I have this morning received a N! Form from Brighton County Court. Brief Details of Claim: Monies due in respect of unregulated charge card expenditure The claimant therefore claims: 1 £3014.92 2 Contractual interest accrued to the date herof £1944.72 3 Further contractual interest at the rate 3.5% (£5.62 per day) 4 costs to be assessed Claimants claim £4959.64 Question is can i dispute the interest they are applying and admit 3014.92+court+fees or would i be better admitting the full amount and offer to pay in installments with my current outgoing i could pay 100- 150 per month but if they continue adding interest i will never pay off the interest let alone the dept. the AMEX card is not covered under the Consumer Credit act Many Thanks -

Hi, i have recieved a SD from stevensdrake this morning 18th April, there letter dated 3rd April and postmark on envelope 17th April all sent via regular mail and not recorded. i guess they are trying to use up the 18 days by backdated the SD. The SD its self is just printed on a piece of paper with the name of the stationary printers still on the bottom. Should i discard this as they have no proof of me recieving this. The matter is over a AMEX issue to the value of £4555 of which £1540 is interest they kindly are adding at £5.07 a day, I believe this is not covered under a CCA so i cant send a CCA request. Any tips on what i should do.? balance without there interest is £3014 thanks -

I have already sent by Special Delivery (confirmed delivered 30/08/07) a CCA request as follows: i know it may not be covered by a CCA but thats why i have stated i do not acknowledge any dept to your company (stevensdrake) as my last contacts were with RMA and i have had no notice that they have passed it on back up etc I have also not acknowledged the reciept of the SD to them. -

1. i was an employee for the company ( Hewlett Packard ) 2. note sure will need to check tommorow 3. the initial figures could be correct 2900 and it seem that stevens is adding the 50% interest 4. not sure again will check tommorow ( form from corporate website that gets faxed off the AMEX ) 5. i am guessing 3-4 years ago thanks -

There are a few vital questions. 1. do you know what debt this is for? Hotel expenses etc 2. Was the debt a charge card or a credit card? (Amex does both) this was a Corporate Card which i believe was a charge card? 3. Was the debt subject to a forthright CCJ? i have had no ccj regarding this 4. Is this stat demand served by the original creditor, or a DCA. If it is a DCA, had it served on you a notice of assignment. the demand is served on me by the creditor ( amex ) 5. Do you own your own home (the most important question). nope live in rented accomadation OK. This dept was origionally with RMA (Risk Management Alternatives) part of NCO i think, but the refused to accept any payments and wanted the full amount due ( which was 2920.84 then ) i can then assume they have passed it back to Amex and now stevedrake has it. -

It does has a squiggle / signature and mentions a Court although not my local but next county so close. Thanks again Nigel PS the amount seems to be for 3532.63 of which 517.71 ( to date ) is interest that they have kindley added at 3.98 a day. -

Hi guys and gals, I have recieved by royalmail a Statutory Demand from StevenDrake, with cover letter: Dear Sir, Re. AMEX..... We enclose a Statutory Demand by way of service upon you. Please acknowledge safe receipt Your faithfully stevesdrake The demand itself is on two sheets of paper with the Demand, Part A, B C etc and seems to be at version 6.1 going by the footer "Insolvency-Bankruptcy 6.1" They also seem to kindly be charging me interest at 3.98 a day which currently totals 517.71 bringing the total outstanding with AMEX 3532.63 as at 22nd August I guess my first step is to send a CCA Request off to StevenSDrake? And if by magic, a return letter from connaught stating "The contents of your letter have been noted, However we write to inform you that out files have been closed and returned to 1st credit" Should i now contact 1st credit regarding this and arrange payments with them now? Thanks for all your help -

I had recieved a SD from Connaught on 19/07/07 delivered buy courier. I originally had an aggrement to pay £18 per month via my Debi Card, My debit card they were using expired and they were unable to continue payments i think the last payment was in April 07, I ran them to inform that my card had expired and that i now have a new one issued, but they said that they were unable to accept the current aggreementof £18 and would only accept £50 per month, i have already sent them a Proof of Earning etc showing my incomming / outgoing before where they were happy to accept. So am i right that my next step would be to send one of these http://www.consumeractiongroup.co.uk/forum/general-debt/20758-creditors-dcas-letter-templates.html#post162367 to Connaught to dispute the SD that they sent. Many Thanks PS the Outstanding Dept is £865.39
