  3. Hi Westy, The natwest cheaque is cleared I sent the letter to request defalt removal on around the 20th Dec 06. No response. I have been getting calls and letters from Interum Justicia demading the outstanding 127 quid. They are part of natwest/rbs group i think? What I was confused about is this: 1. The cheaque i got from natwest covered all charges and the court fees. I was sent to interum for dept recovery for over 800 qud with only 127 left to pay. The default was for 800 quid. I am requesting removal of the defalt and cancellation (which is what i requested in my letter) of the outstanding 127quid. Is this a bit cheeky? Do I still owe them this money? I think I must because it was related to unauthorised borrowing but inflatted as I had charges applied. 2. What kind of letter do I send to the RBS/NATWEST litigation dept...I couldnt find one in the template library. Is it the same procedure for defalt removal request when appliying to the courts? Thanks Westey, When you said "The attraction to me of putting it into an account they've registered a default against - and have specified it should go there - is that they have, de facto, admitted you never owed them the money adn they shouldn't have registered the default. It should make any action to get the default removed very straightforward." How do you think can go about removing the defalt? I was gonna call them and say thanks for the offer, I will take it but i want the defalt removed. IS that sensible? Cheers for the congrats too. jmac.
  6. Hi, following my court claim and them puttin in a defence for extra time natwest have supprised me. Natwest have just offered me all the 800 odd quid back (my whole claim). I recieved a recorded delivery this am with a letter saying it was commercialy unviable for them to carry on. There is a cheque attached for the full cash. The cheque however states pay me 800 pounds into ********account. Im confused. My natwest acccount hasjust under 200 pound left to pay off in dept and is with their dept collection acgency interum justica. The account is not shut nut acepts repyments. I would like to know 3 things. 1. The cheque is made out to me from RBS litigation section but has the natwest (cos RBS own natwest now) account number on it. Can i cash it anywhere? im worried it will only cash in my natweat account and that i wont see the money cos it will go to pay off the outstanding debt (see below) 2. The outstanding monies owed on that account. Should I contact them and say clear it and send me another (smaller) cheque or just continue to pay off the last of the money. Baring in mind this last 200 odd quid reflects the last of their charges on this very old account. 3. I had a defalt on this account attached to my name for 500 quid which runs out in sept 07(after 6 yrs). Their offer is for just over 800 quid. If i persue court stuff can i get this removed earlier? If i say thanks i will take your offer but can you take it off...will this work? sorry for the lond rant and beg for advice but im sitting here with the cheque and dont know if their tryin to pull a fast one. jmac x x xx x x
  7. I Know it sounds tight but every penny counts. Im filling in the N1 claim form in tommorow and want to include the £10 for the DPA request as NATWEST didnt meet the time frame of 40 days and i havnt sent the data commisioner the letter to say thats the case. Can I include the tenner in my 'value' part of my claim? Finally, I cant find the post but I think I read on here that it is okay to stop repaying my repayments to natwest because what I have left to pay them (220 quid) is less than my claim (770 quid) and I am about to persue a case against them to reclaim the monies?   8. Thanks Frank, Ive sent my prelim letter and got the standard response 3 days ago. Today sent the lba letter but only for the first couple of years because natwest are stilll draggin their feet about sending the rest and i wanted to start the ball rolling, Fingers crossed this was the right thing to do?! I sent the LBA prior to the 14 days because natwest was very rapid in their standard letter response (only 4 days). I think thats cool cos it was a fob off letter. Jmac999

  10. Hi just a quick Q? If im repaying Natwest via Interum Justicia (dept collection agency) can I stop repaying the dept if im questioning there charges? I only have 300 quid left to pay and I calculate they owe me 400 quid in charges back. I am about to send the LBA letter today but my next repayment of 55 quid is due today. Cheers Jmac
  11. Hi All, I have just sent my first letter to ask for refund of charges. My concern is that it took so long for me to get statements from Natwest that some of the charges I am claiming are for October 2000 onwards. I am worried that by the time I send of my N1 (after the LBA) it will have passed the 6 year mark. The other thing is that the "statments" are infact print outs but are headed woith CMS (credit management services) Telford name. They do not have Natwest header. Finally I am still waiting for another 6 month worth of statements which I am sure will also have these charges on them. Should I send seperate LBA's if I get them soon? Or should I stagger the letters and do two court claims for the total. I know the time delay I have too give them but I want to start court asap. Kind Regards JMAC999
