Jackie BG have done exactly the same to my daughter, raised a bill from Nov 06, or more precisely when she first moved into her new rented house without fully taking into account previous payments. Basically, when you look at the bill it's almost impossible to decipher how they have arrived at their cost. I suspect its been computer generated without human intervention to check that is correct. I will shortly be writing to BG and may send a copy to their chief exec as I am very annoyed at their continual incompetence. We have to date made several telephone calls to sort out her billing all with promises to resolve etc but to no avail. The moral of this story is to 'Bin BG' until such time that they can get their act together which unfortunately has been a long long time and still no better. It's about time Watchdog gave them another humiliation I think. Send your complaints to BG's chief exec, I am sure his name and address are on this site somewhere. Also mark it 'Personal and Confidential' then his secretary won't intercept it and add it to the thousands of other complaints.

Hi jonni2bad Thanks for your reply Yes I do see your point re bank charges versus interest etc. I suppose I would have to prove that the interest charged is excessive and is not clear within the terms and conditions provided. This was in the main my point, because if you look at the T&C's within a credit card agreement and then try and reconcile actual interest charged on your statement it is almost impossible to understand how they have arrived at their figures.ie, What is financial interest and what is punitive interest I suppose. I do think there is an element of both in the interest charge levied, it would appear to me they are not simply recovering costs incurred here. Its a double whammy every time! THEREBEL

  11. Hi everyone, I am a nightbird, hence the late postings. On the issue of interest charges, I would like to clarify what is deemed as recoverable ie. Interest being classed as punitive, therefore claimable by me against interest that is classed as being within the terms of ones credit agreement and therefore payable, no case to pursue etc. In my case, Abbey charged me what I would consider to be an excessive interest charge ontop of a late payment fee. My payment was about 11 days late according to their statement yet I made the request to my bank within 9 days. My point is, Are Abbey entitled to charge what is effectively a finance charge at whatever rate they decide? If so is this charge recoverable? This issue is not clearly stated in their agreement for sure. Further I was certainly a rate Tart and proud of it, and took advantage of their 0% offer yet at no time was it made clear that my rate would rocket if I defaulted and what the terms of default would be and that the 0% offer would cease forthwith for that account etc. I also think it is important to distinguish between one off punitive charges for paying late etc (the basis of the majority of claims on this site, I believe, correct me if I am wrong) and the interest that is levied against the balance owed. Abbey have been very clever in structuring their charges in this way splitting actual financial interest and punitive interest yet at the end of the day it all adds up to the same ShAbbey treatment that many people have fallen foul of because it could be argued that there is a financial agreement/contract in place and those are the financial/ interest terms agreed etc within the credit agreement. I trust I have not confused you all, but do you see my point? It will not however prevent me from pursuing my claim simply because I believe their terms and conditions were so confusing and unfair that any reasonable judge would find it difficult to disagree with my view. This I believe is ShAbbey's Achillees heel so to speak, they have spun such a complex web in their own T&C's and that those terms are not clear and unambiguous and are effectively rendered unfair and therefore challengable.

  13. Just got my 28 day, give us more time so that you may forget letter. No I am not going to wait as there is no legal requirement to do so. So I am going to craft my reply to the effect that unless I receive my cheque by the 14 day expiry date then I will file my claim on line etc with Claim Online. I note the point about interest and not to mention an amount till the claim somewhere on the site re Interest at 8% etc. I assume I should omit any reference to interest at this point. Is this correct???

Hi Cornflake Statements were issued by Abbey with notes on statements that card was issued by MBNA etc. I have since closed the account but am determined to recover severe penalty charges etc. When I closed my account (which was normally managed online) my letter snail mail correspondence was with MBNA in Chester as that seems to be their accounts office. I also note on my statement that Abbey Credit card has a PO Box address in Bolton. As a first shot I have written to MBNA as they wrote to me to confirm account closure but as expected they have ignored my letter. I think I will now write to both with a threat of legal action and see what that produces. The main point I suppose is who is the 'Penalty Raiser' here is it MBNA or Abbey?
