  1. Just to keep every body posted. I have written to BCT and received a reply dismissing my accusation, to which I replied to this by writing to them again, pointing out my complaint and that they must have misunderstood what I meant. It's now nearly 2 months since I last wrote to BCT, and up to now, I've not received a reply. I also wrote to Carcraft, they replied stating that they couldn't do anything as it’s a Police matter. I have today, contacted the Chief Superintendent at my local Police Force's HQ, to which I have finally received a reply, stating that they are going to look into this. I were in court a couple of weeks ago, the strangest thing happened, no one turned up to represent BCT, so the judge threw it out. It's been suggested to me, that there may be a breach of the Consumer Credit Act, due to the fact that the signatures have been forged in order to get the agreement through. Can anyone offer any advice as to what I should when this comes to the next stage? Thanks in advance, Dean.

  3. I eventually got hold of CID, they told me it was a civil matter, so they couldn't help.
  4. Because the judge has been giving me time to try to get my PPI policy to pay up.
  5. Hi, how long ago did you have the report done, what were the circumstances, and what stage are you at now? I'm in court on the 9th of next month to fight to keep my car.
  6. Tried that but they don't seem very helpful, I have talked to a solicitor, Consumer Direct (who seem to be the most helpful, but not enough to help me out)

Hi, BCT (British Credit Trust) have been trying to get a return of good order against me for my car finance for the past several months, but the Judge has adjourned the case 3 times up to now pending a claim on my PPI policy. Anyway, yesterday whilst making sure all my paperwork was all in order, I discovered that on my original HP agreement and a top up loan, there was only my signature there. On copies of the agreements that BCT had sent to me about a months after I bought my car, they had added their signature to the agreements and when I looked at my signature, there appeared to be something odd about it. It's only by chance that I spotted this irregularity, what a very lucky find it appears to be. I then scanned it into my computer and enlarged it to A4 size, to my amazement the signature is clearly different from how I sign mine, the way some of the letters have been formed look completely different and even more amazingly they had been signed with a different coloured pen. As soon as I've finished here I'm going to telephone the police and report the crime and get some advice from Consumer Direct. I believe that I have good grounds to ask the Judge to dismiss BCT's claim for the return of our car, as the agreement should be voided. :grin:

Thanks, just one more thing that I forgot to mention, on Monday when we got back from court, GE telephoned us to ask how the hearing had gone:eek:, when my partner told him that he would need to speak to their solicitors, he then said he had some advice for us, that was to re-mortgage our house with another company:confused: (quite a strange thing to say). GE have also been ringing us on regular intervals for the past few weeks.

