  1. Hello everyone, I'd really appreciate your advice on how to deal with my Mint credit card which, due to an unexpected drop in income, I'm finding increasingly difficult to pay. I actually hold 2 CCs, the Mint and a MNBA. The Mint. I took it out in October 2003. The balance is just under £10,000 which is the credit limit. There has never been any PPI. There have been a small number of late payments over the years, prob only 3 or 4. No defaults or missed payments. No over limits. I've been paying the minimum for years. I've done a CCA and, unfortunately, they have provided me with a photocopy of my original application form. The MNBA I took this out in March 2013. Balance £2000. Credit limit £2,500. No PPI. No late or missed payments or over limits. Again paying the minimum. I haven't done a CCA as it's post 2007. I've gleaned all this from this forum! Both accounts show on Noodle as Up To Date. A good friend has offered to loan me £5,000, interest free with a repayment of £50 per month until cleared. I initially thought I'd use this to pay off the MNBA and reduce the Mint but I'm now thinking I may be able to use it to get full and final settlements on one or both. I own my flat, on mortgage, and was wondering about offering them a charge on it to pay the amount off if it were sold. I am 64 yrs old and don't envisage selling any time soon Any thoughts would be greatly appreciated. Thank you

  3. Hello again, Well I've now received The Notice to Owner. Please could you advise me on which box to tick for Grounds for Representations? Most of them are self explanitary and do not apply but 2 may be appropiate: "The alleged contravention did not occur" or "There has been a procedural impropiety on behalf of this authority"? Or there's an option not to tick a box but provide mitigating circumstances. Any help, please? Thank you
  4. Thank you Sailor Sam. Albert Street starts at the junction of Queen Street. The cafe on the corner is No 1 Albert Street. I wished I'd noticed the street name in the first place but I guess that if incorrect location is fatal as you say then even it it goes to court it should go my way.
  5. Hi everyone, Please would you advise me on this. I received a parking ticket issued by a council ceo. It wasn't a blatent park where I shouldn't rather I suppposedly parked in front of a dropped kerb. I challenged the ticket on the grounds that the so called dropped kerb was simply a long length of pavement with a low kerb all along it. That was rejected by the council. Then I noticed that the street on the ticket was inncorrect. Where I parked was in Albert Street, actually outside a house, No 6 Albert Street, in Dawlish, Devon but the ticket says I was parked in The Strand. The Strand turns into Albert Street at a junction outside No1. You hear so much about being able to fight a ticket on the grounds of the wrong street but is this really true? To be honest, if I'd just chanced it and parked where I shouldn't and got caught then I'd just pay up but this wasn't like that. On top of that the ceo was extremely rude and unpleasant. I'd be really grateful for any advice. Thank you

  7. Money2me, Have you had your cheque yet? Thing is Abbey did exactly the same thing to me. Made an offer to settle in full before I sent the court bundles but no cheque yet. My court day is (was) 25th July, just after yours and I'm hoping this is not a ploy by Abbey to stop me submitting my bundle so they could then apply to strike out my case. Does anyone know if the offer to settle letter is legally enforceable? Could they wait until after the deadline for submitting the bundle has passed and then start argueing? I think I'll send in the bundle anyway just before the deadline if I haven't actually received a cheque. What are you going to do? I haven't heard of this before. Is it a new strategy? I'm nervous 'cause I wouldn't trust them as far as I could throw them which isn't very far!!!

    3 weeks to go!!!

    Thank you all for the good wishes. Lady E, No I didn't contact anyone at Abbey. I was going to as soon as the bundle had been delivered but they beat me to it. I know what you mean about the printer being on fire. I printed out hundreds of pages for mine. I think sending an e mail, especially after the bundle has reached them has got to be a good thing. Anyone who goes to all the trouble of compiling that bundle is going to go all the way and Abbey must know that. I haven't actually received a cheque, just a letter offering to settle for the full amount. They even added on an amount for interest between the time of the last letter I sent them and today. I hope this is not Abbey pulling a fast one. They've effectively stopped me finishing my bundle. Being suspicious, I suppose they could wait until after the last date for my bundle to be received (Next Tuesday), then apply for the case to be struck out and start argueing about the settlement!! Oh heck. I think if I haven't received the cheque by the weekend I'll finish and send in the bundles anyway....just in case. I wouldn't put it past them to dream up something like that or am I just being paranoid in my old age!!!??? Good luck Lady E. Keep us informed how you're doing.

