  7. Hi all I am at the stage of filing a claim against Halifax credit card, can someone let me know if they have already done this what address did they use for the defendant as the company is registered in scotland so mcol wont let me claim! Please help TIA
  8. Hi there Sorry to not reply to above messages but just in case you still need the answers..... Pixie I didnt tell them why I wanted the statements and I got them at no charge. Marksteps The address I used was the customer services one from the statement. HTH
  9. Well I wasnt expecting this..... Halifax didnt acknowledge my claim so I have just requested a judgement by default..... is this usual for the halifax???? what now!!!
  10. If this is going before the courts then surely you shouldn't be discussing anything in this manner. If its true it could only damage your case!
  11. I think I will, is there a template for the letter, I have had a look but couldn't find it. Having said that I do have a three year old and a one year old tearing round my living room at the mo. How did you make your estimate? Thanks in advance
  12. Day 40 What a surprise no statements..... I will proceed with an estimated claim I think. Let me know if anyone thinks I should do something different!!!
  13. Well I have still not recieved anything other than the last 11 months statements. The dealine is up tomorrow. I have had a letter today explaining the microfiche issue and saying that my statements would be forwarded to me in due course. Unless due course is tomorrow then they have breached the 40 day rule!!!
  14. Well done on recieving your offer, it might be just short of what you are claiming but worth it for you if you have a hectic month ahead and cant afford the time for court etc. I would have done the same thing! Congratulations My turn now lol
  15. I have sent my preliminary request for refund to halifax credit card. awaiting response now. fingers crossed
  16. OK I waited!!! Now I have filed claim with moneyclaim, I did this on the 10th May. Do they have 14 days from that date to respond. I am claiming for £994.00 inc interest. Fingers crossed
  17. I have still only recieved my 11 months worth of statements. In my letter I authorised them to take the money from my account as one of their advisors in the branch said this was ok. They told me it would still be cleared as a DPA request as authority to take money was enough to start things off (this was the case with my two other claims also - they just debited from my account). I have £400 + charges in my account in last 11 months. In response to my DPA reminder letter I just got a standard reply telling me they will respond within 4 weeks. Should I (a) Start to dispute the charges I know about and wait for the statements from previous five years to arrive. (b) Start to dispute charges I know about and then send off a new DPA request with the cheque and a complaint about mis information from their staff (why does this not surprise me!!) © Wait until I have all staements to dispute charges. hope some one has some advice for me the 40 days would be up 25/05
  18. Congratulations. I have been keeping a chack on everyones progress as i have a claim oing through money claim at the moment and stories like yours make me feel like i am not wasting my time. You and your family enjoy it!
  19. just recieved a printout from the last 6 years with a letter advising that there would be no charge for this. If nothing else I am pleased with the service and the speed in which I got these statements. I have £350 worth of charges so will now begin the long (hopefully not too long) road to getting these back.
  20. Hi guys. First of all what a great site, the advice on here is great and it helps to see other people in the same situation as your self. I have just recieved statements from abbey as requested under the DPA, but i only recieved the last 11 months. No letter of explanation with them and also they were sent with no charge. I have read about abbey and the microfiche saga so have sent the letter telling them that they have seven days left to comply with my dpa request. Did anyone recieve the info requested within the 40 days.

  22. Does anyone have a copy of what they put on their claim form as I am about to fil mine in. I have looked at the template in the library but just wanted to see what other people have put.
  23. I am sending my dpa request to halifax credit card today, not sure how many charges i have had but there is bound to be a few....

Any help here would be appreciated I have sent off my preliminary request and recieved a phone call offering six months worth of charges back... this i declined and sent my LBA The deadline for this ends on the 08th May but I have today recieved a standard letter from halifax confirming they will not be settling my claim and sending me details of the ombudsman. Do I now need to wait until my original 14 day deadline or can I file straight away due to the fact I have recieved this letter from them? I am claiming just over £800 of charges so I want to make sure I do this right cheers
