  1. Had the same problem have a read here it makes interesting reading Seaman Arts | Traditional, digital artworks, photography
  2. have you the chance to appeal this with NPAS.. if so go down that route, you may find that this is worth doing... it will also give you a chance to save up the money if the appeal falls through, NPAS are very thorough and will pick up on any you may have missed or the council have failed to provide in way of details
  3. Hopefully the adjudicator will pick up on this as he did with mine have a look half way down the page with regards to this thread.. it may help http://www.consumeractiongroup.co.uk/forum/bailiffs/94493-bailiff-assaulted-me-9.html come back and let us know how you did
  4. I think you may find that he/she broke the forum rules and paid the price, mentioning names when he/she had been warned more than once.
  5. Im a bit confused with this sign, if this was out side the shop i was going to shop at I wouldnt shop there .. reasons being.. 1. I am disabled and I certainly dont like to be told how long I can shop for and the fear that I may not get back to my car in time would cause a stressful shopping experience. 2. If I wanted to return an item I would have to wait an hour to return it. Being a disabled person I may not have the opportunity to return after the hour has lapsed. It says nothing about disabled parking at all and I wouldnt class the wording 'designated' as to refer to disabled parking. Not being picky here but I for one would not shop /visit etc where I saw this sign and I doubt many disabled people will either, thus this business will lose my custom and money. Very Very disabled unfriendly .. I hope shops /business's consider very carefully placing one of these signs out side their place of business as they may risk losing customers.. sorry for the hijack
  6. Am I correct in assuming that all private parking companies have now to be members of the BPA as from October this year, and have to follow their code of practice?? Just wondered if mr perky was a member and has the BPA logo on his signs and tickets.. by the way if this has already been covered i apologise
  7. I found this an interesting read.. dont know if its relevant to this thread but interesting all the same BBC - Radio 4 - Transcript - Face the Facts 29 July 2005 please for give me if this has been posted before
  8. thats great news .. apologies for the hijack
  9. I like to think this is KARMA what goes around comes around
  10. have you ever attended a hearing? did you read the link i gave you did you read the second page or in fact any of it, the appeal was upheld not just because of certain procedures that the council failed to follow but because of genuine circumstances that had arisen when getting the said PCN. I was there I heard with my own ears what the adjudicator said.It was my mother whose PCN had also had the appeal upheld because she over stayed on a visitors permit due to the fact that she is disabled and couldnt get to change the permit in time the adjudicator allowed the appeal on that basis only. Im sorry that I dont have the proof you ask for to prove to you that I am right. You will just have to take my word on this one. there are some compassionate people in this world who dont look on every case with the eyes you do
  11. and I would get that how????? so what you are saying is that an adjudicator has to follow the exact letter of the law??? I can assure you that all circumstance are taken into account.. matter closed
  12. my bad it was a parking attendant, they are all the same in my opinion. By the way what IS the difference.
  13. The rules of the forum states about no names to be made public in the forums.. your transcript had the names on show.. thus it was taken off. like I stated rules are rules and you have to abide by them or you pay the penalty of having it taken down. unlike companies like yours you wont be charged for your mistake
  14. [edited] you could have posted it omitting the names etc. rules are rules and should abide by them .. I thought you of all people should know that
  15. This is just my two pence worth and my personal opinion.. so please no one spout off about road traffic acts etc..as Im blonde and wouldnt Know what you were talking about As I can appreciate that your land is your land and you pay X amount a year for the upkeep etc and why should Joe public park on your land for free or park there at all if uninvited or out stay their time limit etc etc etc you get the gist. Why does it have to be a money making business. You spend out x amount of pounds to get signs put up that most cant be read, pay out for printed tickets, pay wages to the man who gives them out or tows/clamps the cars.. pay out for the person to sit there all day waiting (like a vulture) to pounce on the car who has out stayed his welcome. when so much time and effort can be saved if you just put a warning on the car to start with or just get people to pay for parking like a pay and display. I some times think that these people who do this sort of business have no compassion and thrive on making peoples lives miserable because they perhaps didnt see the signs and genuinely thought they were parking in a safe place to park. It makes me angry that these huge shopping complexes have free parking for customers up to two hours as long as you shop in their shops, but if you pop off to get something else off of the complex you get a ticket!!!!! even though they were a customer. or you get a ticket for parking over the two hours. when you are disabled or have children you tend to take your time when shopping and it often takes more than two hours when looking around the whole complex. why do we have to shop on a time limit? most of these shopping complexes have ample parking spaces so its not like you are taking up space. I would also like to point out that never have I seen in this area that a Valid blue badge has to be displayed to park in a disabled bay. some disabled drivers dont have a blue badge. I didnt for years does that mean I cant park in a disabled bay. my tax disc has clearly marked on it that it is registered disabled. any way im rambling on now its just my opinion.
  16. The point im trying to make here is that NPAS do look at all aspects of an appeal not whether the person has a right or no right to park there. I have personally known a few cases where a PCN was issued where a permit was not present and because of circumstances the appeal was upheld not because the PCN was issued incorrectly or the council had gone about things the wrong way. these people were not residence either. It wasnt just the council either who were in the wrong.. the traffic warden was in the wrong also.
  17. we will have to agree to disagree here on this one Adjudicators decision on one of my appeals, might be worth reading, not that I am trying to prove a point here http://www.consumeractiongroup.co.uk/forum/bailiffs/94493-bailiff-assaulted-me-9.html pages half way done
  18. Have you ever been to an NPAS appeal ? they take ALL aspects into consideration.
  19. Have read this thread with interest. You have a valid cause to appeal these PCN's. I know that this may be a little late perhaps but please appeal these if you still can. When you get a notice to owner sent through you should have the option to appeal this with NPAS (National Parking Adjudication Service) They are independent people who look at these appeals and dont look kindly on the councils when they are in the wrong either. I am almost certain they will uphold your appeal. You had a valid reason to be there WITHOUT the need of a visitors permit.
  20. He is not excepting this as the amount is in dispute with the bank, and he is trying to claim the bank charges back. they have told him that he has to pay this and reclaim it back from the bank after they get the money from him first.. is this right .. can they chase him for this before it is settled with the bank.
  21. just wanna bump this .. any advice please
  22. A friend of mine has asked me if I can deal with this for him, so I thought why not, its for a business account that was closed about 3 years ago, he believes that the amount owed is bank charges that have built up over a period of time. These people keep calling him asking the norm etc about getting him to pay, they tell him if he pays a certain amount they will forget the rest. Its under £200. the letter reads as follows; Dear Sir, We can confirm that the offer of £100 by the 9.11.07 will be accepted in settlement of the above debt. This supersedes any previous arrangements in this matter. To ensure that your payment is cleared by the due date, it must be made 7 days beforehand. Failure to make payment as outlined above will leave us no alternative but to commence recovery proceedings against you without further warning. Any suggestions will be greatly appreciated.. by the way the letter was dated 25th of October and he only received the letter yesterday.