  12. Thanks for your response natwest staff. The act sheet marked 1 was from oct 2002. My act was opened what i know think was prior to april 01 because i have this print out thing that is called "copy ledgers and outstanding responses 1D" which is dated first week april and it shows significant O.D. figure. There is NO WAY i was OD to that degree within the first 7 days of openin the account and everyone on the fone says that was when the act was opened. I am very confused! If Joyce is doin the right thing then thats fine but she has haqd 40 days to sort it out and as far as it goes its not my responsibility to know where to find the info.......its her's. So what do you think is the next step? Im gonna do the DPA complaint thing and joice isbeing apoligetic. Cheers J:(

  14. Hi all and thanks for all the advice in the FAQ's. Sent my N1 in personally and it was served to Abbey on 15th sept 06. They sent me the Notice of Acknowlegement which was filled on 25th Sept 06. This means they have untill 12th Oct 06 to get their defence in (as far as I can work it out). They are using Dla Piper. My act was a joint account that was opened in scotland. The other act named is my father. I did not get him to sign the N1 or be involved in it. Will this give them any ammunition? I now sh**ting myself because I think I may have messed this up cos im the only one asking for the charges back from our account. Will it make any difference that I live in England but it was opened in scotland? Thanks all JMAC999
  15. Hi all, DPA request been with Natwest for 39 days. Requested data using template letter. Requesting from April 01 to present. Recieved same statements from Oct 02 to present all showing repayments but no charges (which is what i was expecting). Info I really need is from April 01 to Oct 02. The statements I got were page numbered from page 1 (starting Oct 02). Called the 'efficient' Joyce Tudor who told me that I had been sent these and that that was all the info they had on their system. The big argument from Joyce was that "you cannot get statments prior that start before page one" and that she would look into it. I explained that she had a responsibily to hod data for 6 years. She gave the old story about natwest computers changing over to RBC. I called customer help line who sent me this print out dated April 01 which olny said how O.D. i was but nothing about charges. No one could answer if I was ever given an overdraft....and i cant recall. Joyce also 'helpfully' after telling me she had worked for the bank for 20 years and had never come across a situation like this and that she had ALL her staff looking into it (etc etc) said that because my act was closed it was difficult to find the data. My act. is not closed as Im still paying off the dept to Interum Justica (who I belive is part of natwest). The last statements I got showed the credits up to last month. So I have three questions for you all 1. DPA not fullfilled as of tommorow day 40. Do I contact info commisioner and if so how? 2. What do I say to Joyce Tudor to get her to pull her finger out and clearly state I know where my info is i.e old NW v's RBC records? 3. I want to start the claim asap cos ive been trying to get these statments for 7 months (before the DPA). How do I make a guestimate if I have no idea about charge levels or OD figure so I can send the request for refund letter? Thanks for your help (in advance). JMAC. :-?
  16. I have done all of the DPA, LBA letter thing with just my name on the letters but the abbey act was a joint one and too confuse matters was opened in scotland. I live in england and the other named act is my dad who lives in scotland. He is the first named on the account and all mail has been going via scotland as its a hassel to charge the name on the act. I will be applying to court with my N1 tommorow (after waiting the 14 days). My N1 only has my details on it and im ging through the english courts. Will this be ok? Do I need to state my dads details and address? does he need to sign the N1 as well? Finally my charges were £15 a pop mainly. I still see these as being well above as in total the charges and interest tot to 605 quid. Will the court frown on my application cos I think abbey will say this is reasonable. Im kakking myself!!! any help/advise would be great! cheers jmac.
  17. Hi all, Just an update on my fob off attempt for info from abbey. My account was a joint one with my father and I closed it after paying off the overdraft and charges on 03. Both my father and I have lived at seperate addresses since the act was opened. Although his name and his address was always the 'main' name and 'main' address. Sheena Small (dpa manager at abbey) told me its fine but all info will go to that address. After they sent me 6 month worth of statments to my dads address. I thought I would send the 10 pound for the DPA info with your library standard letter (rec delivery) as I wanted the full 5 yr period. I sent a postal order and they recieved it on 4th May 06. So I waited.......... I got a change of address form and a letter to say they couldnt proceed due to "my registration address' was different. Called Sheena. She said I would have to wait and there were a lot of requests for info. I said that the DPA date still stands as ending on the 13th June and she gave me the microfiasco story. She said abbey did not have to comply with the deadline as the fiche stuff was not covered by section 7 of the DPA. Should I send them a request for payment letter now with the statements ive got? Its about 700quid I think im due back. Does anything happen or should I do anything after 13th June? She said she was going to sort out the address thing with Bradford abbey. Im so confused!! jmac.
