  6. I started claiming for my charges last year, around August, but for one reason or another, I stopped... I had got to the stage of having to apply to the courts and at the time, i just couldnt afford the court costs. Do i have to start right back at the beginning, or does anyone know or have used, a letter readdressing all the previous correspondences? Dont really want to have to start all over again, but if I have to, so be it! Any help or advice would be most appreciated - I have all the copies of my letters and their replies.... and all the bank statements, of course!!
  7. Just wanted to let you know that I received my cheque today! So yours should be very close behind (even waiting for you on the door mat when you get home)!! Usual things, dont disclose to third party, full and final settlement etc!! Will wait for it to clear before I stop the court proceedings!! Good luck kidda, keep us posted!!

  9. question for one and all!! I wrote back to Cobbetts, accepting their 50% offer as "partial payment". Their lovely offer was only open for 7 days. This expiry date was nearly a week ago and I have heard nothing. No large full settlement cheque, no correspondence from either them or the courts, zilch! What is my next course of action? Do I sit and play the waiting game, wait for the courts to allocate me a hearing date or do I write to Cobbetts and ask them where is my 50% cheque/full settlement cheque? I need this money as I am still out of work.
  10. No, when I went to file my AQ, the very helpful lady told me that we were looking at December! Hoping it isnt going to come to that though!
  11. Have still been persuing this claim but unfortunately not been keeping my post up to date (slapped wrist) Well, my AQ date was 30 Sept and I had a 50% offer letter from Cobbetts on the 2 Oct. I wrote back accepting it as PARTIAL payment and would still be continuing my claim for the rest (with interest). Am just still playing the waiting game now. Having looked at other posts, I think I should be hearing something quite favourable within the next week. Keeping everything crossed!! Once this is in the "bag", am off to file the other 3 with MCOL!! Speculate to accumulate and all that. Will be a nice little nest egg (or January sales pennies) when it all comes in! Will keep you updated!
  12. Hi!! I too have received the standard 50% offer letter! I too have drafted a letter saying I will accept it as PARTIAL payment and will still be recovering the rest (with interest!!) Copy went to my local court too. Having looked at other threads at this stage, I think we should both be expecting our cheques before the end of the week!! CANT WAIT!!!
  13. Thanks for all that! Yes, its now in my local court. Have also had a 50% offer from Cobbetts, obviously rejected it and popped a copy of the letter into the court on Friday! just waiting for my big cheque now!!
  14. Hi I am currently waiting on Natwest to repay my charges, the date of the AQ was 30 September, I sent mine early, Cobbetts sent theirs late!! However I have just noticed that they are still applying charges to my account (ok its only another £40 but its my money and as i am currently on job seekers, that makes quite a dent in my incomings) Can I still add to the amount being claimed? Or will i have to start another claim? I am sure I read somewhere that we can continue adding up until the day they agree to settle? Help, please!!
  15. Nice to see they are following the same pattern! I too have had the "intimidation" letter from Cobbetts!! Those people are being paid a fortune for churning out the same stuff over and over! Makes you wonder why Natwest dont just cough up, their legal fees must be nearly as much as our claims put together! You'd have thought the penny would have dropped by now! Good luck, I'll be watching your progress closely! I'm at the court in Tamworth, so I assume their timescales are about the same as Warwick - at least we know we will get our money back, its just this waiting game, its driving me CRAZY!!

Hi - I am at exactly the same stage as UK Joe - my AQ date was the 30th Sept too, received a copy of their AQ today (dated 30th Sept) but stated in their letter (dated 2nd Oct) that they have posted it that day!! One rule for us, one for them hey! I am really hoping to get some good news in the next week or so as since starting the claim against Natwest, I have been made redundant and really need this dosh! Then I can "speculate to accumulate" and start off my other 3 claims on MCOL! Good luck to all and I will watch both of your posts very closely!!
  17. Hi all - sorry its been ages since i've posted but i was unfortunately made redundant and have had pretty severe money worries! However, I have took the bull by the horns and have logged my first online claim with natwest! cost me £120 but I think its well worth it! Anyone give me any timescales? How long before CrapWest pay up?!! Will use "my money" from them to start the other 3 claims! So wish me luck and if anyone can give me an idea, please do!!
  18. Had a letter from a new person, Andrew Lea, Head of Banking Services: "I am sorry that you remain unhappy following a letter dated 10 May 2006 from my colleague, Robert Kerhaghan. However, as this was the banks final response I am unable to add anything further in relation to this matter. As advised, if you remain dissatisfied, you may contact the Financial Ombudsman Service" This seems a pretty "final" letter - another stalling/scare tactic? Dont particularly want to log a claim, costing me £80 and lose out.......

  20. Okay, I misread the advice then! Oh well, am being too nice to them! Havent heard anything back from First Direct so I suppose if it goes to a court hearing, it will make me look better-ish! Will stick to the next deadline like glue!!
  21. Hiya - just spent the last 20 mins trawling back through to see where i saw it!! Its on the Purplegirluk1 v Abbey thread and its a response from Vampiress. Any Advice, should I hot foot up to the post office to try and get the letter back? Sent it Recorded (as usual)!
  22. Hold fire on that previous thought! Read on here it helps our case if we write to the banks after the deadline, remind them and given them another 7 days as a "goodwill gesture" so the date to file my claim is now postponed until 31 May!! Wish the banks were as thoughtful as us!!!!
  23. I have read (somewhere within the forum) that it gives us more brownie points if we write to the bank and give them another 7 days to refund as a "goodwill gesture" so I have done that. Well, I have given them until 30 May and I will definately slap in my claim through MoneyClaim! Fallen, we will be at exactly the same stage then!! Have been a model citizen with First Direct too, and given them another 7 days too! What an angel i am!! (Not!)
  24. For my information too (!) Sorry for butting in here!! But when you file your claim and they ask for the total, is this the total before interest and you then detail the interest in the narrative. Or is the amount claimed the charges + interest?? I am getting ready to file 2 claims, one at First Direct and one at Natwest. Again, sorry for hijacking but other people may want to know too!!
  25. Well, their time has lapsed and i am counting the days to when i can log my claim (tomorrow is payday and "lift off"!!) I got home from work last night to a reply from Mr Higley to my last letter (when they added another £38 charge) with the following: "Thank you for your letter of 18 May 2006. I have noted your increased claim and assume that it will increase should any charges be added in the future. I should add that the OFT comment on 5 April was not a direction but a statement from them relating to credit card administration charges and we have until the end of the month before we are to respond. Our position remains unchanged, we will not be effecting a refund or taking any other action, and our legal team is ready to handle the proceedings you propose to take. However thank you for letting me know of this development" Well - not quite sure what to think of this, is this their normal "stalling" tactic and do I wait until the end of the month to find out what they propose to do, or do i stick to my timescales and slap in a claim through MoneyClaim?
