  2. Hi All, Bit of advice on the following would be extremely appreciated. I have just recieved a letter back from Barclaycard explaining that they have reviewed my claim for a refund of PPI payments made on my Barclaycard and that they have decided that compensation, as they put it, is not applicable in this case for the following reason; QUOTE. The payment protection commenced on the account on 28th July 2003 and a policy document was sent to you a few days later. You had a 30 day cooling off period in which to examine the document, decide if it was suitable for you and cancel it if necessary. You had never requested to cancel the policy, nor have you queried any of the charges applied to the account for the previous years. Our "condition's of use" state that it is your responsibility to ensure that your spending is reconciled each month against your statement. Payment Protection insurance was shown on each statement and communication should have been made to Barclaycard in order to rectify this. Unquote. This letter has actually crossed in the post with my LBA of court and was just wondering if i should write back to them explaining that i never recieved any PPI document and was just nieve in believing that PPI was just something that i had to have. Shoud i have brought it to their attention earlier?? Any advice would be greatly appreciated.

Hi Paintball, The S.A.R was sent sometime ago and i did recieve all of my statements and have infact recouped all of my charges it's just the PPI i'm trying to recoup now on the grounds i was unemployed at the time i was signed up for the card and although i have sent 2 letters requesting a full refund of PPI payments made (at this point i have just added up all the PPI payments as they appeared on my statements and not added any interest) they keep fobbing me off that's why i was considering making the next step the small claims court.   4. Hi Paintball and anyone else taking an interest in plight! Sorry i havn't posted for a while but i work away for months at a time but i'm back now and here's were i'm upto. I sent the letter Paintball so kindly made up for me (#3) on 09th September 2008. On 07th October 2008 I recieved a copy of my T&C's which i requested 4 weeks earlier along with a letter stating that they were taking my request seriousley and that they hoped to have resolved my complaint by 14th October 2008. Then on the 13th October 2008 they wrote stating that they were still looking into my complaint and hoped to have it resolved by 14th November 2008! I think they are taking the mick!!!!! Also i read somewere on the site that they are obligated to send the original copy of my T&C's including a copy of the original application form which would have my signature on it, all i recieved was a copy of the then T&C's. Is this correct??? Should i wait until 14th November 2008 or will i just be fobbed off again?? or should i just get the ball roling with the small claims court?? Any advice as always would be greatly appreciated. Cheers Adamsdad

  7. Hi All, I have recently wrote to Barclaycard requesting a full refund of £253.56 for "payment protection premiums" as i was unemployed when i was signed up for the card. This is actually the second request i've sent but i forgot to send the 1st by recorded delivery so as it was over 2 weeks ago i'm sure they've ignored it hoping i'll go away (NO CHANCE:grin:) but I did send the 2nd request 1st class recorded and it was delivered on 27th August08 but i've not recieved anything back as yet but i would expect them to take the full 12 days!!! Just as a matter of interest, If they didn't respond what would be my next move??? Any help would be greatly appriciated. Cheers Adamsdad.

Hi All, I would be extremley greatful if anyone could offer me a little advice. within the last 7 years I have had a mortgage and 2 loans as well as a current account with the Halifax but unfortunately the only refference i have relating to these accounts are the roll numbers which i obtained from a branch (according to the member of staff this is the only info she could give me as all the accounts are now now closed). My plan was to contact the Halifax and see if i could get the info i require to see if i had any charges etc to try and claim back, so i sent the following letter: My name and address Halifax Customer Relations P O Box 548 Leeds LS1 1WU 15August 2008 Dear Sir/Madam Re: Roll Numbers: ????????? ????????? ????????? With reference to the above agreements, I would be grateful if you would send me a copy of these credit agreements. I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of my credit agreements on request. I enclose a payment of £3.00, which represents the fee payable under the Consumer Credit Act. I understand a copy of my credit agreements should be supplied within 12 working days. I look forward to hearing from you soon. Yours faithfully The problem i have is that i'm not even sure if the Consumer Credit Act 1974 (Sections 77−79) actually aplies if the accounts have been closed?? and as they were sent recorded delivery and delivered on the 20th August 08 the 12 day period is now up. The 3 £1.00 cheques i sent have all been cashed and I clearly wrote the individual roll numbers on the back of each cheque with an instruction as to what they were for. So my question is what would be my next move??? Any suggestions would be greatly appreciated. Adamsdad.

Hi Old Andrew 2007, Thats probably the best option but i'm not holding out much hope as just reading a few posts on other threads it would seem Banks are under no obligation to keep keep, never mind supply T&C's once the accounts have been settled and closed but the fact they have cashed my cheques gives me a little hope.   10. Hi Slick132, Thanks for the advice and i will keep you informed. If they dont reply to the original request is their a particular letter i should use to follow it up, I think i recall reading on another thread that the best road to go down with PPI issues is the ombudsman rather than the small claims court especially if you dont have your t&c's. Hi All, I'm was hoping for a bit of advice if anyone can help.I recently wrote to Barclaycard asking for a refund of charges incured during the past 6 years which totaled £130.00 (£100 charges and £30.00 interest @ 8%). I've just received a letter back from them explaining that although they have always believed their charges to be fair they would be willing,as a gesture of good will,to credit my account with £40.00 as full and final settlement which they say is the difference between the charges that i incured and the current fee of £12.00. Is this correct?? Should i accept?? Also,having read a few threads on PPI would it be worth challenging them over the PPI i paid as i dont recall being given the choice to take it out,in fact i dont remember much about the application at all as i was signed up for the card by a very pretty youg girl when i was at Haydock Races and more than a bit worse for drink and to the best of my knowledge a couple of weeks later the card just turned up.
