  1. Success Just got a letter from First Plus stating they have listened to the call transcripts and they are not happy with the way the PPI was sold and therefore up holding my complaint. They will be refund the premium and all interest paid to date! This is for my second loan, they (FP) refered the first loan to Norton finance (The broker who introduced me to FP) when I first complained. Norton wrote and said they would investigate, but I've not heard anything so far. I think they have to give in and refund the PPI as FP descision makes their position untenable .
  2. Got my interest rate letter from FP today - money grabbing gits! Also got a voice message from them re the PPi refund, which is interesting as today is the LBA deadline!
  3. Yep, thats what they are hoping for - for you to go away! Well we know better and the fight is just begining Haev you you sent them a S.A.R - (Subject Access Request)? If not, I suggest you do as it will help your fight. The letter can be found in the bank charges templates section.

  5. Hi Maggie, I'm in exactly the same position with Barclaycard! Mercers (BC in-house DCA) call constanly. I have witten to BC and Mercers several times, yet they continue to call. I think writting to them is a waste of time, as they will just ignore it! To date, I have not spoken to Mercers on the phone, but I'm at the stage where the next time they ring, I will ask the assitant to record/note down excatly what I say. I will then say the following.... "This will be the only time I talk to you on the phone, until BC produce an enforceable CCA, I will not be paying! Please stop calling and take me to court, at least then I can counter claim for my PPI." How do you think that will go down

  7. I'm not an expert, but I dont think they have to be to the penny, just close. By the time it gets to court, the daily interest would have increased anyway. The problem is that most loan companies give you the least amount of info possible, which makes calculating the true figure difficult. IMHO, It's the responsibilty of the lender to provide the correct figures. I think on the day of court (if it gets that far!), I would try to have the figures as close as possible.
  8. How many months was the loan over and what was the interest rate? How have arrived at your 'Interest to date' figure? Have just added 8% to the total? The calculator will work it out daily. If you give me some more info, I will try to help.
  9. Hmmm..... I've received a letter today from the complaints exec who has, so far, been respoding to my letters. He say's that he has just downloaded the conversations, but not yet listened to them and that he needs more time..... and that he will respond by the 4th June !!!!! How long does it take to listen to a tape! FP are definatly stalling (or they don't read the letters properly!) My LBA gave them until the 14th May. I'm not going to play their games. If I do do recieve a response by 14th May (LBA 14 days), I will comence court action and report them to the FOS, FSA & OFT. Perhaps they think I will go away (and if anyone at FP is reading this - I won't and nor will the others on this forum) Time to get tough!
  10. Sounds very wrong to me, the PPI premium is huge! First thing you should do is cca them and get a copy of your original credit agreement, then send the a SAR which will force them to send every peice of info they hold on you. You have come to the right place - it's time to take back control and get back what's rightfully yours!
  11. They may deny it, but they took your money and IMHO fully complicit. I'm in a similar situation to you and First Plus are trying to blame Norton Finance (Broker). I don't care who pay's but one on them will, I will make sure of that. FP use peoples niavity (and desperation in a time of need) to there advantage.   12. I'd ask them for the specific information/conversation and they fail to produce it, I'm sure this would assist your claim. It is up to them to prove the PPI was not mis-sold and 'loosing' one key conversation would look suspicious to a Judge (if it ever got that far!)
  13. I thinks so, but it is pro-rata..... You have not paid the 17K yet, only part of it. Seeing as you paid it early of in 2006, you would have paid 2 years worth of the 17K interest.
  14. I found the monthly interest figure on my credit agreement. I used the APR from when the loan was set up, like you it has gone up and down in the last few months, but applying that variance to the calculations would have over complicated things.

  17. Did you get this in your SAR? I did not, which makes me even more certain they have not fully complied with SAR. Did they quote 8 weeks for the comlaint to be looked into?
  18. That's what Barclaycard are saying - I agreed over the phone! yet they can't supply any evidence of my agreement (No recordings/transcripts or copies of correspondance to me!)
  19. They mean they are following your thread with interest and have 'Subscribed' to it using the option in the 'Thread Tools' near the top of the page.
  20. IMHO You were still mis-sold as you were not told ALL of the facts up front i.e the true cost in terms of interest. So it my not be possible to get a refund of the premium in full, but I would assume you could claim the interest you have paid to date.
  21. Hmmm. I've got a response today, a letter apologising for the delay in responding, but they are still reviewing my case! Good or bad news? I've not decided yet
  22. I think I've got them! It's amazing what you notice when you read things again..... In BC's last letter, they say (Quote) ' The prescribed finacial information (I assume they mean terms) together with with the full T&C's were set out on the reverse or otherwise incorporated into the application form and were specifically refered to in the credtit agreement section which contains your signature' Note the use of the word 'or' - they don't actually know! They have not sent the other side of the application form, presumably because they did not scan it at the time as it was just standard leaflet with sales blurb saying sign up now etc. Also, as you can see the credtit agreement section (pics in this post http://www.consumeractiongroup.co.uk/forum/general-debt-issues/132464-barclaycard-enforcable-credit-agrreement.html) only saysthat a credit search will be done etc. - no prescribed terms! It's been 2 weeks since my formal complaint letter and still no response! I have however, have sent details of my complaint to the FOS, FSA, ICO (done online) and Northampton Trading Standards asking them to investigate. OFT letter going tomorrow Boy, am I up for the fight!
  23. LOL Yep, same for me! I think they will regret sending the tapes as they screw themselves into the ground on it. 50% of the conversation is checking details and the rest is "you should have PPI on a loan this size but you do get a refund after 5 years Blah Blah...." They know the y have mis-sold and worse still taken advantage of people when they are most vunerable. I sure they won't want these played out in court Mrs Vorderman make it seem like FP are so wonderful and are there to help - if only she knew (...or maybe she does???)
  24. I don't see why not, as long as you have had the other companies 'Final Response' then FOS should get involved. They will be seperate cases to them.
