Hi so i sent my Prelim letter (also csaying im in hardship as i am on JSA)with a spreadsheet of my charges, and i recieved a letter saying they acknowledge receipt of my complaint and quote "we believe that your complint concerns the level, fairness or lawfulness of the charges". So does this mean they think that im not in hardship? They also attached a form to fill in for me to write down my income/expenditure. (which i had already sent one of my own that i made). I am in real financial difficulties at the moment and on a DMP with CCCS, and i have been on JSA for over 12 months now. Natwest are STILL charging me. I don't use the account anymore, but because my balance is now £1900 and my limit is £1250, they still chose to do so. However, this month my statement show no charges but interest of £47 plus a further £17!!!!!!!!!!! I can't cope anymore with this and don't know what to do next. Can i claim the overdraft interest back??? I did ask in the letter for them to stop charging me interest as i am only on £64 a week. Ive just sent the income/expenditure form off to them, but should i send a Letter Before Action letter to them aswell and continue to the court process??? Please help, thanks.
  3. Hi im ive been on a DMP with cccs for about a year now and had to add my overdraft on to it 2 months ago because i could not pay what they requested. My balance was £1800 when i added it to my DMP, im paying just over £50 per month but they are still charging me interest plus charges!! My balance is now over £1900, so logicaly i am never going to be paying anythng ff because of the interst and charges , can they still do this?? even though im in financial hardship?? My agreed overdraft limit is £1250. Natwest are really driving me mad and i shall never be banknig with them again. I have over £600 in charges which i am going to start the process of claimimg next week. They know that i am in financial difficulties so why are they still charging me £28and over £40 in interest each month??? cheers
  4. also forgot to say they also refunded interest which was more than the 8% i claimed lol. Just rang them to ask when are they sending the cheque out, and she said tomorrow .
  5. Received a final letter this morning saying they will refund all charges, so thats my debt with them cleared and a few extra quid in my pocket . Cheers for the help guys1! now onto my next claim
  6. Note that they don't have to pay the 8% interest unless you take it to court, but you can try and claim it which is what i have done
  7. no i don't think you need to restart, on your next letter you send which should be you Letter Before Action, just state that if they don't refund the full amount you will be claiming the statutory 8% interest and court costs, tehy will then either offer you another amount or the full amount which will be their full and final offer, if this offer is not what you want then when you make the claim to court just add 8% interest using the spreadsheet provided on this site. They have just offered me the same as you but i will be claiming full amount plus 8% interest, hopefully i should have another offer through within the next ten days

  9. Hi to my surprise i had an offer this morning from creation! They have offered the difference between the charge and £12 plus interest, this totals £1099.85 but my original claim for both accounts was £1647 plus £336 in interest. They said they have credited the money onto my accounts, this now means that one account has been cleared and the other has around £200 left. Should i reject this offer and claim the full amount??? cheers
  10. ....Also i have been on JSA for 13 weeks now, does this mean i am exempt from court fees? If so what do i need to do in order to be exempt, do i have to fill in any extra form etc.
  11. Hi i sent my LBA to Creation Finance on the 17th of Feb, which they received on the 18th Feb, but ive had no reply from them as yet . So im going to begin the court process over the next few days, so i was just going to ask you guys how i should prepare for this?? Do i simply just send the N1 form to my local court and let the rest do its part? I sent my LBA on the 17th recorded delivery and the only reply i have had so far is a letter saying that i have informed them that i am having difficulty in making payments on my account and that a financial statement has been sent to me for me to complete. Why have they completely ignored the letter? Don't they read them properly!! I HATE creation, has anybody WON their money back yet from creation as i am finding them very hard to deal with. I have decided to give them until the 6th march to respond properly to my LBA, then i start the court process
  13. I have all my charges from the last 6 years that have been added to my overdraft and im about to send my Preliminary letter out this week. However, quick question, i have been getting charged around £28 each month for the past 5 months or so because i am over my overdraft limit, and so they have been taking around £30 in interest each month on top, which comes to around £60 in charges!! Can i claim this interest back? or do i simply stick to the 8% statuary rate? cheers Also can somebody post me the link to the spreadsheet for financial circumstances?? (I am in hardship at the moment)
  14. I received a reply to my preliminary letter this morning. It simply says that they are investigating the matter fully and will contact me with their findings within the next 20 working days. Is this the standard reply from creation? cheers
  15. hi ive just received my statements for 2 store cards i have with creation financial services. I have written all charges from both accounts onto two separate worksheets in excel calculating the 8% interest (i know this can only be claimed if reaches court). My question is do i need to keep the accounts separate when claiming on do i simply add all charges together? Account number 1 i have £740 in charges and account number 2 i have £907 in charges. I am about to send my Preliminary letter but like i said im not sure if i am required to send 2 Preliminary letters (one for each account), or just the one letter? thanks
  16. finally received my statements today, i have £740 charges on my jjb account and £907 on my nevada bobs account. When i send my preliminary letter do i add these 2 accounts together?
  17. received 3 of the same letters this morning, each containing the transactions on my account. However, at the end of the statement its all very confusing, firstly it says "UNABLE TO COMPLETE STATEMENT - Note: further transactions may exist", and at the end on the 25/11/08 my balance reads £411.44, however it then reads on he 27/11/08 "Debit Adjust" -£345.83, balance £757.27!!!! Can somebody please help me with this i havnt got a clue what this is, why have they added £345 onto my account?
  18. Ive just been on the phone to creation again to see what the score is with my statements. By now they should have received the DPA reminder i sent last week. Dont forget my original letter was sent out on the 1st of december so ive already gave them enough time to send me them. The guy on the phone said somebody is gonig to phone me other the next couple of days to sort it out but this is what they have said to me twice before in the last 14 days or so, so im not expecting a phone call this time, i dont know what to do now, should i give them another week? If so and still no statements what is the next step for me? Do i claim for estimated amount?

  20. well i got my bro to post the first letter so im not sure if he did recorded delivery , but ive sent another letter out this morning recorded deliver as a SAR reminder and gave them 10 days to reply
  21. arrrggghhhh!! Right the £10 postal order i sent in with my SAR letter has been credited to my account, they really are taking the **** now. So they are either extremely thick or trying to do their best not to send me my statements. Just spoken to a guy from creation now and he actualy seemed a decent person for once, he new what the score was and is trying his best to solve the matter, but he said that they cant find the letter that was in the same envelope as the postal order! Now im having to wait until they have solved the mixup
  22. hi, i have to spoken to hfc again about them not yet sending my statements out, the lady said that they have not yet received my letter however i did not need to send them one because they can send out the statements if i would of just asked over the phone. But i have asked in the past and they told that they cant do this over the phone, all very confusing as to why they would change their minds. Anyway she said she will send my statements out to me, so what happens with the £10 postal order i sent ??
  23. Hi im just about to send my preliminary letter but i dont know what amount i need to put down for interest? I have £527 in charges, can someone please tell me how i calculate the interest for this, or do i just look through my statements and add whatever interest is taken each month? cheers
  24. ive just spoken to creation again and they have taken the reference number from my postal order receipt and gave it to the missing payment department, has anybody had the same thing done to them before?
