  1. If you are about to, or recently had, a BT line connected you may be hit with a whopping £125 connection charge. We were hit with this unfair charge as the preious tenant had used talk talk before the phone was disconnected. However, we have just discovered they have a special offer at the moment of half price connection at just £62. After a long phone call to explain that we were never given this option we have just had the charge reduced. so if you want to cut this charge i half read this page... BT Price List and then phone them up and get your money back.
  2. Oh, and also... the judgement says that if payment is not made within 42 days the debt starts to accrue interest at 8% It's been just over a year and I haven't been paid, so how do I work out the interest? Is it plus 8% of the whole £8k?
  3. I started Maternity Leave and was not paid my Statutory Maternity Pay by my employer. I took the company to an Employment Tribunal and won - even though I have not been paid a penny of the award yet. I did an SAR on the payroll company regarding my Statutory Maternity Pay and the information they sent me show that my employer falsified documents that he sent to the Revenue when applying for the Statutory Maternity Pay to be paid to him. The documents show that he created false payment record to show the dates that I was paid my Statutory Maternity Pay - these are all fake as I was never paid the Statutory Maternity Pay. He used these to put in a false claim for Statutory Maternity Pay from the Revenue, saying it was to reimburse the money he had already paid me - but I was never paid. There is also a document from the payroll company stating that they had spoken to my boss and he had confirmed that he had received the Statutory Maternity Pay payment from the Revenue. Does this count as theft? He told them he's paid me to falsely claim money from them - and then withheld it from me! How do I complain about this, and who to? Can I go to the police - he has commited fraud and theft i would think and i have the documents to proove it - so what do i do?
  4. Hi. In June 2006 i informed my employer of 2 years that I was pregnant and would be starting my Maternity Leave in December 2006. I did not receive my wages for Agust, September, October or November, and I did not receive my Statutory Maternity Pay for December. In the middle of January I was suddenly issued a P45 stating that my leaving date was November 13th! This is a total lie - my boss falsified the P45 so he could get away without paying me my owed wages or paying my NI and PAYE. I was not paid my Statutory Maternity Pay for January 2007 either. So I got a solicitor involved. My boss agreed to take the P45 back and reinstate me and pay my Statutory Maternity Pay and unpaid wages. I was reinstated and carried on claiming Working Tax Credits - as I was still classed as working and am allowed to claim WTC while on Maternity Leave. I was not ever paid the wages or the Statutory Maternity Pay. My Maternity Leave finished in June 2007 and I tried to inform the Tax Credits people about the change in circumstances. They asked for my P60. I have not been given a P60 - even though the boss was told by the Tribinal I won that he had to provide one. The Tax Credits people are refusing to let me claim CTC or my partner claim WTC as I cannot provide a P60. I have explained to them a thousand times but they just keep insisting I need one. I have contacted my local tax office about it, but they say that I was made redundant on 13 November 2006 - as they have a P45 for me, but I can't get a P60 as I was not working afetr November!! I just don't know what to do - not only have I lost all my wages and Statutory Maternity Pay, I now can't get Tax Credits either because of my ex-boss. He has falsified documents that he submitted to the tax office and this has had a detrimental effect on me. Nobody seems to listen to what I'm saying. How can I sort this problem out? I need the tax office to disregard the P45 and issue me with a P60. HELP!! I went to an Employment Tribunal and won, but of course he's made no effort to pay me the money awarded. But I do have all the documentation.
  5. I worked for a small company with 3 employees (including myself), and had been there for over a year when I found out I was pregnant. I told my employer I was pregnant in June 2005 and would be starting Maternity Leave in December 2005. I wasn't paid in August - When I asked about it I was told the company was waiting for invoices to be paid and I would be paid ASAP. I asked the Jobcentre about it and was informed that if I left voluntarily I would forfeit all right to Statutory Maternity Pay and would not be able to sign on. So I was forced to keep working without getting paid. I wasn't paid for August, September, October or November. My Maternity Leave started in December 2005. I didn't get my SMP in December or January. On February 27 2006 - 5 days after my child was due - I still had not been paid and I went to a solicitor. In April 2006 the company changed hands to two new directors, who made all sorts of nasty accusations about me leaving the business in the lurch by leaving! The solicitor discussed the situation with the company and after no payment was forthcoming eventually applied for an Employment Tribunal in May 2006. The solicitor filed claims againt the company itself and against the two new directors individually, saying that they would then become responsible for the debt. In July 2006 the company reverted back to the previous director. My solicitor had to resubmit the Tribunal Application forms. But when she did she only claimed against the company name this time - not the director. In October 2006 I won the Tribunal - my employer didn't even bother to turn up - and was awarded £8k - £5k in unpaid wages & SMP, and £3k in compensation. It is now October 2007 and I have not had a penny from my employer. He is still trading and taking work, but I have not been paid. The solicitor has said that as there's no money in the company there's not much I can do. If I want to wind the company up it will cost me a further £900! So as far as I can see my employer is going to get away with keeping my wages and the Employment Tribunal was totally pointless. My questions are these... 1. Should the solicitor have submitted the Tribunal claims in the company name AND the directors name aswell. 2. If she should have done so, is there anything I can do - the initial forms filed were for the directors aswell, so is there any way I can use those to pursue my cash? 3. What should my next move be? I can't afford to do a winding up petition - but what else can I do at this point? Do I go to a small claims court or county court? Please help - my partner and I are on a very low income and cannot afford to just lose this money - £8k was a whole years wages for me!!
  6. Well, I'm still a bit of a newbie at this and I'm sure other people here can direct you more accurately. But here goes... It's pretty much the same as the bank & credit card charges issue. The OFT have said that any charges incurred can only be the same as it costs the company in admin costs. This is usually a few quid - so charges of £25 and the like are unlawful. So if the SLC has charged you this sort of charge each time (as they have me) then they have done so unlawfully. If you have a record of everyting you've paid out in charges over the years, great but if not then you need to do an SAR (Subject Access Request under the Data Protection Act). You can find the template letter here... http://www.consumeractiongroup.co.uk/forum/bank-templates-library/516-1-data-protection-act.html You need to include a £10 payment with it, but this means they have to produce copies of everything they hold about your account with them - including charges incurred and payments made. Once you've got this, add up the amounts you've paid them and send a letter asking for the money back.   7. You should still be able to claim back any arreas charges as we all know they are considered to be disporportionate, and therefore illegal. Seriously, check out some of the other threads here and send of a letter (like the bank charge one). you could get a nice little nest egg back from them - after all it is rightfully yours!
  8. Well I just got another threatening letter from the SLC about charges on my account - even though they accepted my dferrment two months ago! The date on the letter was the same date as the deadline for the CCA request, which they havew failed to comply with! So they manage to send a threat but can't come up with the CCA. Still no SAR info either, but they've got until the 28th to produce that.
  9. Yep here too. They had until Oct 4th, and surprise surprise, no CCA. does this mean the debt is unenforcable? Can I claim back all the money i've paid them now? I am a full time mum with no income of my own, and yet they're still taking payments out of my bank account!! They've deferred me on one loan, but not the other - they say i didn't send it, but they were in the same envelope, and it was sent recorded delivery!!

