  1. Wife has recieved a CCJ as in the judgement to repay loan to Nationwide. Shoosmiths were representing Nationwide. Problem is we have a month to repay in full or she has the CCJ against our name and GOD knows what else. Time is limited and I need to act fast. What are my options? Can we appeal to have the Court review our circumstances. We did something foolish in that we did not return the form to the County Court as we tried to negotiate privately with Nationwide but could't raise the money within the time agreed. So CCJ was reached in our absence.
  2. Hello esteemed members. My wife and I are considering different options in order to get out of our debt situation. We have been to Payplan. They have done a income expenditure assessment. At the same time we arranging to get a secured loan on our property that will only cover about 1/3 of the debt. We are at a cross roads because my wife knows someone who has been successful with using a loan for consolidation and is awaiting things to improve so that she can remortgage. She is wary of Payplan and has a lot of questions she needs answered. 1) What is the difference between a DMP and an IVA? 2) What are the implications of both eg. jobs, future credit etc?. 3) Has anyone on the forum gone through the debt mangement plan for the 5 years? Please share your experiences both good and bad. 4) Has anyone taken on a secured loan with a third party in trying to consolidate payments? If so what are your experiences in trying to pay these off and become debt free. 5) Can creditors force a sale on your property? 6) What if situations change eg. a new baby?

  4. I saw this late. I am currently writing to them to get this sorted out ASAP as it clearly represent miselling.
  5. AOL broadband isn't bad. The customer service sucks big time. I know because I have used them for about a year.
  6. The CP Warehouse spec is solid. It is the T&C that I have a problem with. It is miselling. I have retained the advert and would advice anyone interested in the offer to retain theirs in case it gets messy.
  7. Carphone Warehouse have been offering free laptops when you sign up to AOL. I signed up for the middle spec. Everything looked nice until I got T & C documentation to the effect that my package which is £19.99 is bundled with Pay as you go calls. Now my understanding before I signed the papers was that apart from a one off charge for upgraded spec + delivery + monthly £19.99 payment there would be no extra charge. The rep offered another product which would allow me to make unlimited land line calls at an extra £4.99 a month. I didn't want this because I am with Sky. I called AOL today to sort out the issue as I am still within the statutory cooling off period. The customer repat the other end explained that the phone charge at 3p per minute day time calls will have to be taken up. If I decide to refuse the offer, I will pay £9.00 extra. I have just written by email and post to AOL. In addition I want to alert anyone interested in the offer to check out the T&C to know what you are getting.
  8. Is it not possible for them to reissue the PCN correctly? Would that stand up in court?

  10. Hehe. This gets more interesting. Just had a look at the PCN and found that only the VRM is stated. There is no make or colour on the fine. I culled the following excerpt from the RTA 1991 on a different thread: Just to make things clear here is the actual wording of S66(3) RTA 1991 A penalty charge notice must state— (a) the grounds on which the parking attendant believes that a penalty charge is payable with respect to the vehicle; (b) the amount of the penalty charge which is payable; © that the penalty charge must be paid before the end of the period of 28 days beginning with the date of the notice; (d) that if the penalty charge is paid before the end of the period of 14 days beginning with the date of the notice, the amount of the penalty charge will be reduced by the specified proportion; (e) that, if the penalty charge is not paid before the end of the 28 day period, a notice to owner may be served by the London authority on the person appearing to them to be the owner of the vehicle; (f) the address to which payment of the penalty charge must be sent.

Anywayz I hold my hands up to the crime:mad: I was snapped going in the opposite direction of a quiet one way street near my house ( what a sad git operator 106 0f Croydon is:mad:) To cut straight to the chase, I have been sent a PCN by Croydon council and the text reads: 'DO NOT IGNORE THIS NOTICE: The Penalty charge of £-NaN:???: must be paid before the end of the period of 28 days beginning with the date of the notice. If the penalty charge is paid before the end of the period of 14 days beginning with the date of the Notice, a reduced amount of £0.00:eek: is payable. See overleaf for details of how to pay. OR: If you believe you have valid reasons, you can make representations against the Penalty Charge. The grounds on which you may make representations are set out overleaf. If you do nothing, the charge will increase to £150 and we will serve a Charge Certificate seeking payment of this increased amount. After the issue of the Charge Certificate, you cannot maek representations. Failure to pay the increasedd amount may result ibn the debt being registered in a county court and a warrant being issued to bailiffs to seize your goods.'(sic) Overleaf guidance for representations reads: REASONS FOR REPRESENTATIONS THAT WILL NOT NORMALLY BE ACCEPTED INCLUDE: "I lent the car to a friend and he will not pay the ticket" "This is too much money to ask for a traffic offence." "There was no need for yellow lines anyway" "I am not the owner/keeper because I hired/leased the vehicle." Question: Since I cannot afford to do nothing, what are my options?
