Thanks for that hun, was just thinkin about the intrest you can add, i didnt originaly add it on because i read you can only claim for that when its in the court process.If i were to add it on now would i have to amend the claim form then ?I did send an email to Inga at abbeys solicitors to see if they would offer settlement without intrest and said otherwise i will be adding the intrest if we have to go to court she replyed saying your welcome to add intrest but i can help no further ( this was berfor the test case announcement) :)

  2. thats all we need, when i first filed the case they were very helpful and because im struggling with the mortgage repayments they agreed to the court fee been non payable ( this was a man with white hair) :)

  3. she's proberly annoyed because i phoned up to complain that i had been mis-informed about how the court was proceeding, after been told everthing was on hold then told by simon otherwise ! anyway will be going in next friday to see where i stand with regards to the defence been due from abbey by the 9th. i'll give them a smile see if i get one back !

    Back at the begining of your thread you mentioned getting incorrect building insurance back, could you explain why it was incorrect as i have recently been looking into reclaiming arrears charges from kensington mortgages and found i was charged £30 a month for buildings insurance which i do not remember agreeing to as i was also paying another company for buildings and contents so why would i have agreed to this?

    any help appreciated :)

Hi Louisk, I also had the unfortunate pleasure of doing buissness with kensington ! can you tell me what i can try to reclaim from these options - RETURNED DIRECT DEBIT FEE £25 (X15 = £375.00) MONTHLY ARREARS FEE £50 (X15 = £750.00) COUNSELLORS COST £ 193.88 SOLICITORS COSTS £555.14 SOLICITORS LETTER £20.00 My starting balace was £89'441.00 I redemed it early and paid £102'037.29 !! robbers! ERC £5'707.51

This artical which is on the martin lewis site may not apply to everyones situation here but it certainly does to me, its saying if you can show your having financial difficulties the waiver allowing the banks to suspend a claim does not apply. :) Q: I am currently having financial difficulties, is there any way to reclaim?A: The waiver that allows banks to suspend claims does not apply to people who are having financial difficulties, also known as a hardship case. Banks will have to conduct a filtering process to ensure that cases of genuine hardship are still dealt with during the waiver period. Although there is no firm definition of what genuine hardship is, it generally applies if you are not able to deal with your debts, for example you have mortgage arrears and lots of credit card debt that you cannot afford to pay back. If your bank is not able to help you can also send your complaint to the Financial Ombudsman who will decide if your case can be dealt with before the test case is resolved. Hi spicester,i phoned the court today as i was reading another thread ( simon's who has also filed at scarborough ) and he said he phoned them to see if the claims had been put on hold and he got a different story to me.so seems theres some bad staff communications going on there, claims are been processed as normal x

Well thats great news !! as soon as i read your post i got onto the phone and told the lady that i'd been in the previous day to be told the claims were put on hold, she asked me who i spoke to, put me on hold then returned to say yes the claims are still going ahead! They did not ask me yesterday nor today for my claim number so i dont think its based on individual case's, so looks like we all have the goahead ! seems theres some bad staff communicatons going on there x

    A NatWest customer has lost his legal bid to obtain damages for what he calls "unfair" penalty charges.

    Barrister Tom Brennan took the high street bank to court after he was charged £2,500 for unauthorised overdrafts when he was a law student.

    NatWest offered to settle out of court for about £3,000 but Mr Brennan pursued his claim for damages, arguing the bank acted unlawfully in taking his money.

    The City of London County Court has now dismissed his case, describing it as contrived.

    Judge Peter Simpson said: "There is no prospect of success and no other reasons why this should go to trial, in my judgement."

    Mr Brennan said he was not surprised by the decision and would appeal it in the High Court. He accused the banks of attempting to avoid court adjudication by "forcing" money into people's accounts.

    "It seems any financial institutions can force money into an individual's account and therefore excuse themselves from any court case," he said.

    Martin Lewis, of consumer website MoneySavingExpert.com, who has been leading a campaign against penalty charges, said the outcome was unlikely to influence a test case to be heard by the High Court.

    "Tom Brennan has always been going for the extreme case that is totally different from what everyone else is going for. It is something I always questioned the wisdom of," he said.

    NatWest will not seek costs from Mr Brennan over the case.

The lady behind the counter did mention what was on the news and said we know as much as you at the moment until the outcome, so i told her ive heard other courts are proceeding as normal and she said that it is up to the individual judge how their court proceeds and ours has been put on hold until the outcome :(

    I truly wish she is wrong.

  11. hi there, im from scarborough too and i also work at the hospital where you seem to spend alot of your time unfortunately and i have a 6 yr old daughter and claiming from abbey ! think we have a bit in common there !!:p

    so what ward are you normally on? im not a nurse im a domestic.

     

    anyway back to the main reason for been on here.... my claim from abbey is for £4'285 they put £500 into my account last week so i phoned said i wasnt accepting this as full payment and the guy asked what i would accept, i said the full amount he said he would add the details to my file and they would contact me again in 8 weeks with a decision.

    I told him that i had already filed my claim with the county court which i have (on valley road as youll know) and he went quiet for a while then said ok ill pass your details on today and you may recieve a call from our solicitor soon to settle the claim. fingers crossed :)
