  1. Hi, I joined my local gym just over a year ago and signed 12 month contract, which I was happy to do at the time. But during the year my attendance was curtailed due lack of motivation at times and injuries: 1. Mechanical back problem. 2. Spurring in my left shoulder which needed injections. Towards the end of my contract my wife insisted I cancel it as there had been months that I didnt attend at all and still paid for it. I contacted the gym explaining I was going to have to quit at the end of my contract, which was fine. So i went ahead and cancelled my direct debit after final payment. I kept nagging at my wife to allow me to continue and after a couple of weeks she gave in on the understanding that if any of my injuries played up or I lost motivation I was to give it up then. I went to the gym, explained the situation to the gym owners husband, who is also a trainer there, and asked for a new direct debit form to fill in so I could continue my membership. He gave me the form, I quickly filled it in and left. I got a letter this week from the company that deals with their direct debits saying it was set up and I was now on a 12 mont contract! None of which I wanted or was told was happening. I emailed the gym: Hi *******, I emailed you back in December saying that due to injuries etc I was going to have to cancel my gym membership when it expired beginning of this year. After agreeing a termination I went ahead and cancelled my direct debit. But after moaning at my wife constantly to get another chance, she finally agreed to let my membership continue provided I kept going and my injuries never flared up excessively - if they did i was just to cancel my membership then, which I agreed to. I popped into the gym on the 3rd and explained to your husband the situation and said I need to set up a new direct debit to continue my membership - he gave me a direct debit form which I filled in and handed back. I received a letter today from the company you hire saying the direct debit was set up and I had 12 payments to make before I could cancel. I never agreed to a 12 month contract and your husband never said I was signing up for a new 12 month contract - I was just looking to fill in a direct debit form to keep my membership going as long as I kept attending as per arrangement with my wife. Am hoping it's just a misunderstanding as I'm not prepared to sign up for a new 12 month contract I'm afraid. Regards Her reply was: Hi ******* I am sorry but we have moved over to Direct Debit now and this is managed by a third party. I am afraid it is a 12 month contract however this also guarantees that you will maintain the same membership amount for a year even if the membership goes up. The only other option is an 8 month contract. Let me know what you want to do. I am sorry for any misunderstanding. Thanks I have always paid by direct debit so dont get what she means "we have moved over to Direct Debit". I want to continue at the gym but not on a 12 month contract, all I wanted was a continuation of my current membership. My membership was due to finish about the 6th and I signed the new direct debit on the 3rd, still within my membership year to keep it rolling. There obviously was something on the direct debit form which said it was a new contract or something but it was not pointed out to me or explained and I failed to notice it. Is there anything I can do? Thanks!
  2. Which bank was this? - Clydesdale Bank Did you agree to take out a new loan????? No chance Although a DCA is involved I take it I send my CCA & S.A.R - (Subject Access Request) to the Clydesdale? I'll extend the dates by a couple of weeks or send them after New Year?
  3. Morning, Wondering if someone could give me a bit of advice. I took a loan out in Feb 01 and was told by the bank I had to take PPI to "ensure" i got the deal I was given. A couple of years ago I got into a bit of financial mess and approached the bank to remove the PPI so I could afford to keep the payments up - the bank refused but offered to give me a new loan without the PPI but when quoting me the new deal it was only a few pound less than I was paying back anyways. I ended up being defaulted and handed over to a DCA (Jeremy Sutcliffe) and I agreed to a new repayment figure, but a few months down the line they insisted I pay the full payments or get taken to court etc which I have managed to maintain thus far but is a real struggle. I am currently paying a few £ over my agreed repayments than the original loan agreement. 1 - My repayments still include the PPI which is approx £82 a month - should I still be paying this on a defaulted loan? 2 - Also I'm not use to this but if i'm defaulted is the interest still added from the original agreement or should I just be paying back the loan amount - have already paid back over £22000 on a £15000 loan. 3 -I made a claim on my PPI (resulted in them paying my loan for 2 months) can I still claim back my PPI minus the money they paid out? If I could somehow settle or get these payments down (£260 a month) it would take a lot of strain away from my finances & stress from me. 4 - I have a CCA & S.A.R - (Subject Access Request) here ready to go, but am also wondering if it's worth sending a letter regarding the PPI? If so any templates I could send? Thanks for any advice

  5. Morning all, Am looking for some advice regarding PPI but will need to give you a quick history. I borrowed £15000 from the bank and was told to take PPI out to ensure I got the loan I was looking for, over a period of 10 years. (think i'm into year 7 of repayments now). I was paying £256 a month including £86 PPI per month. Unfortunately I took ill 5 years into my loan and the PPI paid my loan repayments for a period of 5 months but I ended up losing my job through ill health. During this illneess/unemployed period I ended up in financial difficulties and started missing some payments on other credit cards/loans. I did manage to regain employment quickly. My new jobs pay is a lot less than my previous employment & i approached the bank asking them to cancel my PPI as i could no longer afford to keep up my repayments - they insisted I would have to do a new loan at a higher interest rate and it worked out at the same payments as i was currently on but I refused to do this. I struggled on and ended up being defaulted on this loan and it was passed to a Debt Collection Agency. I remorgaged and paid off a lot of my loans/credit cards but not this one as the DCA asked for a huge settlement figure. I am still currently repaying £260 a month the the DCA for this loan, more than my original agreement as the DCA insisted I had to do - this still includes the PPI protection. I have roughly paid around £21,500 back to this loan and still have a few more years to go, of which £7000+ has been to PPI. I have been unable to to find my credit agreement and am wondering how I go about getting a copy - is it worth asking for a S.A.R - (Subject Access Request) & CA copy? Also who do I approach, the bank or the DCA over this. Any advice or help would be appreciated. Thanks
