  1. Its probably because Im arranging my own DMP, and they would rather me go through CCCS or Payplan
  2. not yet, Ive had that much on my plate with my DMP ive not got round to it yet. Having said that, Cahoot are the worst creditor that i have dealt with, they are refusing to accept any kind of reduced payments. Therefore I need to look into this in more detail. Watch this space
  3. The problem is - you can make a complaint, and you will get an apology generated by computer. Then you can complain to FOS but nothing will get done, we are just the little people! I have a very low opinion of Clydesdale / Barclay's. They don't seem to have any respect for their customers.
  4. OK these muppetts are winding me up now. Ive still no CCA (must complain to Trading Standards this week), passed on to Mercers. So I sent Mercers the usual bog off letters and telephone harassment stuff. Now they are phoning me at 9am on a Sunday morning (when I have a hang over) Who do these people think they are? Are they above the law? They ignore my CCA requests They ignore my complaints and they ignore my request to stop telephone calls.
  5. Yes that is a breach of the Data Protection Act. Clydesdale are swines to deal with, I am having a battle with them at the moment as I am trying to arrange my own DMP and they are having nothing of it Send this - Re: Harassment by telephone I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.   8. I agree Curlyben, 6 months ago i wouldn't have said boo to a goose, now i have a new found confidence and i am loving it. All thanks to CAG and a bit of help from a new work colleague who is the most confident person i have ever met (after witnessing how different people treat him to the old doormat me)

I know that you should never talk to these people, but I really enjoyed it and I'm a big boy I can deal with people like that all day long
  10. Hi Harvest I have not even started with the charges yet! I sent a CCA request and they have virtually admitted in 2 letters that they do not have it. They have however passed the account on to Mercers and they continue to charge me fees and interest which is illegal.

On xxxxxxx I sent you a letter regarding my offer of pro rata payment – You did not reply. On xxxxxxxx I sent the same letter via recorded delivery – You did not reply. On xxxxxxx I sent a third letter via recorded delivery – You did not reply. Today I have received a letter from Blair, Oliver & Scott threatening legal action. As you are unprepared to enter into any correspondence with me I require you to inform me in writing of your internal complaints procedure, failure to do so will result in a complaint being registered with The Financial Ombudsman Service.
  13. I'm in a pickle on how to approach this. I made them an pro rata offer through my own DMP. they have wrote back and eventually accepted it provided I make the first payment straight away. What should I do? Can somebody point me in the right direction of a template letter informing them that they have not complied with my CCA request due to separate terms and conditions and no right to cancel doc
  14. I have just received my statement and they are adding late payment charges, over limit charges and interest of around £90 whilst they are commiting an offence!!!
  15. SAINSBURYS!!!!!!!!!!!!! They keep ignoring my letters (3 to date, all recordered delivery) Now I have received the usual threatening letter from Blair, Oliver & Scott!! I am really mad about this and could do with a bit of advice. Should I complain to FOS or to Sainsburys and what should I tell B,O & S in the meantime?
  16. I keep getting letters from Mercers asking me to call them asap to discuss the matter further I am going to make a formal complaint about Barclaycard, whats the procedure and who do I make it to? Is it Trading Standards or OFT and should it be by letter or telephone.
  17. Ive just recieved a letter from these for an old debt that first national sold on. They are threatening me with a home visit! I can't wait for that, should be fun
  18. In 2 days time they will be committing an offence, I will therefore make a formal complaint to the OFT (not that they will actually do anything about it)
  19. What was the insurance for? If it is PPI then it was probably mis-sold, especially as you are self employed Has the agreement been signed by you and on behalf of Welcome?
  20. Please bear in mind that I am still quite green with regards credit agreements, however I was under the impression that the signature had to be on the same page as the prescribed terms. Also Cahoot have executed the agreement before I have signed it (not sure if this has any relevance) US

Send this to the company threatening a pre-bailiff visit - Dear Sirs Account Ref xxxx Please be advised that I will only communicate with you in writing Should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.   22. Hi again Paul, Its that different from all my other Credit Agreements I thought I would post it up here for the professionals to look at. Don't the signatures have to be on the same page as the prescribed terms? Plus Cahoot's signature is dated before mine! Does this have any relevance. I'm doing so well at the moment with other credit agreements, maybe I'm getting a little carried away.
