  1. Thats a shame, but if they make a ruling is such a case as this with the countless number of bankers ( ) watching and waiting to see what happened, i am sure that it would have an effect. As someone said before, they are all sitting around a table, trying to decide which one will be the first to take on the BAG in County Court, very Pratchett!

Having gone away and thought about it for a moment, their solicitor (if they are advising properly) are going to tell Scabbey that the Fest Track means that they will have to disclose they way that they calculate their bank charges. Two scenarios come to mind and a question Is this the court that can set precedent? if so then this is VERY exciting indeed my guess is that they will be advised of what they will have to do and settle VERY quickly........or they bite the bullet and take the risk of court (unlikely,even if it isnt the court that sets precedents any ruling against Abbey will have huge ramifications) hmmmm very interesting

I never mentioned them and neither did she, at this stage, I thought it better not to mention them as I think it might be getting somewhere, if I get them Friday this will be a big plus for everyone who is being battered by the MA and I will be willing to sign an affidavit listing all this should anyone want to go to court. Of course the Information Commissioner might be interested too

Well, I rang them and the lady on the phone said that there was a big delay blah blah blah, and I asked her what that had to do woth me as I was assured that my statements were in the post last Wednesday? She said that she had to not on my file to back this up, I told her that she needed to look on the complaints log as it was on there. She got a little more to the point when she realised that this was a person who understood how these calls were logged Well she went off for a while and apologised profusely and stated that she had "found" it in the log and that they werent in the post at all (surprise surprise) so she "promised" me that they would now take priority and that i would definately have them by Friday and she (without prompting) gave me her name and a reference number to get back to her if they didnt arrive!8-)

Hello and Welcome I have not been here that long myself but what I have learnt so far is that they will try and frighten you with jargon you dont understand, they will wriggle and fight at every turn but if you keep faith and do everything that is in the FAQ's and standard forms then you will win, because no one has yet lost. If you read the FAQ's thoroughly and read a few of the threads on here (honestly it is better than a soap opera) you will learn what to do and in what order to do it. Your first port of call is to aquire all your bank statements for the last 6 years, you may have to request them from the bank, there is a template letter for you to use, send them £10 with it, this is the maximum that they are allowed to use, and in about 40 days you "should" receive them, there is also an excel template that you can add up all the charges. If you require any more help then, the best thing is to start your own thread and there will always be oneof these wonderful people on here that is around to help you out best regards and good luck Julia
  10. So you know I have given up reading "books" because this site is more enthrawling than any novel ) and Seminole, if I do get my statements and you do need a witness statement or even a witness then I will be more than happy to oblige
  11. If I get them that is, but if I do I will be happy to oblige, can you just stall em till I get my money, or will I have grounds to sue if they withold the money that they have been "keeping" for me, just because I gave evidence against them

Please remind me never to hack you off This is great, I would love to challenge them on their statement that their filing system doesnt relate to individuals, is not part of a set of information, is not structured and is not able to be interrogated !! I find this absolutely staggering that a major financial institution could admit this about their own data storage and retrieval, they hae no business being in business at all, Anyway, If I get my microfiched statements through by Friday then this is all a load of hogwash anyway (which we know already) You ought to set up business as a professional letter writer Well done

  14. Well I have been promised that my statements are in the post to me as we speak, so if they are that is Monday to Wednesday/Thursday which totally blows away all their arguments!
  15. just rang the Scabby again to actually confirm that the statements were sent last night, even if they are posted out today I think that this blows away their argument about microfiches and the amount of time it takes to gather old statements. Just awaiting their call now
  16. Do you know, I just dont beleive them, perhaps 20 years ago, but not now, they are yanking our chains, i bet they are all neatly organised, can you computerise microfiche? Perhaps onto some computerised filing system, of course, in an ideal world one would tap in a name or account number in a computer and be presented with a file holding all account information and all statements
  17. i still find it incredible to beleive that they keep this stuff in "boxes"!!!!!! this is the 21st century!!!!
  18. I totally agree a huge financial institution "must" have an adequate records system not only for accountability but for people like the revenue and foresic police to be able to interrogate easily
  19. Hey its no problem at all, my online banking only goes back to january, I think that they only let you see a certain amount of transactions. I thought that my earlier statements (2000-2004) were kept of microfiche "if" I get them in the next few days, it kind of blows away their argument about "it takes alot of time and effort to trawl through and find them" doesnt it? I requested them originally on the 4th May, via the call centre, (abroad) rang up a week later to ask why the money hadnt been taken out of my account (scotland) quoted the DPA and they got all apologetic and said that I would have them in about 4 weeks. Rang up Complaints department today and quoted "DPa" and "40 days" and "escalating complaints" and she said that it would be posted out tonight 2nd class, I will check my account tomorrow to see if they have posted it. To be honest I will beleive it when i see it, but you never know, perhaps a new directive is to send out copies in a very timely manner
  21. I rang up and complained today and I was told that 2000 - 2004 copy statements will be in the post to me (second class) tonight, they must work quick!!!!

  23. Just rang the Scabby to ask where my statements are and low and behold, they havn't done it, even though they admitted receiving the request! I said that the 40 days are nearly up and this isnt good enough, the poor girl on the end of the line said that an "urgent request" will be done and they will post them second class this evening. We shall see on the upside, I have opened my parachute account, so all is organised here. Bring it on
