  1. cheers lateralus will do that . its very difficult to follow from one day to the next how courts are reacting and from my own experiences with just dealing with derby it sounds though its the same for those working in the court!!!
  2. ok so rang the court up this morning and explained that i had sent my request for a judgment in and that the letter they sent me must have crossed in the post. they say at derby that there is a blanket stay on all claims however those who are at the judgement stage will be treated indivdually. they told me i should here from them within the next two weeks . i explained that i was concerned that according to the letter i had that it said i only had a week to respond about the stay . they said not to worry as they are spending all of there time dealing with bank charge cases and the judges are getting fed up with the banks leaving settlement to the day of the hearing . so it sound as if i may be one of those lucky ones who might just get it sorted before the long wait....... but then again im not banking on it ....... sorry couldnt resist that.

  5. ok i can use that as some leverage then when i make the call but usually the people at derby court arnt to specific as what is happening , although they are as helpful as they can be. the cases that have been settled then ,i will incorperate into my letter to the judge but i will see what they have to say about the request a judgement form as i have said they must have passed in the post . god its been an bad 18 months .....started this in feb 07 and in fed 06 my mum died and i started to build a bungalow in that same week ....... looking forward to a few months of relaxation think i have sold the bungalow but you never know untill they sign on that bottom line !!!
  6. yes anything that you could do would help . just read through the letter again and it says that "this case is stayed with immediate effect pending the final determination of the test case in the commercial court . ANY LISTED HEARINGS IN THS CASE ARE VACATED AND WILL NOT TAKE PLACE.... " then at the end it says that its therefore appropriate for this case and many other cases to await the decision of the commercial court"
  7. thanks for that . read all on stays etc but not sure what to do on the fact of my request judgement form ,they must have passed in the post . so will ring monday to clarrify. thanks again
  8. on saturday 11th had my stay from derby court .a tad annoyed as on the friday had sent off the n225 form requesting judgement as the court had said if dg hadnt presented to the court its papers then the case would be struck out . so saturday opened up the bad news but now what do i do ?? is it worth me ringing them up to see if i will still get a judgement on the strike out or proceed with requesting the stay to be lifted .
  9. cant remember if i had to send a fee when i started my claim on line . just filling a request for judgement form in for the court costs . can anyone please advise ??? dont want to let hsbc off with anything now do we !
  10. derby.... spoke today awaiting the results of a meeting .at the moment they are now carrying on for those cases with a hearing date . just filling my request a judgement form as dg never responed to returning papers back . ha ha ha ha !!!
  11. can anyone guide me through the n225 form as the court have had no reply from DG and there time is up!!!! on part d do i put the amountof claim at the start of the claim then work out the amount it has come to with interest to date .finally the time it has taken i cant remember if a fee was needed when i claimed initially on line . can some one please give some advice . Derby are continuing with claims that have a date although the woman in the listings dept said that they are waiting on advice from a meeting with other judges
  12. derby court . hearing sept21st .- first contact today suggests that any judgement will be made after oft case. will update on monday 6th
  13. dont be ... its not that bad . but be aware that with the oft it may take some time

  15. sarah , mine was on the same lines just different times .... not sure about the aussie report, didnt have it in mine. but im sure pete will know where to find it . its got to be here somewhere .. just calm down and you will be ok
