  2. Just a little update today the delivery driver turned up with payslips for the last 2 months nothing for the before that though? Seem very odd clearly trying to hide something. Also the driver did not know her address so the employer has given this out would this be a breach of dpa?
  3. Brilliant thank you everyone for all your help I have passed everything to her. She is writing the SARS request. Is this the same request as you would send to any company or is there a different type for ex employers?
  4. One last think how is she going to force them to give her payslips I can only assume he is up to no good that's why he won't supply them

  6. Hi thanks for the reply her contract does not state any hrs it just states she will work 5 days out of 7. She has a separate letter since leaving that she was contracted to 37.5hrsa week does that matter? Do I know where she stands with the week In lieu
  7. Sorry I hate being the go between but she has cancelled her internet due to funds so said I will help as much as I can. In her letter to her ex employer she as asked for payslips and holiday pay and her week in lieu to be paid. Holiday pay has been paid However her week in lieu they state that she works a week in lieu that means you work a week and get paid the following so no money is owed for that. In regards to the contract not statiing the hours the letter she has does intact say you are employed on a 37.5hr per week contract of which there is 37.5 hrs work provided and your clocking in and out provides me with the amount of hrs worked therefore paid for those hrs.
  8. I have a copy of it in front of me it says hours of work The employee shall work 5 days per week Monday through Sunday then it goes on about working overtime
  9. Ok I have just spoken to her to give her an update so thank you all so far for your help/advice ease keep it coming if you have anymore information. She has also just told me that on going back through her bank statements it would appear that for her 1st 3 months of employment she was being paid £6.51ph rather than the £7ph which it states in her contract.
  10. She did say she had spoken to scad who said she cannot claim unfair dismissal due to the 2 yr ruling but they did say she could go down the tribunal route another way but did not state how.

I suppose another question even though she's not asked me yet Is she entitled to any help in regards to income She is married with young children her husband work full time again he is only on min wage. She was told she could not get jsa due to walking out of her job. Income support from what I can see is a no go due to her husband working full time. She has a mortgage so again I assume no housing benefits will be available nor help with council tax?

Her contract does not state the amount of hrs she is contracted to however since she left letters have been going back and forth and in one of those letters its states full 37.5hrs how ever they have also said she left early of her own accord therefore in breach of her contract. As I said before she is on low income and could not afford to leave early so this is just not the case surly just say she was leaving early without prior consent this would lead to a disciplinary of some sort to of which there is not.. It does also say the employer can deduct money at anytime. She has emailed me a copy of the contract I have noticed that neither party have signed it either which is odd. So if she decides court action it's her word against theirs am I right in thinking that? Obviously this is awful behaviour and how can an employer be allowed to get away with this and not supplying payslips which I thought were a legal documents? Thanks so far
  13. Hi after some advice if possible. Today I have been contact by a family member go is having some issues with an ex employer. The issues became so bad that she decided to walk out of the job after 11 months of employment. She had problem being paid on time in fact around 3/4 of her pay were at least 3 days late with some being nearly 2 weeks. She is yet to receive any pay slips even though a number of letter sent recorded delivery have been sent. It all came to a head when her employer told her all work had been completed so he is closing early this happened on a number of days. She was not informed this would affect her payslip as being on a low wage she could not afford to lose this income. However when it came to being paid she noticed that her wage was less the hours he closed up early she is/ was contracted to full time hrs. She has spoken to cab who could not offer any advice apart from legal action. Any advice would be great

Hiya just after some advice for my brother yesterday he recieved a court date for car payments he as about £3000 outstanding he has called and offered to settle on full by the 15th of june ( im releasing some money to help him) They have refused which i fully understand as he promised to make payments before. the court date is set fo the monday 4thafter june However after looking at the court summons it states they are after reposession of his car they have the right make and model but the reg is wrong his is on an 06 plate and they have filled for an 05 plate the rest of the reg is right apart from this. Im just thinking if he leaves it till the 11th hour and calls both the court and blackhorse and says he does not own a car on an 05 plate woud they then have to file again with the correct details thus giving me the time i need to get the money fo him?? or would it get thrown out because the details are incorrect he then wins and keeps the car? and i save myself 3k lol. thanks
  16. hi still not had my ca through as soon as this happen i will seek legal advice and keep u up to date as i see it i can take action due to stress on me, myalready ill pregnant wife them not following goverment procedures on flexible hours ( when they are others who have family flexible hours in my office who are not carers nor do they have children or the children they have are above 16.