I too suffer with chronic fatigue as a Lupus sufferer, so I understand what you're going through Don't let them get you down, they are bullies and feed off people's anxieties. I have also been paying arrears for years due to 'lost' deferrment forms and a month ago was threatened with default and court action. But I have now done a CCA request - which they have failed to comply with and a Data Protection S.A.R - (Subject Access Request) - which they are running out of time with fast. SO now I know they can't touch me anymore, their debt is unenforcable and I am going to claim back all the money i have already paid them. You should do the same. Their charges are illegal and their tactics are underhand. Don't let them get away with it. If you have been classed as unfit to work they HAVE to write the loan off - if you want free legal advice try (link to commercial site removed.) they're great and totally free. good luck

  12. I've had a smiliar problem. I worked for a small company - with only 2 other employees and the boss - Mark Briscoe of NMR Web Design. When I told him i was pregnant he just stopped paying my wages at the end of the month. The jobcentre told me that if i left i would lose all entitlement to maternity pay, so i was forced to keep working there and not being paid for 3 whole months. then when my maternity started he just didn't pay it to me. i took the company to a tribunal and won £8k+ in compensation, but it's a year and a half on and i've not received a penny. he said he's got no assets and keeps saying he's winding the company up - but he isn't he's still trading. to wind the company up will cost me nearly £1k, which i just can't afford, considering i might not get anything back. this man kept my wages and my maternity pay, and he's been allowed to get away with it! it's as if he stole from my baby! the law is a joke, totally unenforcable and there's nothing i can do. Meanwhile i still have to pay council tax for that year as they say i was 'working'!!
  13. As some of you may know there was a problem around the 13.9.07 when Paypal threw up the wrong addresses when buyers paid for items. This problem is still going on. i use ebay all the time without a problem, then suddenly on 16th september paypal gave my old address to 4 sellers. All 4 of my items have been sent to an old address i lved at more than 3 years ago, and I've lost £40 because of it! i contacted ebay - they blamed paypal. i have contacted paypal about 6 times but they are totally ignoring me. no reply to emails and refuse to acknowledge the problem on the phone I don't know what to do anymore. my sellers didn't put return addresses on anything, so now i've got no option but to claim it from them using item not received disputes! but i don't think that's fair - it's paypal's mistake they should reimburse us. I have given them more than 3 weeks to respond to me, and they haven't. so today i sent the story to watchdog - the more people that complain, the more likely they will do a story about it. there are loads of people who've been afected, read the ebay forums... eBay Forums: Paypal have a bug. ???????? ... if anybody else has had the same problem i recommend you all write to watchdog (new series starts this week) - there is power in numbers and paypal and ebay need to be shown that they can't ignore their customers complaints - they have taken their cut after all!!

  15. he has had no contact at all. They have never written to or phoned him and he has never writen or phoned them either. It's odd cause I get hassled by them every year on schedule but nothing for him at all.
