  1. Sorry, I wasn’t sure what to do. But thanks for your input. Thank God for people like yourself who not only help people like me but who also have the patience to guide people like myself through this process. Honestly thank you. I had a serious brain injury sometime ago and this has reduced my cognitive abilities. I easily forget things and I’m glad for your help. many thanks. i did get an email this morning that I think means that the debt has been cleared. Though I’m not sure. We will see.
  2. The only correspondence I have sent was this email. Which I sent to all the debt collectors who have sent me emails regarding this same claimed debt. I have asked on numerous occasions the company that the debt was supposed to have originally been owed to send me a copy of the original statement and all I have ever received is the claim that they no longer have access to the account records as the account has been sold to a debit collection company. I did try to raise the point that they were legally required to keep records for six years but I was point blank refused to see the original account records. The best I’ve had was literally an email with a made up table, quite literally made up using keyboard characters, saying you owe us this much. here’s the email I sent out. Subject: Dispute of Debt and Urgent Consideration for Mental Health Impact - I am writing to formally dispute the debt associated with [account number/reference number] that your company has been pursuing for collection. It is of utmost importance that you understand the severe negative impact this debt and your collection efforts are having on my mental health, particularly considering the current circumstances and the legal protections afforded to vulnerable individuals in the United Kingdom. I want to stress that I am currently under the care of medical professionals, including psychiatric specialists, due to the seriousness of my mental health condition. This involves ongoing treatment and support for my well-being, including the management of significant self-harm incidents. The delicate nature of my situation necessitates that all parties involved exercise the utmost care, empathy, and strict adherence to legal obligations when dealing with my case. Under UK law, creditors have a responsibility to treat vulnerable individuals with the utmost sensitivity, taking into account the potential impact of their actions on mental health. This includes recognizing the gravity of the situation and the real and immediate risks that further distress and harassment may pose to my mental well-being. I kindly request that you: 1. Immediately suspend all collection activities related to this debt until a thorough investigation of the debt dispute has been conducted and my mental health concerns have been adequately addressed. This includes refraining from any further contact or correspondence regarding the debt until this matter is resolved. 2. Provide me, as required by the Consumer Credit Act 1974 and the Data Protection Act 2018, with all relevant documentation and evidence pertaining to this debt. This should include the original agreement, statements, and any other supporting information that can assist me in assessing the accuracy and validity of the debt. 3. Conduct all future communication in writing, ensuring clear and documented correspondence. This will allow for a comprehensive record of our interactions and ensure that relevant parties are fully informed. I would also like to emphasize that failure to comply with these requests may result in formal complaints being lodged with relevant regulatory authorities, including but not limited to the Financial Ombudsman Service, and legal action being pursued to protect my rights and well-being. Given the seriousness of the situation and the potential consequences of exacerbating my mental health condition, I implore you to approach this matter with the utmost sensitivity, empathy, and respect. It is my sincere hope that you recognize the gravity of the situation and take immediate action to mitigate the potential risks and distress caused by your collection efforts. Thank you for your immediate attention to this urgent matter. I eagerly await your prompt response. Yours sincerely, I don’t think I copied and pasted from any site but I got this reply a few days later.