  18. thats what i thought but this is the first time i have heard of a CA. so no idea what to do, as soon as the CA comes i will be heading to a solicitor
  19. still waiting for the CA to come in the post and i have an appointment with legal they will not let me take VR due to on going complaint but if they did it would be the same
  20. ok here goes i'll try not to miss anything.. back in oct 2011 i asked to change my shifts at work in a call centre due to child care issues and my wife being pregnant but struggles to move due to SPD (this is were her hip dislocates from the pelvis making very painful to walk. in a nutshell) i asked my employer to change my shifts as i would struggle to do late shifts as my wife can not carry our 1yr old to bed and i would not get home til 10pm. my request in writing fell on deaf ears and to this day not heard a thing i would also like to add here i have not been on the call centre answering calls for the best part of 12 months due to the it team not being able to fix my login details so i was asked by managment just to come in and sit down for my shift. i was told to come in and get on with my shifts and if not my job would be at risk due to being awol lets just say the situation got the better of me and since mid nov i have been off sick with work related streess and depression for which i am on medication. While off the company annouced they would be making redundancies on a complusory term to which i offered to go as i felt i was being treated like a dog. come in sit down and ignore my requests. i feel i have been bullied. victimized for what i see as a reasonable request. i was called in for a meeting and was told i was not accepted for redundancy as my stats were very good and they cannot accept my request for VR as there is an open complaint due to my shifts. i was then offered a CA i was told i would get what i would be entitled to if i were made redundant however the CA would stop me claiming against my employer for them not following their procedures like my shift request and also the fact they have caused a mental heath problem that i now have to fight for i dont know how long. i am 31 worked for my employer for 5yrs 7months i have been offered around the 5k mark as a pay off but must drop the cases agaist them and also must sign another contract which stops me selling my story as the employer gets plenty of bad press already. is this offer one i should take or ask for more as i have a couple of stong cases against them will having a CA affect my chances of getting jsa or council tax help? thanks

Sorry it been so long but here is an update for you a few months after me sending letters and letter to bct they came back and offered me a good will of £200 which i accepted as trying to prove any further losses to me is near impossiable. How ever on checking my credit file on the 1st sep i noticed that yet again they had applied a default again. spoke to BCT said they would investigate it got a letter back today saying sorry its an IT issue. no form of offer of further compensation just a note that states they gave me £200for full settlement of my complaint. however that was for the 1st time this happened. What to do now?? a manager is calling me back shortly what should i say/do?

Hi all here is the thing i signed up to a 1yr contract back in jan 2011 everything was going fine until april when due to family problems i had to go to look after family members until start of aug i cncelled all my DD as i was on unpaid leave on leaving in such a rush i forgot to ask my gym to either hold or cancel my contract (i put my hands up) i have no problem paying them for the last few months even though i have not used it the issue i have is paying the rest of the year when i am not even allowed to use the bloody place for my exercise it has now been passed to a DCA any idea whay i cn do? i have spoken to the manager she just said deal with the DCA its out of her hands

  24. i have been going through the bank statments for the last 2hrs and still going, he does not have a formal grievance in place. i am right in thinking we also need to contact all other companies and find out how much they charged her for late payments? my wife has complained to him for the last 3 years by speaking to him txt messages and letter and emails
  25. bacs transferred most of the time we are talking 2 weeks late but there are a number of times it 4 weeks late. once or twice she has been paid on the 15th however its usally for half her wage or less.
