Its the childs dad oldeŕ child. Mum told dad no to taking her and theson out of school for a holiday as per the law. This is the first time he has contacted mum in 18 mths regarding there children. Hi. We are hitting a brick wall and dont know what to do. My family and l have been trying to report a profile that is pretending to be someone else. They are using the name of a female family member and faking her age, real age is 9 but saying she is 14. We know who it is and they have refused to stop despite us asking them informally and formally. In person, on facebook via messages, on facebook via posts on profile and comments on posts and formal letter to the address. We have been blockd from posting or messaging the page but can still see it. Spoken to the police who has said not much they can do other than go round and request they stop. We requested the do this but it did not help. The person despite being there, well the tv and laptop were on, have not answered door. They have left cards for the person to contact the and still no contact. Quick call to the ICO who have claimed not much they can do. Reported to facebook as Fake name Fake account Something else. but nothing done. Cant report it as Pretending to be someone else as they then ask you to select who but the person is not on facebook so cant Select who they are pretending to be. Tried to speak to facebook but they are being less than helpful What do you all suggest

Just a thought but would the sellers not use a different delivery company. Instead of just refunding the items

Your welcome. See where it goes but no harm in starting to gathering evidence for witness statements and bundles. Just a thought do you have the item still. I ask as if you do you could take it to court and show the Judge the items condition etc. Anyway this is getting ahead of yourself. Just start printing off and putting in a folder anything you might need from Ebay and Paypal Most importantly the Listing as that will be evidence on the not described part. Bank should have all your statements as they are fully aware they are meant t keep these records. Mabe a SAR to the DWP asking for ALL your records from the time of the loans and all payments of benefits paid to you including deductions and amounts.

Some one with a bit more knowledge will have to make this a bit better but the basics as l see it that would need to be pointed out 1 Yes, it is agreed that on date l did purchase a motor and foot control from Claimant 2 Yes l did open a claim mistakenly saying it as wrong fr the machine. I should have opened a not as described case. 3 Yes the claim was closed in claimants favour. 4 I did not do a charge back with financial institutions 5 I made a PayPal claim on xxx that the item as not as described. Item was clearly listed as new when it was not. 6 Claimant had 6 days to respond to my claim and failed to. 7 On xxx PayPal closed the case in my favour stating l did not need to return the item. 8 On date the claimant made 8phone calls to me while l was asleep. 9 During the last phone call the claimant was constantly shouting and making threats towards e. He refused to act reasonably and during a 12 minute conversation was told he would be hung up on if he did not act reasonably. 10 the phone called made my partner and l feel rather distressed and threatened. 11 I contacted ebay who advised me t0 report the seller for breech of ebay rules and abusive behaviour. They further advised we block him and report him to action fraud which we did 13 we are unaware of how the claimant got our number ebay said it was not them that passed it on 14 On xxx we left for a 3 week holiday to Greece during this time the seller sent a recorded delivery letter that Royal mail marked as Delivered on Date ke sure you have tracking details for this if it was not sent recorded then state this 15 on date claimant issued this claim 16 the claimant was asked via email to send a returns label they have ignored you

Well how much of that is true eg did you open a ebay case saying wrong one. He states you done a charge back with the bank l am assuming. Did you do this. When did he make the phone call and when was the recorded letter received

Basically put a defense in with a few breif details. What does the poc say

Do u have bank statements dating back thst long. A pre deductions and during deductions. Only ask as if you can work out what you should have been getting and any deductions taken off can be added up and see if tallys.

@AndyorchJust a question it is related to this but more general as well. Could Mdot or any other defendant ask the courts to award costs against the discontinuing party once it has got to this stage. Mdot has incurred research time costs as well as other time costs like paperwork etc.

As Dx said Also if they refuse you keep the email and ìt shows you have acted reasonably. Another thought can you print off the claim you made. This proves the seller had time and done nithing. A holiday is not a excuse according to ebay. Further to this nor is a bank holiday.

