I would say don't go to court straight away - take any and all reasonable steps to resolve this first e.g. the UKPO mediation service - if you loose at court then what? the court enforces the law not 'fairness' as we perceive it , just because the consumer calls it 'excessive charges' doesn't mean its illegal - a point we should all remember from the bank charges case - and if they have better lawyers to argue this - well......what does recent history tell us.. may i also suggest you go the UK Copyright service site - its not affiliated with the UKPO its a private company - but it has lots of info and similar questions from people in a similar position. again all the best
  2. Hi all, Dear Sir..first - stay calm - these companies merely use the tactics of debt collectors to panic you into irrational behaviour and knee-jerk actions. Second, the the UK Intellectual Property Office have a mediation service - why not try there first - rather jump to courrt.? also I beleive the essence of IPR is meant to stimulate business and growth not hinder and if it does hinder economic growth then it - the copyright - perhaps could be invalidated - so perhaps you need to find out about 'fair use' as well - again ask the IPR office. PS ...tiger aspect productions advertised - on this CAG website- for people like you to go on TV to talk about these sort of problems again another avenue Anyway , all the best, and stay calm.
  3. Ellis, get on the phone to the CAB , CCS or even your local council Money Advice Service straight away-please- maybe e-mail them if its easier than to talk straight away about it. Just get away from these private companies ps the phone calls won't stop even after CAB intervene so get your number blocked/changed

Perhaps try asking the CAB (citizens advice) about challenging Barclay's on Consumer Rights law on supplying misleading information to FOS? more importantly they (CAB) perhaps could get charges frozen - thats the key to prevent it getting worse. Hope this helps - PS my experience is the banks and FOS rely on you to give up after about 6 months so your not going mad - it is a strategy they both use. I have a FOS complaint going back 4 years...
