  1. hey Thanks for that. I was goin to say that too. I used that spreadsheet against Capital One. Im goin to take em all to court. This is getting pretty intense now. I will keep u posted if anything does happen! Thanks Shahid
  2. hey Thanks for all ure help. Im coming to terms with all this. What does this mean.... I've reviewed you account and as a matter of goodwill, id like to reduce the fees we've added to your account to 12 pounds each. This amount is 160 pounds. I have also refunded an additional amount of 10 pounds as an acknowledgement of any interest you may have incurred. This amount totals 170 pounds and you'll see this on your next statement. Will they deduct 170 pounds of the 200 pound credit limit they have given me? They said that il see this on my next statement. The one i just received i didnt see any deduction. I have 4 weeks so i need to respond quickly. Any help will be appreciated. Thanks Shahid
  3. hey hey Just to let you know... The 14 days have surpassed and now i will taking Natwest to court. Wahoo. Im ready to challenge them. I have d/loaded the N1 file... Need help fillingit. I am asking them to pay me back 432 pounds and get me off default. Whats all this about the 8% interest that I can claim too? Any help?? Thanks Shahid
  4. hey Its been over a week since i last put a response on... I got a letter from Capital One last week with a offer of 170 pounds. They owe me nearly 800 pounds in excesssive fees and they offered me something way less. This is what the letter stated: Thank you for taking the time to write to us about the fees we've added to your account . I understand you think these fees are unlawful and im sorry you feel we've treated you unfairly. To explain, we automatically add late payment fees if your payment is missed, arrives late or isn't enough to cover your minimum payment. We'll add overlimit fees if your balance goes over your agreed credit limit, which is 200 pounds. When we opened you account in Novemeber 2002, we sent you a credit card agreement which stated these fees. By signing and returning this to us, you agreed to the terms and conditions for the account, including the fees. As you are probably aware the Office of Fair Trading, OFT, havent challenged the right of banks to charge default fees, but merely the level of those fees. Although we feel 20 pounds is a just fee, we've reduced our fees to 12 pounds so that we're in line with our competitors. I appreciate that you've incurred previous fees at the higher rate, and would like to address this. I've reviewed you account and as a matter of goodwill, id like to reduce the fees we've added to your account to 12 pounds each. This amount is 160 pounds. I have also refunded an additional amount of 10 pounds as an acknowledgement of any interest you may have incurred. This amount totals 170 pounds and you'll see this on your next statement. If i dont hear from you within four weeks i'l consider this matter closed.   6. hey hey Its been over week since i last posted, been very unwell. I sent my last letter in order to ask about my full refund and im awaiting a letter from them. It'l be 2 weeks on thursday since i sent the letter if i do not hear from them in that time i am filing court proceedings!. I will keep u posted if anything happens. I will need help filing in the N1 form or wotever it is. So someone please please advise me on how to do this. This is taking the **** now. Thanks everyone! Shahid

  9. hey just a quick note... i have sent the above letter in regards to the same offer being made... can i accept the offer while i still send the letter (above) off? What do they mean they will put the monies in my account? Do they mean my bank account or the credit card debt that im in. What I mean is that i owe em 397 pounds, will they take 155 pounds and minus it from the total i owe them? Thanks Shahid
  10. Hey I have written my 3rd and final letter before i take court proceedings. Can you tell me if this letter is legit and also how i go about goin through the courts (Its below my jibba jabba). I have never done this so all help will be appreciated. I cant believe they have not offered me more monies. A offer of 155 pounds was offered and they are not budging. They owe 432 pounds. I dont know what the interests are and to be honest im not bothered. I just want the debt paid off and default removed. As you have offered me the same value as the first letter I am now thinking of taking this to court. All im asking is for you to refund the money you have over charged me with. I will accept the offer made only as partial payment of the whole debt in total. Additionally, you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you, or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account. In addition to full payment of the sum mentioned above, I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable. I require repayment in full of this money and removal of the default notice. If you do not comply fully within 14 days I will take this matter further to the courts. I am again willing to give you another 14 days. If I do not hear from you within 14 days I will start the court proceedings. For any proof of letters of debt and tuition fees or medical records I have stated in the previous letter can all be obtained upon request.   11. hey Thanks for all the help. I dnt think il be asking for the contractual interest. Looks complicated to me. I dunno what interest rate they have charged me for cash and purchase. On the statements it doesnt say how much, all it says is interest applied. thats it! I think im going to claim the interest total charge overlimit fees and late payment charges. Do i have to use the spreadsheet for this too? Along with the letter that i will send Capital One. Thanks Shahid
  12. Hello Im jus wondering i have a student overdraft of 2000 pounds with natwest, i have just received my monthly statements and they have charged me 12.37. They have never done this. I have gone over my overdraft ever. DO u think they have done this because im claiming back monies from the Natwest credit card? Can I do em for this too? Thanks Shahid

They have said they are still offering me 155.52 and if i want it i have to send the reply off. What do you think the next step is? Another 14 days for them to re-consider before i take it to court? I cant believe they offered the same amount. The letter is below: It also says : As we outlined in our letter of 30th July 2007 we explain all our terms & conditions including our fees and charges at account opening and they form the basis of your agreement with us. We must therefore, disagree with the views expressed in your letter. If on reflection you would like to accept our offer of 155.52 pounds as outlined in our previous letter please complete the attached form and return it to us in the reply paid envelope enclosed. The figure represents a refund of teh difference between our original 20 pounds and the current twelve pounds late payment charge and includes any associated interest charges. I would remind you that acceptance by you of this payment will be in full and final settlement of all claims you have relating to our charges. Any charges that properly accrue in the future will be applied to your account in line with our published terms and conditions. I would re-iterate that our letter of 30th July 2007 should be takes as the Bank's final offer. any help will be appreciated shahid

  15. hey i still dont understand how to work out the interest. They have charged me 210.21 in interest charges. Can i claim this back? Also what is contractual interest? The spreadsheets are helpful but need help to fill this in. Is the interest they have charged me something different to contractual interest? I really need help on this. I want to send this thing off soon so some help would be really be appreciated. Thanks Shahid
