  1. Received the standard OFT vs banks letter from Barclays. Looking to send LBA letter; my only concern is, I really can't afford £120.00 to submit my claim to the courts. If and when the OFT vs banks hearing takes place, it is, in my opinion unlikely that the banks will win outright, that is have to repay no bank charges. If the judge states a reasonable charge is, say £5.00, won't the judge order the banks to refund any charges owing, without customers going to court? What are your thoughts?

  3. I work in debt recovery and routinely send bills to customers. I work in a low-tech office. We release letters to the printers, envelope the letters and post them. I'd say the total cost of this is around 35p (1st class). These banks have hi-tech software, printers and enveloping machines (and 2nd class post!). I'm not sure what the 'staff costs' are. Unless they add a charge up front for customers quering the bank charge, which is, in itself, wrong. I would, of course, settle for an outcome at the OFT vs Banks hearing of £1.50!!!:)

  5. Sorted spreadsheet! Claiming £1,900 charges and £458.00 interest which I was very suprised at. In light of the OFT update, I assume, I just cary on as normal and fllow the procedure outlined in the template library? Thanks.

  7. Requested my 6 years statements 38 days ago and they arrived today. Enclosed was my £10.00 cheque as Barclays "Do not charge for providing such a service"!! Total charges I'm claiming are £1,900!! Just completed the prelim letter and the schedule, to be posted Monday. I know I don't mention interest at this time but have one query about the interest speadsheet. I'm using the 'Simple-charges-calc1' spreadsheet. Specifically, what do I enter between the brackets in the 'days since offence' column (here "=NOW(???)-XXXX"?) I've tried entering today's date but keep getting an error message. I'm using the Works spreadsheet. Thanks in advance.
  8. I agree. I've been a member of Leeds City Credit Union for about 8 years. Had several loans and have a Christmas savings account. Staff are very friendly and helpful. There is still a bit of a stigma, I feel and I can't quite make the jump from bank to credit union!!

  10. I guess the simple answer is panic! I've seen the recent posts regarding claims being suspended - I cannot afford to loose the £193.00 that they have offered me.
  11. I received a letter from the courts yesterday stating that I'd made an error on my N1!! Cheque for £30.00 enclosed. With this in mind, I've decided that I'd like to accept Halifax's offer of £193.00 against a £300.00 claim. I sent the rejection letter stating I refuse their offer and take money from my account. The money is still in, can I send a letter stating "I've changed my mind and I'd like to accept their offer". Can I take this letter as an OK to spend the money?? Thanks.
  12. How could each of these influence Halifax's next stage! Are they more likely to pay the outstanding balance if you accept part payment or reject and ask them to remove? Thanks
  13. Send letters 1 and 2; filled N1 at court Friday and £193.00 cash (!!) payment in my account today! They, in all liklihood haven't received the court papers yet. Tempted to accept - I'm claiming £300; but having shelled out £30.00 court costs I'm going to send the reject partial offer letter. The letter from Halifax says if I do not accept their offer to return the money. I don't want to do this... I assume I should just keep this and send the rejection offer. To anyone who hasn't claimed yet, my advised would be to do do. NOW!! Thanks to this forum and all those who assisted my claim. Just my submitted Barclays claim to go...

Should I just amend template 3 from: Dear Sir/Madam Account: xxxxxxxx You have failed to comply with my Data Protection Act Subject Access Request dated (Insert Date). If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice. Yours faithfully [name] TO Dear Sir/Madam Account: xxxxxxxx You have, as yet, failed to comply with my Data Protection Act Subject Access Request dated (Insert Date). I have, since sending the above letter, found my closed Barclays bank account details. These are XXXXXXXXXXXXX. If you do not comply by **date** I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice.   15. Hi, my 40+2 days is due to expired shortly and I've received no statements or acknowledgment letter. I sent the SAR letter without my account details. I've since found them! Should I send them with a copy of my origional letter or just wait until 40+2 days has expired and send a breach of Data Protection Act letter?

  18. Hi, 1st and 2nd letters sent. Quick bugger off reply to 1st letter; no response to 2nd letter. Both sent recorded delivery and have checked to ensure they were signed for. Submitted N1, etc at Leeds Court today. It was, frankly, a scarey experience! I really, really.....hoped they'd settle before court action... I'll await their response or not and then send them the final letter. Thanks for a greats site and advice already given...

  21. What an idiot! Completed letter 1 and sent off to Halifax; recieved standard 'Bugger off' letter. Sent second letter, by overtyping, but forgot to change origional date! Letters have been sent by recorded delivery so I have these dates. Will this mater?

I expect them to play hard ball as I didn't know my account number. I want to plan ahead and need advice - can I get a letter typed up in readiness for the expected "We are unable to locate your account details" letter? Great site and thanks in advance.....
  23. Hi, currently claiming charges from Halifax (second letter just sent). I had an account with Barclays for a long time and am aware of bank charges that I need to claim. To get my account details and statements do I just send a request for them + £10.00 or is there aniother way? Thanks in advance.
