  4. Yes unfortunately they are the same company.I called my original Insurance company today. They said it will not effect my current policy in any way and if they start the insurace even after I have sent them over ten emails saying I want to cancel then that is illegal. Surely they should just cancel my policy. What justification could they have for asking to see my NCD? I am going to email it over to them. With my renewal quote from my current company to show the van is insured and that if they start the policy it is illegal. What type of legal action could I take against them? All my emails have only been acknowledged by there automatic server,no real response. I just received the paperwork today and still have 14 days. I just want to get my money back.I know I should not call them without a recorder but they are expensive and I do need to speak to them? Thanks again in advance Jooper
  5. Hi I rather stupidly signed up to Evan insurance for my van.I have since checked them out and its not good news.I have just tried to cancel my policy. However they are saying they need proof of my No Claims Discount before they can refund me. Surely this is against the law? What about my 14 day cooling off period?I only bought the policy on Sunday and foolishly paid in full £372.I have definately been ripped off. They used bank of scotland world services so I could not cancel the payment.I have only found extremely negative reviews and alot of people looking for their refund which never comes! I was wondering if anybody has had any dealings with them or any good advice. If I cancel the policy before its even begun surely I should not have to pay a £75 cancellation fee? Do I need to declare this now as a cancelled policy to my current provider as I have now renewed with them? Will this effect my future insurance ? Thanks in advance Jooper Policy is not due to start untill May.
  6. Sorry I think this thread is in the wrong place how dom I move it?

  8. This is it good people. The reply from Lowells reads as follows: Dear Jooper Further to my letter dated 5 December 2008,I have now investigated your complaint fully and would respond as follows: Your comments that this account is in Dispute and that we have breached the OFT guidelines by attempting to collect the outstanding amount owed has been noted. Please be informed that we are unaware of any ongoing dispute on this account. On receiving your comments infirming us of the above we requested details of the dispute from you in our letter of July 13 2007.As we did not receive any response from you we ,activities were continued as normal. On receiving your recent correspondence in which you informed us that the same was a formal complaint, all activities were suspended and our complaints procedure was instigated according to regulatory requirements.Your comments as outlined above are therefore not accepted. However,in view of the commercial viability of continuing with our pursuit of this debt, the decision has been made to cease collection activities and close this account forthwith. You should no longer be contacted with regards to this matter.I must reiterate that this decision has been made solely on the above reason and not as an admission of any wrongdoing whatsoever. Please not that under the terms of our Complaints Procedure this is our final response.Should it be the case that you remain dissatisfied you may refer your complaint to the Financial Ombudsman Service. You need to do this within six months of the date of this letter. For more information please see the enclosed guide,Your Complaint and the Ombudsman. Well talk about covering you back, still the fact that they are now going to leave me alone can only really be seen as a win. I just want to say a massive thanks to everyone who has read and advised me with this thread. I honestly could not have done it without this fantastic web site. Thanks again from a very happy Jooper.
  9. SAR is on way[just recieved letter. Also as the dates of the actual charges are over six years old is this debt now unenforceable? The account itself was then closed on 21/05/02. Does the debt itself run in conjunction with the closing of the account?Or from exact dates charged? Any Help always gratefully received. Merry Christmas Jooper
  10. Just to ask again: There are nineteen unpaid standing order charges of £30 a time.[£570] Four of these were payed by me as the account ran and was then back in credit. The account was left by me £3.13 in credit on the 01/07/01. On the 06/08/01 seven charges at £30 a time were added. Then on the 06/09/01 eight charges at £30 a time were added. The rest were then put on in the form of int debit?at roughly seven or eight pounds each.I did actually then pay in a total £125 in small amounts before the account was closed by Abbey back in 2002 being £384.73 in Debt. What I don't understand is how so many charges can be added ?unless was for a weekly direct debits maybe? 13. I have just now received this e mail from Abbey. Dear Mr Jooper Based on the additional address information I have located an account and have today arranged to retrieve all the data held by Abbey. The information collated will be sent out to you as soon as I have received it from the respective business areas. In the meantime, I will send you a written acknowledgement confirming the original Abbey Account Number for your future reference. Kind Regards This can only be good news and has only taken six months! When I have the information I can see exactly what the situation involves. Once I have said information how do I then go about retrieving or at least getting the charges removed? Cheers Again to all Jooper
  14. I have been expecting them to cease ever since I told them the account was In Dispute. As ever there is always a massive difference between expectation and reality with these people. I will add the 14 days part and e mail it now. Thanks again for all help. Jooper
  15. Firstly I would just like to say thank you for all who have taken time to look at my thread.I really appreciate it. I have tried to scan the details into my friends computer but we did not seem to manage it. We did however work out two things. 1:When I have contacted Abbey I have given them the reference number that Lowells Portfolio 1 have provided with all their corespondence. It is now clear to me that Abbey have assumed this was the account number and is probably why they have found no details. 2:I now believe the numbers in the corner of the bad printout may actually be the account numbers and was thinking of sending this to Abbey. Ref.***** ********* Further to my earlier emails I would like to point out at this time that ************* is the reference number that the debt collectors Lowells Portfolio 1 use in their correspondance with me. It is not therefore an account number. One of the correspondance I have recieved is a bad print out of the statements . I can only guess that the numbers in the corner are said account number. They are:*************************** I hope this will assist you in tracing the account as I have no more information. Mr Jooper I do want to get the information as I would like to claim back the charges as that is all the debt is made up of.I left the account in£3.13 credit and all the charges were then added later before the account was closed down. Do you think I should post above email or leave it to them? I have also today photocopied everything and have sent it to the Office Of Fair Trading as the debt collectors have persued me continually even though I told them the account was in Dispute in July. Thanks again for all help and advice. Jooper
