This is in regards to a Capital One credit card that Capquest have allegedly purchased, the balance is just over £800, I have not seen anything to support this, other than threats through a collector called Scotcall. I sent a CCA request to Scotcall in September 2007 and received a letter dated October 2007, stating that they are unable to obtain the agreement and were returning the account to their client. I have not received anything since then, until todays letter threatening a statutory demand in ten days, unless a settlement payment is made of £500. Please, can someone offer advice
  3. AIC did the same with me, never replied to any communication, including that from TS, then Debt Investigations contacted me, I sent the same letter as above, still no reply. I now have a new DCA chasing me, and so it goes on! Dibs.
  4. I have just received a call from a company called Financial Help Services, allegedly, only the last four digits of the phone number showed on caller display, 0111, I thought Mercers phone number also ended with those digits, strange.
  5. I sent them a CCA request to the Weybridge, PO Box address by recorded delivery, they acknowledged receipt and had requested a copy for me from their client, that was months ago and I haven't been contacted since Good luck and remember, never phone them.
  6. The letter I have from them has the Weybridge, PO Box address on it, but at the bottom of the letter it gives the registered office address as 7/10 Chandos Street, London, W1G 9DQ, hope that helps.

  8. I am phoned fairly regularly by 01772 688881, they only let the phone ring once, I have tried calling the number back and get BT call minder. Does anyone recognise the number or have you received similar calls? Many thanks, Dibs

I agree with nblaen, it does sound as if this alleged debt is statute barred, follow nblaens advice and do not speak to them on the phone, if they phone you, simply hang up. Good luck, Dibs.

Have you sent a letter to Cabot stating that you don't recognise the debt, if not, this is one of Curlyben's I think : You have contacted me regarding the account with the above reference number, which you claim is owed by myself.   12. I'm sure that Providian became Monument and was then purchased by Barclays, Cabot have my old Providian account and seem unable to produce a CCA, not really surprised. Dibs x

  14. Well said, Sarah, I couldn't agree more. I am in a great deal of debt and was literally being sucked under by the weight of it, like most people I didn't choose to be in this position, circumstances put me there and it feels like an impossible situation when you are under constant threats from debt collectors. Cabot own several of my accounts and thanks to the excellent Cabot Fan Club I have gained so much knowledge and now have a greater understanding of how the debt industry works. I am not trying to avoid paying my debts, but I do expect Cabot and all DCA's to operate within the law,
  15. I am in a similar position and would also like to offer a f&f payment, but i'm concerned that it could be taken as acknowledgement of the debt, hopefully someone with more knowledge will answer the question. Dibs.
  16. Welcome to CAG Surely if the debt has not been acknowledged for 7 years and there is no CCJ, it's statute barred? If there is no CCJ, it will be a debt collector who comes to the door, just ignore it, they have no right of entry, they might like you to believe that they have the powers of bailiffs, but they don't! Someone with a lot more knowledge than me will be along to offer advice soon, in the meantime do not speak to Cabot on the phone. Dibs.
  17. Tesco Personal Finance must be pushing Intrum Justitia to take legal action, Tesco made it clear in their last letter that they intended to persue this account, I feel that Intrum Justitia would perhaps prefer not to! It will interesting to see what the FOS has to say. Dibs x

Just an update, Intrum Justitia are now chasing this debt, correspondence as follows: I had hoped after receiving the above letter from Intrum Justitia that I wouldn't be hearing from them again, wrong, received this one today: So have sent a letter to the FOS reporting them for harassment. It does seem that Tesco feel they have the required documents and are intent on going to court with this one.

I have now challenged all my considerable debts and only one would appear to have an enforceable CCA, so I have stopped payments to all the rest and this has left me with a nightmare as I now have a considerable amount of defaults. I have been searching the forum site and it seems that they are not easy to have removed, if at all, a loans company tell me that they do not drop off my credit file after 6 years, as credit searches will still reveal them as an aged debt, are they correct?

Link didn't work for me either, I went to the BBC site and typed in credit card debts wiped, then click on the video link in the right hand side column, it's about a couple that had £37,000 debt wiped for improperly executed agreements! Thanks Alan for that, it's made me feel quite confident. Dibs.
  24. Hi Lexii, I am so sorry to hear your news and you are right to want to take the time to be with your Mother. I also lost my Mother to cancer and took three months off work to care for her and enable Mum to die in her own home, as she wished, so I can appreciate how hard this is for you. I saw my Doctor and explained the situation, I was signed off work for a month at a time without any problems, I would hope that your employer will understand your position and honour the terms in your contract with regards to long term sick leave.   25. I have received no reply to the letter sent to Intrum Justitia, but they have now asked a company called Debt Investigations (UK) Ltd to chase the debt, first time I have heard of this company, I will also send them the CB letter, not that I expect the courtesy of a reply.
