting! Shes meant to have that meeting for over a month now!

     

    I am due to be back at work but this problems has given me so much stress, i dont even feel like getting out of the house! My mobile phone has been disconnected yesterday due to unpaid bill! I feel frustrated!

     

    I am not sure what to do at this stage! I am not sure whether it is good idea to go back to work while we are in dispute!

     

    I dont know where i stand! Could anyone please help me? What should i do? I am sure i am entitled for the sick pay but my employer has been harrassing me long time now! And i have a feeling this is their next trick!

  12. Hi guys;

     

    i am really desperate for some help.

     

    I will start from the beginning and briefly explained the situation.

     

    I started working for this company 4 years ago. The first year i was a full time employee and worked 35 hours shift a week. A year later, i started university and i have asked for flexibility, i was given it right away by my current Manager and HR. All i had to do was to give them the hours i could work in a week. Agreement was to do 20 hours per week.

     

    For example: I worked 4 days a week 5 hours each. But because some days i had classes midday, i could only work 3 hours a day and make up the time through out the rest of the week.

     

    This has been going perfectly fine the last 3 years. Now, suddenly (considering this is my last year at university and even better, my last semester) I have been told that my working hours are not acceptable and i was given a disciplinary hearing without much warning!

     

    I have provided them with the hours i could work this semester in September 2011, just like i have done the last 3 years. I wrote the times on a post-it note and explained it to the new manager (HR has been replaced since i started work as well).

     

    After a month or two, i was given a WLB(A) Form (Work-Life Balance). I denied filling it as i was flexible anyway and thought why should i fill a form and accept not being flexible! The letter stated that i should fill it and if it is accepted, i would be notified! Why, i asked to myself! Are they trying to get rid of me and this is their strategy!.. After a month of receiving the WLB form, i had another letter in my pigeon hole stating that i had a disciplinary meeting scheduled, without even a warning whatsoever!

     

    In this meeting i was told that my working hours were not acceptable. Also how i was not allowed to be flexible (when all the other part timers are allowed)

     

    I was also told it was in my contract that i wasnt allowed to be flexible! Now, only contract i have is the full time contract i signed when i first started work 4 years ago which mentions/allows flexibility. I have not signed a contract when i become part time, and my contract was a verbal one. If there was a problem, surely, i should have been told about it years ago! My working hours have never affected the running of the department as my HR claims right now. I go to work, do my shift, do my job and leave. And clearly as everyone also states, i am the best at my department.

     

    I have asked my line manager if he had any problems, he said no. My supervisor said no! I just dont understand what is her (HR) problem with me!

     

    In the meeting she also mentioned how i called in sick this many times and been late 8 times! I have been late because my motorbike was broken and i had to take public transport which takes 1 hour or more to get to work! She also mentioned about last minute holidays!

     

    She said i need to give at least 3 working days before booking a holiday! I asked why they were approving if i wasnt allowed, she managed to change subject! If i have to take a day off for an urgent matter, i always ask in person. And if i am allowed, i fill out the holiday sheet!

     

    Ok, here is the last part. Today i went into my pigeon hole and the second WLB form she has given me was stolen from my pigeon hole together with the staff handbook i was given after requesting it! The letter was dated 05.12.2011 when in fact she placed it in my pigeon hole on the 8th of December 2011!

     

    So i had it signed by a colleague. I wrote received on the 08.12.2011 and he signed it. Then (stupidly) i put it back in my pigeon hole!

     

    I told my manager today that both items were stolen from my pigeon hole and he said he would talk to HR

     

    I took the rest of the day on sick leave and left after working 2 hours. Later today i received an email from HR (on my very personal email address). She said that she heard i "mislaid" the form she has given me for the third time and she attached a copy in the email and asked me to fill it and send it back to her today!

     

    I have no intention of filling the form as i dont see it necessary. We already had an agreement since i started working part time and how on earth i am being asked to fill out a form after 3 years of service!

     

    I would be really grateful if you could help me on this matter as this is seriously stressing me very badly! I am a student and i cannot afford losing my job. And from what i can see, this is what they are trying to do! By filling the form, i believe i will be accepting a new agreement between me and my employer which will not be for good cause.

     

    I really appreciate all your time for reading this and any input will be appreciated.

  13. Thank you guys, but the problem is, I dont think i know how to remove a clamp nor know anyone who can do it!

     

    Can anyone tell me if the clamper obliged to remove the clamp once he is told that out of statutory declaration is filed? What if you dont have money to pay for the fine to remove the clamp and you need your car?

     

    He needs to travel back to London as he finished uni now and he has to move out of his flat by wednesday and he needs his car!

     

    Any ideas?

    Green and mean, i dont think it is possible to remove the clamp and would probably get fined for doing so, dont you think?

    I checked the bailifadviceonline website and it was advising to fill out Out of Time Statutory Declaration. It also says that bailiff should remove the clamp if its not towed away. After our phone call to the guy who clamped the car, he said he wont remove it!

     

    Does that mean that we have to pay the fee and than challenge them afterwards? Or can we demand they remove the clamp?

    I am desperate for some urgent advice! My brother was fined in October for going into a one way road in London! He never recieved the fine until now!

     

    His car was identified in Southampton by one of those CCTV Smart cars and immediately clamped! According to people who clamped his car, he was sent a fine in London as well as door visits and letters, which he received none! There was no home visit either, well at least none that we are aware of!

     

    I would like to know what his rights are. He always paid his fines within 14 days period. Now his car is clamped in Southampton, and they given him till Friday to pay £460 fine which also includes charges for home visit and letters sent! If he doesn't pay the fine by Friday, his car will be towed away.

     

    Can you guys point me in a direction and guide me on what to do? He doesn't have any money, ge is fine with paying them fine as long as it is proved but how about the charges for home visit and clamping?

  16. Hi there again;

     

    It has been a while since the last time i have heard from provident since i have contacted them. I explained them how i sent my cancellation letter and was waiting for a respond from them.

     

    2 weeks ago a guy called me telling me how i have not been paying my loan back and how i was avoiding them etc!

    I said, i sent them the cancellation letter and have contacted their office and waiting for a respond. i have recieved 2 letters from their office. First one was to tell me they were investigating and the second one was saying they couldnt come up with result and still investigating and would get back to me within 28 days.

     

    When i explained this to the guy who called me, he said can you pay it off (the amount without interest on it: £700) i said YES, thinking i would have time to borrow from someone within a week or so. He said "by tomorrow" and the line cut off (i live in a bad reception area!

     

    After the call, he didnt bother calling me back or sending me any letter to confirm anything! And few days ago, i've recieve a letter from provident telling me how i failed to keep up with their offer of clearing the balance! They said they havent recieved the letter till february (which is a lie) and even though they accepted to cancel my agreement, they now wont do it because i failed to pay £700 the next day!!!!!

     

    Now, where am i at this? can anyone please guide me? The letter says they are giving me 8 days to respond so i need to contact them asap! I sent the cancellation letter in time, and i had the cash to clear the balance then, but i dont have it anymore! Not till April! And now they are still charging me interest! I had £700 in January to help me clear the balance but now i spent it to fix my bike which cost me £599!

     

    Can anyone please please help me? I am lost and i am not planning to pay them a penny extra than £700. What are my rights?
