  1. CHEERS MATEY!!! Its been a bit of a slog. 5 l3tters, 4 ignored. LBA - ignored. Chairman Dennis Stephenson summons issued! Started in Feb of this year, they did make an opening offer of just £32 - REJECTED;)
  2. I WON Greetings. Just thought I would share the envelope that "pat" brought today! Original amount charged to account - £171.00p Statutory interest & my "admin"fees - £ 43.01p TOTAL OWED £214.01P My MCOL claim totalled £519.24p This included all my costs, time of research, pen to paper etc. Just about ready to compile the court bundle................... ................ OWARD at d ALIFAX has offered £385.47 as an out of court non liability blah blah blah settlement. ACCEPTED mitch

Incidentally, in my LBA, I offfered to accept a straight £200 Its a no brainer to see who has come out on top. Its cost them nearly double. I dont know how they arrived at £385.47 but it is more than acceptable to me. By the way they did tell me that I must keep my account in order & thatt hey would credit my account blah blah blah - WELL THEY HAVE ACTUALLY CLOSED IT ABOUT 2 YRS AGO !!!!!!!!!!!!!!!!!!!!!!! SO OWARD, A CHEQUE WILL DO NICELY. Power to the people. Next stop, Lloyds TSB house insurance & their refusal to settle a claim. mitch:D :D :D
  4. Yes lets see. Ive also just taken on Lloyds TSB insurance services as they refused a claim for storm damage I made in jan 07 for roof repairs. Ive had to settle up - £385 plus the Vodka & Tonic. Just set the ball rolling with that one. They refused payout as their "computer system" told them the weather wasnt severe enough! However I have had £1500 back from The Woolwich on a mortgage. They charged me £600 in fees plus interest on interest over 6 years. All it took was 3 1st class stamps.

  6. Just called them on 01422 333381, spoke to"claire" in legal services who advised that it will be "customer services" who will be in touch. Told them that I wanted to confirm the address to send my court bundle as I didnt think they would pay out. Claire informed me " well you would be surprised." So we will see
  7. Greetings all, I have a buildings/contents policy with Lloyds. In Jan bad weather blew the TV arial down, damaged roof etc. Works cost £385 plus VAT. I claimed. They refused payout - as they had consulted their "weather reports" & deemed it not severe enough to pay out! Needless to say one can ask the Q "what is the point of insurance" I have called them, they refuse to debate it, I am writing a letter of complaint, will give them 2 weeks to payout otherwise its the County Court for me. I have paid the builders for the repair now. if anyone can advise as to any recourse quoting any relevant legislation SI's or case law that would be great. Thanks
  8. I will try that then after the weekend. My claim was only for £171 plus statutory interest. £214 in total. My claim is for £469 plus court fees so any offer has to be at least £200 plus the costs. I wrote in my LBA that I would accept £200 as a gesture of goodwill so I dont know. Anyways what do i have to loose, just the court fees of £64.

  10. Another update for you all folks. Today I arrived home to find the "Notice of intent to defend" from Oward at D Alifax's legal dept! I have started to think about compiling a court bundle, I instigated the claim online so any pointers will be gladly recieved. I will be including the relavant case law, quoting the unfair consumer contracts SI 1999 to name but one, also the std T & C's attached to the account & my witness statement together with copies of all correspondance, most of which was ignored by Oward. I wrote 4 times in all. Got just 1 response. I take it this is still pretty much "standard proceedure" on the part of Oward n his chums? Of course Im prepared to go all the way as I have nowt to loose as I managed to recoup £1500 worth from The Woolwich for the price of just 3 1st class stamps!

I did name the banks chairman Peter Stephenson as "Defendant!" papers were deleivered to my local branch & as true to form, they waited until the penultimate to acknowledge. Not too sure as to what happens now. They have a further time period right? I do have additional documents which will be included in my court bundle, witness statement & exhibit etc, thats mostly done. Im just unsure as to my next move. I take it, will i recieve info from the Court as to what to do?
  13. Court papers deemed to have been served 25/5. They had until 9/6. They have filed their acknowledgement 6/6 so I now have to sit & wait. Just starting to think about the "court bundle" Any pointers would be greatly appreciated. Original correspondance asked for £171 plus stat int total £214. Offered them £200 in LBA. Went ignored. Filed claim for £469 in total. Claimed through MCOL.

Gave em the option to pay a reduced amount of £200. Ignored. Named the Chairman as Defendant. Couldnt think of anyone better. Sent details to my local branch. Now Im trying to educate myself on a "court bundle" Anyone with advice / a shoulder is welcome to contact me. Local paper is interested. Read the Judgement on the Birmingham case last week. Not put off one bit.

I called the clowns several times, interesting responses, sytem is down, unable to locate file, cant find file, no one here to help blah blah blah. Bounced from dept to dept, left a couple of messages for someone to contact me before NOON last fri, no one did so by 2pm the MCOL was done Today I sent in support of the MCOL, 2 summarys of charges & my costs to be attached to the claim. I am now trying to educate myself as to what a court bundle should be made of. I expect to go all the way to the courts. Local paper is really interested especially as it only cost me 3 stamps to get best part £1500 from The Woolwich for late payment charges+interest ona mortgage I have. Anyways, I would be greatful of any pointers, although I will be reading as much as i can on this website. In addition, any help with the court bundle will be good, I have seen the link on this site. I am claiming just £171 plus statutory interest totalling £214, my costs etc have increased the MCOL to £469. I reduced the amount as a "good will" gesture in my final LBA to £200 but it went ignored. Originally the account was a "cardcash" only account, Halifax "upgraded" me once I had reached the age of 18. Cant recall any T & C's so if any one has any from circa 1987 that would be great.   17. Many thanks. I had the account closed for me by the kind folk at The Halifax Bank! Not worried as it was a secondary account tht wasnt used that much. I had the account since around the age of 15, it started life as a "cardcash" account & the Halifax "converted" it to a current account for me. Im now starting to research as to what the court bundle consists of. The amount due is just over 200quid, not a lot but its the principle of being charged £39 for a failed direct debit! Ive read the judgement details of the recent Birmingham case, I believe i wasnt provided with any "service" but we will see. I have a lot of reading to do!

  19. Good day all, Having just registered I am eager to learn & am currently busy studying all the topics. Main interest is getting my bank charges back. Ive been successful with Woolwich already, 3 letters & hey presto best part £1500 knocked off a mortgage for late payment fees & interest. Now Im trying with halifax bank for the return of just £171 plus interest for bank charges - £30/£39 each time for unpaid direct debit fees. To date (started in Jan 07) I have written 4 times now, they only acknowledged 1st letter & offered just £32. Rejected it, started the court process last friday as their deadline came & went. No i suppose its where the hard work begins. Anyways, have a nice day all
