  1. Hi I have just checked my license has no penality points on it. Cannot find any court dates etc
  2. Default Notice of removal from Marstons - court fine from 2012 I wonder if someone could help me. Today I received a notice of removal from Marstons for a court fine back in 2012. They said that the court had been trying to find me for 4 years in Apriil sent a letter to my current address which is a total lie as I have never received anything from them. This is where is gets complicated. i moved out of London in August 2013. I can remember them endorsing my license but I cannot remember a fine. Also they are charging 1285.00. I don't understand why they have charged me so much. The bailiff explained it was because they had been looking for me for 4 years. I have explained that this is not my fault if they are unable to find me. Why am I being penalised for something I knew nothing of. This is extremely excessive for something I know nothing of. I certainly don't have that sort of money to be able to deal with this. Also from November 2013 to June 2014 I was homeless due to a house fire so anything that would have gone to the address would have been returned. Also this is a removal notice. I did not receive any form of enforcement notice which the bailiffs admitted most probably went to my old address!!! So I asked them if that is the case how am I meant to know of this to which they couldn't answer. Can you please advise me what my next move should be as this is completely unfair to expect me to pay 1285 for something I knew nothing of.

  4. At last I got my money back but not all. I had to wait for 7 weeks for it and even then they took 500 pounds off. However they called me yesterday as the V5 document is in my name. Shall I make them wait as long as possible or can they apply for a new one? I maybe in a position whereas I am now holding all the cards by having the V5. Do you think I can negotiate some of my 500 pounds back.
  5. yes done it all the car was £5000. It is apparently still being fixed this is over 3 weeks now. Its ridiculous. I have amended the template and sent recorded. they are ignoring me. I can't let this drop as I need the money back to buy another car.

  7. should i hire a car. its been a week already and despite sending them an email regarding refunding i have heard nothing. Right now I have no car and they have not responded to any emails. Its difficult because i rely on a car to ferry my kids around.