Ok just a thought could you contact ebay via the chat option rather than the phone option. When l need to make contact with ebay l get the bot but go threw until l get the speak with representive option which then gives me a chat with or call option. Then chat option gives you a option to have it sent to your or you can request the rep sends you a copy of the chat and use it imo l woould not send the item back. You have the item and its the bargaining chip. I would write to them advising that you have followed the rules with ebay and pay pal and as result you will bring this to the courts attention. Advise them that under the consumer rights act 2014 they are responsible for return costs and you require them to provide the returns label for that. Further to this you require proof of loss and interest lost. I very much doubt they have lost much interest or anything. Oh and why did ebay not sort this out over paypal. I would have opened a ebay case over a paypal case

I dont now about PayPal claims but l do know about ebay claims. I have had to use them a few times over my 12 years as a buyer. @just_jue on post #9 is correct on some of the stuff said. Some sellers have said all returns have to be approved by them other just leave it to the ebay system. This meaning that automatically ebay issues returns label that sellers only pay for once the item is used. According to a recent agent conversation with ebay, via telephone as l had another unrelated to this issue, as my item was not as described, and l asked for a return due to this a label was automatically issued. The seller could choose once label issued if it was feesable for them to accept the return. The label would cost the seller £3 with the item being £1.99 the seller opted to refund me and l did not have to return the item. I did cover my backside by messaging the seller asking if they want the item back. The still have not replied its been about a month. How has the seller got your phone number. ? A few years ago l had a seller request my contact details which they got from ebay. The seller then proceeded to text and call me several times a day. they got a visit from the police but it was not before l complained to ebay. According to ebay it was perfectly legal for the seller to obtain my details as it was in the terms and conditions. @just_jueis also right on the seller obtaining the phone number for courier contact. I recently brought some sets of drawers and wardrobes off ebay, it was cheaper than using the company directly, A message in red capital lettering came up when l put the items in my basket saying WARNING *THE SELLER* WILL REQUIRE YOUR PHONE NUMBER TO ARRANGE DELIVERY OF THIS ITEM IF YOU CONTINUE WITH THIS TRANSACTION. when l went to pay l got this message is Red capital letters. WARNING *THE SELLER* WILL BE GIVEN YOUR PHONE NUMBER TO ARRANGE DELIVERY WITH THE COURIER IF YOU BUY THIS ITEM True to the statement the seller contacted me regarding delivery and so did the courier. l have used *The Seller* instead of company name.

All the letters have been written. Consultants for the husband from each department GPs letters occ health. All paperwork re diagnosis from each department with detailed write up on the treatment meds etc. Wife GPs letter with details on her treatment and meds. Occ health has even got a killer report done by the council saying they cant put a stair lift in due to how unsuitable the stairs are and full drawings etc. This is because some nights he cant get upstairs to bed. Tho they wont move them up priority list and they cant give them any propèrtys.

They are registered but its not easy to get a move. Needs to stay local to here due to work, treatment and the family are here. Also living on the worse road in the area does not help and most flats in the area that are ground floor are 1 bed but due to disability a 2 is needed. Bungalows well council might as well be non existant. For every 1 you have atleast 20 people waiting for it. They are not classed as high enough priority as the flats are mostly for familys with children. Most of the children are older but they have 4 grand children here. Then on top of that the further problem is if they move to far the wife would have to give up work and that is what is keeping there head above water and her mental health in check. They wont have the support network or a second carer of the daughter so the council would further need to move her but she is private sobthey cant just move her for no reason. They have been made aware of needing to challenge the decision and will be deciding what to do. As l hope you all can understand fighting this is draining and they have been fighting for a while now.

She wont post herself to embarressed to ask for help on this. Tho l have offered to help she dont really want to take it but has said to see what l can do. This has took months of trying. I even had to persuade them to appeal the no benefit and go to tribunal.
