  5. Dear all Good news - Abbey have capitulated and paid up - £755. Story is as follows: sent letter to Abbey in February threatening court action if they didn't refund these charges. They wrote back telling me to bog off. Started court proceedings through moneyclaim in March. Abbey filed a defence. I did nothing. Then soon after, Alan Squires wrote offering 50%. I did nothing again. Then this week, a cheque for the full amount of my claim was paid into my account at Abbey Milton Keynes branch. I have had a letter from Alan Squires denying that this amounts to an admission of liability.
  6. Dear all First of all, many apologies for interposing a question on AlanfromDerby's thread...... This time last year I took Abbey through Moneyclaim, which they ignored. So by default judgement, and bailiff enforcement, they paid up in full over £1000 without any comment. I fear however that Abbey are now taking a more proactive stance - we do not have any recent (i.e. within the last month) examples of them caving in. They are filing defences with the court.   7. I too have had a 50% offer, in 'full and final settlement'. If I don't accept this, and get an 'allocation letter', do I then have to appear at Northampton and defend the case against a barrister, or does the court decide without having to appear? Have other people been through this and has everyone won?

  9. Hello I am in exactly the same position - just going with CCCS, but I am also putting a claim in to Abbey against these horrendous charges and I don't see any reason why we should be deterred from that

    I have sent the threatening letter to MBNA, and I have received a letter back asking me to phone them. What is the general attitude to phone calls? My feeling is not to enter into any kind of dialogue with them at all. Would I be best off: a) phoning them as requested and stonewalling b) writing to them instead telling them it's non-negotiable, or c) just going straight to moneyclaim?? Any advice gratefully accepted.
  11. I am new to this forum but have been into this game before, using http://www.bankchargeshell.co.uk as my advisor. About a year ago, I claimed repayment of bank charges from Abbey going back about 4 years, via Moneyclaim Online (http://www.moneyclaim.gov.uk). I heard nothing, they did not acknowledge or defend the claim. So my next step was to instruct the bailiffs to go in. This all took some considerable time, and I think the bailiffs did get involved - not sure to what extent. Then out of the blue, last June, Abbey paid up in full - £1041 including all my costs.
