  1. I sent off my complaint for the refund of £100 in charges plus £100 for compensation and interest. I got a cheque through for £150 and a grovelling letter. I have decided to accept the £150. Thank you Druid for your informative thread! I think mentioning your case in my letter may have helped too.

  3. I haven't submitted this court claim yet. I have had a good think. Can I appeal to anyone that they refused my argument for hardship? I thought I had a good case to argue for hardship and this was only for a small claim. I don't think that I should have been ignored. I would like to try another route if there is a chance. This OFT case might not finally be resolved for a long time yet.
  4. I was in a bad way at the time and just informed the payees that the cheques had been stopped. Barclays got me in a big mess in the first place, so it was all their fault as far as I am concerned. I do have another question. Barclays sent me statements from 2000. Can I claim back the charges over 6 years old?
  5. That is good news. I have one final query on this account. I had to stop 5 cheques on one particular day and was charged £10 per cheque. This was to avoid larger charges. Can I claim back these charges? Thanks for all the help.
  6. I just noticed this thread. Well done. I will be following you down the same path soon. I think it is very apt they call their sneaky service 'Additions'. No one ever asked for it! I'm sure I never did. I don't even know what it is or how it got there.
  7. What about 'Paid Referral' charges? Can I sling those in as well?
  8. I've noticed that there seem to be a load of £7.50 charges on the account for the last year it was active. My son thinks it is for something called 'Additions'. He says he had this put on his old account without his consent as well. He happened to notice it and got it taken off straight away though. I'm sure I never asked for this. Can I claim these charges back as well?
  9. Things are slowly coming together on this. I had no account numbers to begin with. I got one account number from an unenforcable CCA that some DCA sent me and gave this to Barclays with my second letter. Those statements arrived today after pressure from the Information Commissioners Office. What is fantastic is that there is a transfer to the other account in the statements. I am forwarding this second account number to Barclays today. I'm sure they knew what it was anyway. They have no excuse now. Should I submit one prelim letter now or wait for the statements on the other account?
  10. Sent complaint to ICO. They replied about a week ago. They said they had written to Barclays on my behalf. I am going to wait until the end of the month and see what happens.
  11. Realised we only had 5 years worth of statements. We reminded them we wanted 6 years worth of statements. They agreed, but we are still waiting. Going to the ICO soon.
  12. I have had to drop this issue. The ICO wasn't much help. It seems they can say what they like when it comes to old phone calls. If I had wanted the recording of a recent call I may have succeeded, but it still appears that they can claim the call requested was one of the calls that they didn't happen to record. On the other hand, i'm sure they would be digging up calls 10 years old if it suited them. Not good. All calls should be recorded and readily accessible for a minimum of 2 years or something.
  13. Can anyone help me out on this please? Is it worth a complaint to the Ombudsman or Information Commissioner or are Halifax being honest for once? I just don't want to waste my time for nothing.

On a data protection issue I threatened Halifax that if they didn't willingly provide me with a transcript or recording of a phone call between us I would force them to hand it over with a S.A.R - (Subject Access Request). They wrote back and amongst the other rubbish the letter contained this paragraph: 'Telephone records are not kept for more than two months, and not all of our calls are recorded. Due to the vast amount of data that a voice recording represents, we are not in a position to store calls for longer than this.' If I can get hold of this recording I will have them over a barrel. The call took place in August 2006. They caused me a lot of trouble. If I get hold of this call I can sue them. Am I stuck here?

  17. I foolishly didn't send my prelim letter recorded delivery. I rang them after not hearing anything and they said they had no record of it. I sent another prelim letter recorded delivery and they wrote back basically telling me to go away. They didn't say they would make enquiries or anything. As I have had this negative response from them do I still need to wait for the 14 days to elapse before sending my L.B.A. or shall I just send it now?
  18. They replied today with a standard letter after receiving my prelim letter on the 24th January. They said they expect to complete enquiries within 4 weeks. Do I just send the L.B.A. on the 7th February without waiting to hear from them?
  19. Only a £100 claim or so. Got my charges info from the online banking archive. Thank God, no messing there then. Prelim letter will be sent in next days. £100 is better than a punch in the face. Hope no one thinks i'm being tight.

  21. That would be post 9 point 1. All done completely correctly and pedantically as it should have been. Carbon copies of all letters sent are in my possession complete with proof of delivery.