  3. I have a studio account, which is up to date with all of the payments. However, I received some debit collections notice from Lowell. so I got in touch with studio, who own ace. I keep asking studio for a full copy of all the data that they are holding that concerns me. keep saying that they don’t have any data about me as they sold the account to Lowell. i was under the impression that they were obligated to keep the information for 6yrs. They keep saying that they don’t have any data as the account was sold. i have made a subject access request but I’m not getting any further forward. any help would be appreciated. thanks john
  4. I was getting debit companies constantly bombarding me with phone calls and emails. Then one said it was for a ace online account. Now I do have a studio account but it not in default. I asked if they would look into it. I got a reply saying that there was an alleged defaulted account. I asked if they would send me a copy of the account debit and what was purchased and when. Studio constantly said they a had sold the debit I would need to speak to them to get the information I need. Now I know that is not true. They also gave the debt collectors some very personal and confidential medical details. I had disclosed some medical information to Studio but didn’t give any permission to share this information with anyone else. I got an email from Lowell with a simple spreadsheet type of thing. I have listed your account details below: Lowell Reference Original Company Brand Original Client Reference Current Balance ....... JD Williams Jacamo ,,,,,,,, £xxxxx ....... Studio Ace ,,,,,, £cxxcx This is not what I had asked Lowell for but I was surprised to see a JD Williams debt. I had no idea existed. I searched through my bank account and my email accounts to find any payments made to either account or emails from both companies regarding any debts owing. The ace account it was 2015 the last time they said my account was in default. and the Jacamo one was 2014. where do I stand with regards to these debts? and the dodging of my subject access request? I just keep getting emails from studio saying my details have been passed to another department who will be in touch soon. And then when I email that department again I get an email saying that they have passed my details to another department and they will be in touch soon. I’ve made numerous requests for all the information that they hold on me.
  5. For a few years I’ve been getting debt letters from a number of different companies. When I got the first letter I went to their website and emailed asked what the debt was for and a copy of the original agreement. I got no reply. I just ignore them now. I had been caught before with Lowell , who had sent a random letter demanding payment for a debt. I paid and didn’t check the source or verify the debt.
  6. Would I be cheeky if I wanted compensation? I’ve tried from the very beginning to just get the repair. I had a serious penetrating brain injury a while ago. As a result I can’t use the phone. No matter how many times I said I couldn’t use the Phone they just kept ignoring my email and replying using the template email to say we feel that this matter would be better over the phone. They just wouldn’t relent. well any way Thank you any help.
  7. In February this year I bought a pair of Apples AirPods Max. They worked great for about a week. stopped connecting to my iPad. I spoke to the online help and arranged to send them back. I was told that the fault was due to me having wore them out side in the rain. I’d have to pay for a repair. I decided to have them returned unrepaired . Then I’d have to fight this. I got them back and discovered that they had sent someone else’s AirPods Max. I told apple that the serial number on the original box was not the same as the serial number on the headset they had sent back. I uploaded photos as requested. Then they said that they would send me a new set . I was happy with that. I was promised a number of times that I’d have the new set in two days and the representative would keep in touch. Like I said this was a long process. It was weeks later by the time I got them. As a gesture of goodwill I could pick something from the Apple on line store upto the value of £100. Not much choice so I got the ipencil. New set works well for around a week and started with the same problem as before. I got the email address for Tim Cook and thought it’d be a long shot. Next day I get a call from Apple who arranged for a new set. But I had lost faith that these would work and said I’d rather have a refund that I’d put to a new MacBook Pro. They never responded to that. I think I’ve had four sets now and the latest set are just as faulty as before. I got an email a few days ago saying that as a gesture of goodwill they would arrange the return and I’d get a full refund. now it’s October. Is the refund really goodwill or do I have the right to get a refund? Thanks
  8. I’ve been getting debt collection letters from a number of different companies but I don’t recognise any of them. I signed up to one of the credit rating agencies to find out who I owed money to. But that didn’t help. It just lists the debt collection company and the amounts they say I owe them. The amounts are staggering. now I was caught out once before by a debt collection agency saying I owed money but not who to and I just paid it. It wasn’t till after this that I found out that some agencies just send letters demanding payment for a non existent debit. On my credit report it says I owe money to the debt collection agent but there are no records of any original debt. no unpaid loans or credit cards. so what do I do? I had a serious brain injury so I have memory problems and some untreatable mental illness. Thanks for taking the time to read this.