  9. Could someone please offer me some advice. This maybe a bit long winded but I need to put everything down for you to understand the situation. I bought a car from Pinewood Autos in Surrey 2 weeks ago. I paid for it and then the dealer followed me to the post office in order for me to be able to tax the car. On the drive to the post office the DPF light, anti skid light and engine maintenance light came on. I pointed this out to the dealer and he promised to get it done. I drove the car back to the garage and left it. They promised to have it back to me the next day this was on a Thursday. I had to call them on Friday afternoon and they told me that they had no clue what was wrong with it and that they were going to take it to mazda. I told him if that was the case I would need to have the mazda receipt to guarantee the work done. On Monday I had not heard from them and I finally called them up and the guy Martin was really offhand. With phases like when its finished I will let you know until then there is no point in calling. I had to explain to him that I bought the car on Thursday and I would like to have it to drive. Monday afternoon I discussed the situation with my husband and we decided to reject the car. I called them up to say the same effect. Martin responded I will get back to you later. Having waited all evening I had no response. Tuesday morning I called up again requesting a refund to which the response was I will need to wait for accounts department to come in. I was so mad me and my partner got in his car to make our way up there, halfway there my 13 year old son called to say that the man from the garage delivered the car, gave him the key and drove off. Got home and drove the car and noticed that the car had knocking underneath. Trying to ignore this I continued to drive the car. Then on Monday the fuel gauge stopped working. Thursday I had to drive to Stourbridge for a house completion. The car worked fine but while driving through town the brakes seemed a bit weird. I had to call the AA out to check it but he said he could not find anything wrong. So I decided to drive back to London. On the M40 motorway I was driving for about half an hour then all of a sudden cars starting braking and when I tried to brake the braking system completely failed me at 70 miles an hour. Luckily the cars in front started to move again but that was a complete lucky escape. I ended up staying in a hotel for the night as the children were tired (3 children) was in the car and 1 dog. Luckily I am with the AA and asked them to recover me and they drove the car to the garage. When I explained the situation to the garage dealer he was flippant with yeah I will get it checked out. When I pointed out that the heating thing was off and that the cigar lighter doesn't work which I need for my satnav his response was lets just worry about the brakes. I have only had the car for 2 weeks can I ask for my money back. I am out of pocket by paying for a hotel and a taxi home as they didn't even offer a replacement car. As the car is with them can I formally reject it and what happens if they pull the same crap by delivering it and running away.
  10. i woke this morning to find a clamp on my car. The baiiliffs put a clamp on, didn't even knock the door. I tried explaining that it is a hp vehicle only to be told that he can take it away. I then told him I was not working and have young children the youngest being 5. I also explained that I suffer with chronic depression which is classed as a mental illness and none of these have worked. I spoke to Southwark Council who said they cannot do anything. Please help. What can I do?
  11. No I do work but I am a single parent. I can't remember getting a parking ticket or anything but last year I was going through a stage of depression and I really did not deal with anything to be totaly honest. I was just fed and up and couldn't deal with anything. However I did see a psychologist at the time and things have slowly but surely improved. Ok since yesterday this bailiff has been phoning and texting my phone saying he is going to be putting the bill up if I don't pay by Friday. He has texted me 12 times already this morning. It is driving me mad. I have never said I wasn't going to pay. I spoke to the Marston office yesterday and she said there is nothing they can do as it is out with the bailiff. They were not even willing to enter into some sort of arrangement. All his texts are now saying pay by Friday or the money will go up. I am a single parent family with 4 children the youngest of which is 4. He was absolutely terrified the other day when he came. On each text he now says pay by Friday 10am or the money goes up. I am at the end of my tether. I also have a heart condition which causes me to have painful palpitations for which I am on medication. This bailiff is making things worse. I have never objected to paying, I just wanted a reasonable time to pay it in but the constant texting and phoning is beyond ridiculous. When I speak to the council they say there is nothing they can do it is with the Marston Group. Where do I go from here. I am in no way going to let this man in my house. No I no longer have the car.
  12. I wonder if someone can help me. I was visited this morning by Marston banging on the door and shouting. I refused to open the door. They have a warrant for £456.00 in an old parking fine. I have already paid £100 last week and another £120 today. I am trying to go as quickly as possible. In the meantime I have just filled in a variation order to Northampton County Court where this was issued. However when I spoke to Marston's they are refusing to listen when I explained that I could not pay all at once and I am going as far as I can. This morning the bailiff was shining his headlights through the front door, banging on the door. I have 4 children. My son of 4 was absolutely crying, he was so terrified. I have written to the council regarding this parking fine and offered to pay them directly but they are saying it is with the bailiffs and they cannot do anything about it. He said he will be coming back at 7pm with a locksmith. Firstly can they do this even though I am making payments on this and also does anyone know how much i need to send to Northampton County Court for the variation order fee. Someone please help.   13. Hi I was in a similar situation to yourself. Firstly calm down. Sit and write a letter to the council concerned stating your circumstances and also remember to add in the letter that you are classed vulnerable under the Enforcement Agency Act. Explain your partner's diagnosis and the stress that this is causing. The council will either take the debt back or ask the bailiffs to be reasonable. Tell the council what you are prepared to offer the bailiffs. Don't worry the council will look at your circumstances and should be reasonable. Hope this helps. Let me know how you get on.   14. My parents were clamped over the weekend. Because they were unsure of the parking restrictions around that side, my dad left my mum sitting in the car. Park Direct came along and pointed out some signs which were high up and clamped the car with my mother sitting in it. They had to pay £250 to get the clamp off. I was totally disgusted when I heard this as they are both on pensions. I didn't know it was possible to clamp a car with a passenger in it, is this legal?
  15. Can someone please help me. My parents were clamped on Saturday. They did not see any signs but because they were unsure my father left my mother in the car. Park Direct still came and clamped the car with my mother sitting in it. Is this legal?