    3 weeks to go!!!

    RESULT!!!!!!!!!! Got a letter this morning from Abbey settling my claim in full!! Charges, interest, and court costs. Total £3433.07 Brilliant. And that was before I even sent them the court bundle 3 copies of which will now grace my bin. Thank you for all the help. As soon as the cheque arrives I will make a donation to CAG because it wouldn't have happened without this site.

    WOW Jules. That was quick. Thankyou. No I haven't emailed anyone. I guess the people you mentioned are Abbey's. Do you have an address? What do I do? Just send an email asking them to settle?
  11. Hi all I'm just 3 weeks away from my court hearing against Abbey and I've been quite inspired by threads on preparation and success expecially those by Reka. Belated congrats there. Thing is you know how I'm feeling now with just a few weeks to go. I'm just finishing my bundle and there are a couple of things I'm worried about. One of Reka's threads mentions a "Consise Statement of Evidence". I can't find any mention of that in the basic court bundle file I got from CAG site. It sounds important. Please could anyone tell me what it is?? Secondly, did anyone include the Competition Commission report in your bundle? It was mentioned in the basic bundle file. With 3 copies I reckon that it's about 1000 pages!! I'm not sure what to do with it. It's terribly nerve wracking this, isn't it? I was going to include a smiley here but there doesn't seem to be one for Terrified! So far my bundle cocsists of: Copies of my bank statements where a charge has been made. A schedule of charges showing the date, amount and reason of each charge. A schedule of the interest due from the Martin Lewis's site although this is only up to today's date. I plan to print out another one on the day of the hearing and take it with me. Copies of all letters sent to and received by Abbey in date order. All sent letters have been recorded delivery. Print outs of UTCCR 1999, UCT 1977 and SGSA 1982 from the Basic Bundle file. A list of relevant cases again from the Bundle file including one by Dunlop Tyre Co in 1915. A copy of the OFT report on credit card charges. I wasn't sure about this one as it seems to suggest that a charge of £15 is OK. A copy of the Parliamentry Early Day Motion on bank charges. A copy of the BBC Money programme bank commission sumary. A copy of the Australian banks report by the Consumer Law centre of Victoria. PHEW!! Apart from the Statement of Evidence and possibly the Competition Commission report, is there anything else I should include? If anyone could help with these points. I'd be very grateful. Thank you
  12. Hi All, My case against Abbey is due to be heard on July 25th. I've printed out the 3 copies of everything in the Court Bundle but I'm wondering about the Competition Commission Report. 3 copies of that would be over 1000 pages (I think!) If it has to be printed so be it but might it be ok to refer to it? Has anyone else printed the whole document? Also, does anyone know where to get these T&Cs for Abbey? My charges span June 2000 to Jan 2005. Phew it's hard work this bit. Papers everywhere. Where I'd be without you guys on this forum I don't know. Actually I do....NOWHERE!! Thank you heaps for any info on above points.

  15. Hi there, I've now got a court date for my hearing to reclaim bank charges. An interesting point is that the bank asked for permission to appoint an expert witness to deal with "forensic accounting of bank charges". (Scary!!) but the request was refused by the court. The allocation form also says, "Each party shall deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing......" What documents would these be. Does it mean copies of all the letters that have been exchanged? I guess I don't have to send all the bank statements back to the bank. Or maybe a copy of the interest calculations although these change each day up to the hearing?? I can't really think of anything else. I certainly don't want to make a mistake now I'm so close! Thanks for any help.