  9. Hi, I’m sorry I haven’t replied sooner and that I wasn’t clearer. The situation is this. I had a pay as you go sim and wanted to change to a VOXI pay monthly account. the guy on the phone said I’d need a new sim that would be a standard pay monthly sim. He told me that once I got the sim then I could call and have it put on a VOXI account. I agreed but at some point in the,l ong conversation after he ordered the new sim he said that in-fact I didn’t need a new sim and could just change my pay as you go sim into a VOXI sim. so he did that. I assumed that that was the end of the matter. I had done what I set out to do. And didn’t think about the ‘new’ sim because it was not needed. I assumed he had cancelled it because it was not needed. then in January I get a letter saying I was behind on my phone bill. I called them and that’s when I found out the ‘new’ sim had been ordered but never arrived .
  10. Sorry. Xcd short for cancelled and VOXI is a Vodafone subscription that was only available to students. I was paying £10 per month on pay as you go for less data and text. VOXI was offering 12gb plus unlimited talk and text for the same price. I originally called to get a VOXI sim. I asked if I needed to order a new sim then get it set up on VOXI then cancel my PAYG account and transfer my old PAYG phone number to the new VOXI sim card. At first he said I’d need a new site and that it would be 24 months contract but that I could then transfer the account to the VOXI service, owned by Vodafone. However, after he ordered the sim he said that actually I could just transfer the PAYG sim straight to VOXI and keep my old number. I said that would be great. I assumed that there would be no new sim since it was clear that I didn’t need it now. But he didn’t cancel the new sim. They say they posted it bu I never got it. I assumed that it was all ok. I wasn’t expecting the new sim and no new sim arrived. I was happy. then about two months ago I got a bill. I tried the online chat to resolve it. I was on for hours being passed from person to person. like I said I have a brain injury and when I get stressed or tired I can think. However, they eventually transferred me to someone who could help and he dropped the chat as soon as I said hello. Faced with the prospect of starting again I decided to wait. But of course I have short term memory problems and forgot all about it till today. today I phoned and it was the same run around. After 2.5Hrs I was advised by a really nice lady to call customer complaints as they have the ability to cancel the account if they want to. I was told to wait a while to make sure that all the notes on my account were upto date. I came on here to see if I can get any advice/help before I call customer complaints. And now to you. Thanks for reading my post and responding. I’m sorry it was not clear . I am getting tired now and I make mistakes when I’m tired. I did repeatedly tell them I didn’t get the sim and they offered to send a replacement one free of charge. But not to cancel the account.
  11. last year I had Vodafone pay as you go. And I wanted to switch to VOXI. i call up and the guy says you need a new SIM card and when you get it put it in your phone and call us to get you on voxi. no sim arrives I think it’s been xed. Then I get a bill for four month line rental. I call up and even though I never got the sim and it was never activated. I have to pay £240 early termination fee plus back line rental. is there a contract if the sim is not received and is never connected to the network, just to be clear this is a sim only thing. No new phone. any help please? thanks

I had ppi sold on my in shop loan on my credit cart with nat west on the CC with halifax on first mortgage with Halifax second mortgage with Halifax on final mortgage with platform loads on my capital one credit card. I have a brain injury and just an not dabble to fight this properly. I'm tired of people taking the mickey and just ignoring my request or just confusing me so I can't proceed. I now tony have any of the paper work except the platform loans. Everything else is lost. It all goes back over 18 yrs. can I get some one to help? I don't mind paying a fee. Thanks for your time John. We realy could use the money as am retired with my occupational pension. I don't get any benefits. In fact they took over three thousand from me when my pension paid out. I've had enough nowSeeing my family suffer day after day because I can't work. Our son had ADHD heating bills are in the thousands. To be honest they would be better off if u was dead. It least they would get more help and still claim a widows pension some one please help.
