  1. also if they don't want to refund all the money, just do a chargeback through your card issuer.
  2. Cancel the trip all together and if they try to retain an admin fee take them to small claim court. You have paid for one particular room and they want to flog you a different one. The words "not as described at point of sale" spring to mind. Travel republic matches any deal, so just re-book with them. Don't let them con you!
  3. Bonfire! All evidence up in smoke! No, don't do that, but I would.
  4. I suggest you get all three trustees involved with your younger stepson case. It should be easier to squeeze blood off three bodies rather than one. Well done with your successful court case btw
  5. And it will get worst if boris & co have it their way. No staff outside zone 1, no ticket office and barrier open. Many many people will fail to validate their oyster card by mistake. Best case scenario they will be charged maximum fare when they touch out (£7.90 in peak time). Worst case scenario they get stopped on their way and issued a £80 pfn (reduced to £40 if paid within 21 days, still expensive for one journey imo). And a keen ticket inspector could even bring the case to prosecution. All of this because they want to save money to feed the fat cats. Nice one boris!
  6. I know it's too late, but the kitchen fitter should have spotted all the problems before starting the work, by looking at the plans. Did he look at the plans? Try the ceo as rebel11 suggested and hope for the best. I wouldn't be surprised if in their t&c they wash their hands off regarding the plans. They might claim that it's a free service and if they're not fitting they're not responsible.
  7. 164 yards!?!? They are taking the mickey. Surely the adjudicator will rule in your favour
  8. Or your next door neighbour is stealing your electricity and running a marijuana crop in their house. At least they should give you part of the crop :-P Sorry, just jocking! That sort of usage is extremely high. You shouldn't use more than £100 a month, and that would be a lot.
  9. j) A maximum of 10 additional elements including Extra Minutes, Extra Messages or Bolt Ons can be added to the O2 Airtime Tariffs detailed above. ThetariffsshownaboveincorporateBusinessDataSensefreeofanyadditionalLineRentalCharge.BusinessDataSenseallowsyoutosendupto½Megabyte(MB)or512KBof data usage free each month, thereafter usage is priced at £1.80 (ex VAT) per MB or you may opt to add a Data Service This is the paragraph that conned you. Looks like you have to negotiate a reduction or repayment plan, so probably best to disregard my previous post. Others might find a way out though
  10. There should be a block on data which would prevent anyone from using the internet. They clearly took that block off and now want to polish your wallet. Stand your ground. Send their head office a recorded delivery letter claiming what is owed to you (or to cancel the crazy bills if the credit is in your favour). They will refuse to do so and tell you to complain to a something which is supposed to be an "impartial adjudication service". Don't waste your time with them because they are paid by the communication companies. Take them to county court and after you win send the details to the local press. Of course you will be asking for loss of earnings because tomorrow they will cut your line.
  11. Yes, you must appeal. There's no way someone should walk two blocks to pay for parking. Take pictures or better a video of the spot where you parked and the nearest meter. As far as I know, payment meters should be a maximum of 30 yards from the furthest parking place, but I need to check it out, not 100% sure atm. If you can, upload a copy of the pcn omitting personal details, number plate, barcodes etc.
  12. Ok, you have evidence of the sign being turned against the normal flow of traffic. This is usually enough to win at adjudication stage. Also you have their own evidence, the cctv video, clearly highlighting the poor road markings and conveniently avoiding showing a sign related to the bus lane. Do not insult the council because any correspondence will be produced to the adjudicator. Also the enforcement notice issued before the 28 days is an act of gross procedural impropriety. Make sure you ask for a hearing in person where you will be able to explain everything to the adjudicator. 99% of the time councils don't show up at the hearing and their paperwork is very messy. You should receive a copy of their evidence before the hearing, if you don't even better, a further procedural impropriety. Look out for statements signed by the same person using different job titles. I.E. There will be a witness statement from the cctv operator witnessing the offence as it happened. Also there will be a letter attached to the cctv video you requested signed by a manager of some sort. A lot of councils don't bother getting the signature from different people, so you could find that a Mr X is a cctv operator in one statement and a parking enforcement manager in another. The adjudicators are never impressed by this practice. Finally, as I always advocate, take them to the adjudicator and once you win ask for costs. There are several reasons for having the costs awarded, but my favourite is "the council acted in a vexatious way" by not allowing the appeal in the first place and failing to provide the cctv evidence at the first request (as you said you had to ask a dozen times). If you can, blank out the identifying parts from the original pcn and post it here; there may be many more irregularities.
