  1. ....actually, just checked the envelope and they even managed to send it second class therefore it would never have arrived before the cut off date stated. Strange the way that these people work....there seems to be very little logic in it!
  2. Brilliant, thank you Rory, that's getting fired off today. I think the absolute cheeiest thing with their letter was that they gave me 1 day from the day that it was posted to pay the entire sum.

I have had no contact from Natwest/RBOS/Rockwell at all until today and I am 100% certain that there was no activity on the account since 2001 at the absolute latest, so it is looking good in terms of the law and the 5 year period. Does anyone have any suggestions/experiences in writing to this agency in a professional manner, citing the Limitations Act/statute barred debts?
  4. Hello there! I've received a letter from Rockwell Debt Collection (part of Tessera, have checked another thread) regarding a "debt" on an old Natwest account before they were bought out by RBOS. I remember having an account with them back in 2000/2001 at the absolute latest and am really surprised to receive this letter, particularly after the length of time it has taken them to contact me. They say in the letter that the power of attorney was granted by the bank (Natwest) to the debt collection agency in 2004. Before I contact the agency, I was wondering if anyone had any advise rearding this. I have come across the Limitations Act but I don't think that applies to me as I am living in Scotland. Then I saw the Prescriptions and Limitations Act for Scotland but can't seem to make head nor tail of it apart from that possibly the debt cannot be chased if 6 years has passed from the date of the last transaction through the account. Obviously, I don't know this date and would have to request it from Rockwell, but don't want to go down that route until I have sufficient information re: the law.