  14. Hi everyone, My wife and I just bought a new car (well new to us). The car was from a small used car dealer in east Kilbride. The clutch fail just yesterday, two week after we bought it. We called th dealer who told us that he was not going to repair the car and we could not get our money back either. Well we did some more digging today and discovered the car had failed it's mot two weeks before we bought it. The car subsequently passed it mot the next day but with advisory notices. When we bought the car we were just given the mot without the advisory notice. We got in touch with the dealer who has now said he cannot do any thing as his boss is abroad for two weeks. We paid over £3000.00 for the car so no small claims ( we're in Scotland). Can anyone help. Dose any one know of a lawyer in south west Scotland who could help. I am not working just know due to a brain injury I acquired last year so we're on benefits just now. So if any one knows a lawyer who will take legal aid or who will pursue the dealer for fees I would appreciate it. We live in a very remote area and have two children one of whom is disabled.   17. Hi all, I got a new mobile phone today. It was from online web sales mobiles.co.uk. I had researched which carrier to go with and after checking oranges web site i decided that they were the ones. However, when i got it i tried to use it with the free pay as you go sim that was also in the box. No signal so i roamed around the house trying to get a signal, none. So out i went to try getting a signal, none anywhere in the village. So i want to return it. the contract sim was in an envelope marked "by inserting the encolsed sim in your handset and using it , you have signified your acceptance of the terms and conditions enclosed and will not be able to return your handset or cancel your air time contract under the consumer protection (distance selling) regulations." So since i did not use the service can i still return it? Thanks for the help.
  18. Insurance said it was not caused by hitting a pothole but mechanical failure but they will repair as I said in my last post, they paying £900 and me the rest
  19. I can't remember what the parts are but insurance man said they had broken because of wear and tear.
  20. The independent assessor has said it is repairable and they will pay £900, I have £250 excess to pay plus an extra £150+ for parts that aren't covered by the insurance. Could I contact them and ask them to scrap the car and pay me out? Someone has said you can do that, but I am not sure if you can and if so, how to go about it. I would value any help please. Thanks
  21. We had a phone (after my email to the insurance company asking them for a written explanation of their finding) saying that they were going to send an independent assessor to look at the car but I have heard nothing since. I will let you know if and when I hear something. Thanks
  22. Hi I was wondering if any one can help. My mother in law has recently had an accident in her car. While driving home from our house she hit a pot hole and broke the rear axle of the car. This happened last Friday and after some poor service the insurance underwriters have said the fault is mechanical faliure and as such is not covered by the policy. Can any one help? What rights do we have in this, and how do they determine the difference between accidental damage and mechanical failure. Can any one help us to get this sorted out? Thanks very much for your help.   23. Hi, I have been having real problem with stl. They have been realy difficult for over a year. since we paid of our mortgage. I have been off work sinc november last year due to an opperation which went south. In the course of the year i started having fits which turn out to be epilepsy. So now i get disability living allowance and incapasity benefit. Student loand ignored every letter or phone call over the last two years and even changed our address three times, then geting in touch with my dad and thretening him to get me to phone them. What can i do? the loan is from 1993. Is there any help i can get ? They have been telling me for the last few months that the loan is in default and they want it all. John Phillips
  24. Sorry for taking so long to get back. But I have been in hospital for some time. I didnt actualy sign any of the documents sent by the bank. I forgot all about them so my claim should still be ongoing, right? The bank are still persistantly applying charges. The latest was a good one. I wrote a cheuqe on the monday eveningit was put in the bank with the over night safe tuseday morning email arrives for failed item. I thought I would have at least 2 days to get the money in to cover the cheque. Hope you all had a good new year. John
  25. I have not been on here for a while but i was waiting to see what was going to happen. A few months ago i was refunfed half my charges I then sent a letter saying thank but where is the rest. I advised that if i did not recive the money i would proceed further. The reply from hbos was that if i did not sign a bit of paper saying it was all over they would want all the money back. Just at that time the news reported that all bank charge cases were being frozen untill a proper descision was reached. I had already spent the money. The letter gave me two months to make my mind up. It said that if they had not heard from my in the two months they would assume i still wanted to pursue for the full amount. I forgot about the letter untill it was too late. Where do i stand now. And dose anyone know what has happend regarding cases against bank charges? Please help. Ps i have been trying to change banks but now i cant even get a credit card never mind a new account with a diffrent bank. Happy New Year
