  1. This is an extract from Martins Lewis' newsletter - Bank Charges Court Date Announced: 14 Jan. Plus clarity over credit card reclaiming? Last week I met with the Office of Fair Trading to discuss Bank Charges and learnt the test case is scheduled for 14 Jan and should take around 10 days. It'll only decide whether 'unfair contractual terms' rules can apply to bank charges; after that OFT must decide if they are unfair. At that point it'll return to the banks who'll either concede or it'll go back to court. While there, I strongly requested it clarify that the test case and ‘stay’ on reclaiming only applies to bank charges; outrageously some courts are incorrectly blocking credit card cases too. Could be a long wait!!

    Courts & Stays

Hi Received letter from Preston CC today telling me my case against HSBC has been allocated to the small claims track and will be heard on 25 Sept. 07. What has been DG solicitors response recently - are they applying for stays, fighting the cases in court or making last minute offers? Anyone help? wazbc
  4. Thanks for that. Not posted anywhere else - transferred my case to Preston CC. Will sit and wait - thanks again.
  5. I am claiming bank charges from HSBC. Gone down the MCOL route. Northampton CC transferred case to my local court. Today I received an order from my court which states '' Before deputy district judge........sitting at .........county court ( next line) Upon neither party attending it is ordered that the case be transferred to ................. county court to be listed with other Bank charges cases. Is this a new ploy by the courts , what does it mean and what happens next . Is there anything else I should do or just sit and wait. I have written to DG solicitors twice but had no reply. Any advice / help would be appreciated.
