  1. the fine is £185 and compliance stage is £75 until they make a visit. i will contact them to tomorrow morning as i dont want them to visit my exs house has she very vulnerable and dont need bailiffs banging on her door in the early hours!!
  2. "file an Out of Time Statutory Declaration with the Traffic Enforcement Centre!"? who would be out of time? me or tfl? this is the 1st ive heard of this action so how would i be out of time, and being that its 8 years old surely it cant be actioned on. i just dont understand why its taken so long for them to send any paperwork etc, i was living at the address for 3 years after the said non payment so they had plenty of time to come round my house etc etc, but nothing, i dont live there any more nor do i live in the same town.... just confused why a warrant wasnt issued back in 2010.
  3. there has been no letters or notices sent by tfl or the bailiffs to the house, if i type the pcn and my old reg number in the tfl cc website it says 20/12/2009 23:10:01 PCN issued 25/02/2010 19:00:01 Charge certificate 12/08/2010 16:44:57 Debt registration accepted 13/08/2010 02:00:55 NoDR sent 07/02/2017 13:53:36 Warrant Request Accepted 07/02/2017 13:58:40 Exported to Enforcement Agent(Marston Group Ltd) the pcn was issued 8 years ago, i left the house 5 years ago, i had no notice about this charge so why are they acting on it now? 8 years after? why wasnt a warrant issued back in 2010? and if a warrant was issued why wasnt it acted on, the warrant only lasts for 1 year from date of issue. i did not know anything about this until today so why should i pay it, surly Under the Limitation Act 1980 debt if any, is void because its over 6 years old i lived at the address 3 years after the pcn was issued, why didnt they chase it? the history of the pcn is above, it clearly shows no enforcement was acted on, its says a charge cert was issued but i never got that or anything else.

My ex gf of 5 years has just got a marston notice of enforcement letter in the post for me for a non payment of congestion charge going back to 2009, yes 2009!!! she is very worried that bailiff will knock on her door etc, i moved out 5 years ago and no longer have the vehicle in question, this is the 1st ive heard of this and dont want to give my ex any stress. so my questions are, is this still valid after all this time? is the notice from the bailiffs valid? what can i do to stop this action? any help please rich

    Vat ive started a new company and investing in equipment to hire out, my question is, im vat reg and im spending a lot on vat in buying the goods and renting them out, so the vat income is far less than my outgoing vat amounts,,, can I claim back the vat? if so for how long? many thanks

  7. it is my belief that she was sacked for whistleblowing on a staff member and when she followed it up the manager didn't like it
  8. hi, my girlfriend was sacked today only after she got a contract of employment yesterday! (she has worked there for 9 months), the reason the company stated is that "shes not right for the company" which is rubbish because she excelled in her job and was told many times by her directors, however it appears that a manger took a disliking to her because she reported that a fellow worker was under the influence of alcohol in a company that operates fork-lift trucks, heavy press and cutting machinery and 40ft trucks in and out all day, when after a few days she reported it to this manager she ask if anything had been done about it or she would go to a director to report the problem, the manager did not like what she said and made up a story saying that she's not right for the company,,,,,, ive got more info on the subject but was wondering that if she was unfairly dismissed? any info please
  9. the building insurance is with the mortgage company, and because im living there and not my landlord the insurance would be void as im not the policy holder (under the t's & c's of the policy) , this was told to me by the mortgage company. building insurance is must if the property is mortgaged, it doesnt have to be the mortgage companies insurance but a building insurance must cover the property,,, if ther LL owned the property outright then he doesnt have to have an insurance in place. my point is the the LL did not have the right to sign in the 1st place making the agreement void, he as not acted as if a agreement was in place because there is no insurance as stated in agreement and repairs have not been done since nov 2011!! the CAB have said there is no agreement, the mortgage company say he did not get consent to him renting it out, which he should have had in writting as stated in the agreement steve_m, you say that you are renting a property out?, if your tenents sub-letted the property under an signed agreement would you be ok with that? or would you say there is no agreement in place because your original tenent did not have the right to issue AST (thanks for your input btw),,.,.,
  10. i have spoken with the mortgage company and said that im the tenent and does my landlord have a right to rent the property out.. they have said no and that i had no legal right to live there paying rent, also if the house was to be reposessed i also would have no rights and would be evicted on the street, futher more the buildings insurance is also void as the policy holder (my landlord) does not live at the address and as been absent for more than 60 days, the mortgage company also said that my landlord had no right to enter into the contract and in there view the contract is void and to seek futher advise
  11. i went to the C.A.B today and they advised that there is NO contract between me and the landlord, the landlord needed permission by the mortgage company to enter the agreement as stated in the contract but he didnt get permission therefor the contract is void, i was advised to write a letter to the letting agent stating the facts and leave if i wanted to. it would then be down to the letting agent to issue court perceedings against me if they think they have a case.
  12. just spoke to the mortgage company and they say that he is in breach of there contract, it is not a buy-to-let mortgage and he doesnt have there consent to rent it out, he is behind on hes payments and has cancelled the DD,,,, all i need to know is my contract valid because he knowingly entered it without getting permission to enter it in the 1st place
  13. the landlord knows about the letters because he has cancel the payments,, i dont understand how the agreement can be valid, the landlord as clearly misled the agent and myself and is in breach of his own contract, surely it makes it void if it went to court?