  13. He did this because he doesn't live there. It's a common tactic to sell a car outside a posh house claiming they live there. As someone suggested, you need to be sure of his name and address, otherwise any ccj will just remain unpaid.
  14. Well, After writing to CEO they sent me a £10 voucher for petrol and trouble and assured me that staff have been retrained. Could a moderator add *Solved* to the title please, I don't seem to be able to edit it. Thanks
  15. When I used to work in retails they had a similar system where you would be on a Level 1 warning if you went sick on two occasions in 13 weeks and Level 2 if on 3 occasions in 26 weeks. It didn't matter if it was a day sickness or a month. However the manager had discretionary power to wave the warning and in most cases of a few days sick rather than weeks they would do so. It's worth exploring your company policy on sickness and find out if your managers have the same power. If so, you will have to convince them that being sick 5 days a year is not over the top at all. Also, because your sickness is due to the cold warehouse, they should help you take steps to avoid getting sick again. I'm sure there are clothing designed to absorb the sweat and keep warm, and they could even provide them as part of your ppe. Worth a little research and mentioning it to them.
  16. She needs to rent the third flat to keep money coming in. Whit that sort of assets she shouldn't be worried about money. I wouldn't get rid of any of the properties. They are her income and if sold the money will just disappear very quickly. Millions of people are struggling to get on the house ladder and she's already on the third step. Why would she go backwards. Hold on to the properties for as long as possible without falling into mortgage arrears and if one day she'll be desperate she can sell one and get a greater equity out of it. After all, whatever people say, property prices will only go up or worst case scenario (unlikely) stay stable. She's in a difficult mental situation now understandably, but selling everything is definitely not the answer IMO. If she can cope financially she should keep the properties.
  17. I suggest that all people conned by kwik fit form an association and march to their head office. Oh no, maybe that's not a good idea, half of the country would take the day off to attend!
  18. If they take you to court (unlikely) just respond to the summon, attend the hearing and explain the situation. Case dismissed.
  19. Sorry to hear such a sad story. If your friend can comfortably make the mortgage payments now, I wouldn't do anything to change the situation. Once she'll be in a better situation to get credit then she could sell one of the properties and take a £50K repayment mortgage on her home. But personally I wouldn't sell a property producing income; after all it pays for itself.
  20. I already suggested it to no avail. The police won't even arrest you if you self report. They will investigate and gain evidence before making an arrest. After all they're not stupid and if you report yourself they would know that you're looking for justice, not punishment.
  21. I would tell them that the police must be informed and all evidence passed to them. Insist on this, so they know that it wasn't you stealing the pc. If they carry on with their attack, report yourself to the police. I've done it once when I was accused by a customer of having racially attacked him and my manager at the time was going to apologise without looking at cctv and give me a final written warning. They decided to carry on with this nonsense and, customer complaint in hand I went to local police station and reported the incident. The desk officer initially didn't want to know, but I asked to see the sergeant and he took a statement from me as well as a copy of the customer complaint. I took the crime reference number to my manager and he went bananas, panicking like a nutter. Within 15 minutes I was called by hr and told that the customer had dropped the complaint. I took it a step further. I contacted this customer employer, a well known bank, and passed them the original complaint sent from work along with the crn. They sacked him for misuse of company facilities, make false allegations using such facilities and bringing company name in disrepute. He came to my shop in tears while he was suspended asking for forgiveness and to withdraw the complaint. I said: "F.You!" After he got sacked he came again and threatened to kill me. He got nicked and charged. You should serve the same treatment to your manager falsely accusing you of a criminal offence.
  22. They will try to take it away for repair. Firmly tell them no! Under soga they must give you a replacement or refund. I had similar dealings with currys and only a letter to head office solved it, so don't bother speaking to the store where you bought it. Also take the serial number down in case they try to flog you the same machine after they fix it. One more thing, even if the machine comes wrapped, check the back panel screws; if there's any sign of them being damaged, reject it. It's quite easy to spot: if the machine has come straight from the factory the screws will look brand new, without any damage to the pozi recess in the head. When these machines are repaired they're opened by hand, thus damaging the screws head. I see more and more repaired appliances sold as new when in fact they've been refurbished. But definitely this is a case of refund/replacement under soga.
  23. I learn a new thing everyday. Might come useful one day. Thanks for advice and I'm sure Mally73 will be more than pleased.