GE trying to repossess our house (sorry for this long post) Last summer I started having pains in my ankle, later diagnosed as Osteoarthritis, I carried on working up to December when it became a bit much for me to handle, I thought a short rest would help, and then I’d be able to return to work. In February this year we made our last mortgage payment due to any savings that we had accumulated having run out. I couldn’t find anything relating to an insurance policy to cover my illness, so I wrote to GE on several occasions requesting some information in relation to a policy and to let them know my situation. The only replies we received to start with were very rude and disrespectful and they actually reduced my partner to tears on several occasions, then in June they finally wrote to me letting me know that I did have a insurance policy but it wasn’t through them and basically we had run out of time and they were in the process of going to court for a repossession order. When we attended the court hearing in August, the Judge listened to both sides and decided to adjourn the hearing until the next available date after 4 weeks in order to allow us time to get the insurance claim processed. The next court summons arrived with the hearing to be held in September and the insurance claim still not sorted, so along we went to present our side of the story, again the Judge adjourned the hearing for the same length of time as last time. Along came the next summons with the hearing date of November and still not had the insurance sorted, this time the Judge told the solicitor acting for GE that his client should step in and find out why the policy sold to us through their representative when the mortgage was taken out, wasn’t doing what it was supposed to do and both parties are to submit a statement to the court within 3 weeks outlining our positions and that the hearing to be adjourned for the same period as the last two, the Judge also mentioned that he had heard Martin Lewis on the radio and the miss-selling of PPI was to be the next big issue for the OFT. Today I received a letter from the insurance company refusing to pay because in the T&C of the policy, it states No Benefit will be payable to you if: · Your disability results from any condition, injury, illness etc which came as a result of a Pre-Existing Condition. Apparently my doctor told them that In October 2002 I had been diagnosed with Osteoarthritis in my fingers and was unable to work because of this and that my ankle pain is related to my fingers/hand. Their chief medical officer believes my current condition to be part of a Polyarthritis, meaning that I were already suffering with the condition prior to the Insurance start date of October 2004. This to my knowledge is untrue:-x, when I went to see my doctor about my hand and then found it was my fingers affecting my hand, they couldn’t make their minds up as to what was the problem, at first they thought it was arthritis, but after a blood test decided it was RSI instead. I also think I were miss-sold the Income Protection Insurance because, 1. I were self employed 2. I Were you sold a ‘single premium’ loan policy 3. The GE representative let us know that the policy was optional, but strongly insisted that I take it out. 4. The mortgage was over 30 years, but the policy expires September 2009 Could someone please let me know what to do now, I’m running out of ideas and only have just over 4 weeks to do something. As far as I’m concerned I haven’t done anything wrong, but GE wants to take our house away regardless:-x:-x:-x.
  10. Vodafone has passed my letters on to Capquest, but everything that I wrote in them letters, seems to have fallen upon deaf ears. I've now got a letter from Capquest's solicitors, stating that if I don't come to an agreement over the outstanding balance, they will proceed with taking me to court and also adding an extra £100 to what I owe. Has anybody got any advice as to what I can do please, as I'm off on long term sick and I'm struggling to make ends meet at the moment? Thanks, Dean.
  11. I've been an NTL customer since 2000 and never really had any problems with them. Now that its Virgin Media, I've never received a correct bill, this happened when I upgraded my package to the VIP level. I've emailed VM several times, but no reply, when telephoning customer services they don't appear to know what they are talking about and get a different excuse every time that I call them. I've been disconnected through non payment of bills more times than I can remember. On a couple of occasions, when I called them to pay the outstanding balance, they said they couldn't reconnect my services, but when I telephoned the next time and spoke to someone else they did it without any problems. This is my letter that I've just posted to them. Dear Sir/Madam, For the past several months I’ve had nothing but trouble with my monthly billing, when I upgraded my services to your VIP package, the monthly price was £85 per month, but since then I haven’t received a correct bill. I emailed your customer services to query this, but after nearly 3 months and having sent you the same email several times and getting further into arrears, my bills were still wrong and then to cap it all off, my services were downgraded (felt like a slap in the face). After a telephone call we were informed that we were being over billed and the problem would be rectified. The problem is still there and when I call customer services, the person that I speak to tells me one thing and then the next one something completely different, it wouldn’t be so bad if we were told something consistent. Another point, we have supposedly been on 10 meg broadband and now 20 meg, but I’ve been to the Terayon website and the modem that we have is only capable of receiving up to 8 meg. When I queried the problem with my broadband speed, I were told to ring the broadband support number, on principle I disagree with having to pay for a call to sort out a problem that’s not of my making. At the end of the day, if my bills were correct from day 1, this situation wouldn’t have arisen. If it's any help for anybody the address that I sent this letter to is. I've finally got my car sorted out, after having to return it to Just Car Clinic for them to correct the things that they either did or didn't do, I had to refuse to accept the repairs another couple of times until I were satisfied due to them still not carrying out the repairs to the standard that anyone would expect and also due to them causing some kind of damage to the bodywork every time they attempted to fix the problems. All in all, I had to get them to repair my car about 5 times until my car was in an acceptable condition that was likewise to before it had been broken into.
  13. I'm having a problem with Vodafone at the moment and could really do with some advice as to what I can do about it. Since April I've been off work through sickness and I'm struggling to make ends meet, I was unable to keep up my monthly charges but I haven't and I'm not unwilling to pay them. I've emailed Vodafone on several occasions to let them know my situation, but I'm not getting anywhere at all. I wrote to Vodafone querying the amount that I owe on my bills and another asking for some help and again letting them know my situation being off work and pointing out that if they had some sort of protection available (quote from my letter "It also looks like, when a customer falls behind with the monthly line rental etc, through no fault of their own (sickness in my case), there seems to be no one willing to help, I enquired to see if the phone insurance covered sickness, but I were informed that it only covers the phone and line rental, if such a cover was in place, this situation that I’m in right now, wouldn’t have happened."), still no reply. I received a letter from Vodafone stating that it still wasn't too late to reconnect my phone and to contact them asap. I then wrote to Vodafone again, this is what I wrote. I received a notice of default today, it also stated that it still wasn’t too late to re-establish full service, which is what I had hoped for, I was hoping that it would be possible to come to some sort of arrangement to clear the arrears off, as I’ve mentioned in earlier emails, I’m currently off work due to sickness and this is the reason that this situation has arisen. I’ll look forward to hearing from you, and with the hope that we can somehow resolve this situation in such a way that both myself and you are happy with. I’ve enclosed copies of the last letter that I sent to you. Still no reply, then I received a letter from their debt collection agency Capquest, so I then wrote to Vodafone again, this is what I wrote this time. Today I received a letter from a debt collection company acting on your behalf, I don’t understand why this has happened, I’ve wrote to you previously, to try and sort out the problem that I have with my account, I was trying to prevent this situation. For whatever reason, you don’t appear to have received my previous letters, so I’ve enclosed copies of the last 2 letters that I sent to you. I finally received a letter from Vodafone, stating that there wasn't anything that they could do, because my account has been closed and they would pass my letters onto Capquest. I believe that it would also be Vodafone's interest to come to an arrangement as there isn't any way what so ever that I can pay them the £400 + what they are asking for, but if an arrangement were in place, then they would get their money, still have a long-time customer (since May 1996) and I wouldn't be paying for the line rental for the duration of my contract without being able to use it. I would prefer to get my mobile account back and come to an arrangement to pay off the arrears and hopefully carry on as usual.
  14. I recently had my car broken into and some damage was caused, they had bent the top of the drivers door to try to get in (thank god for deadlocks). My insurance company arranged for my car to go into Just Car Clinics for the estimate, the repairs were approved, but there were problems, they were too busy to repair my car and eventually telephoned me to ask permission to send my car to another branch for repair, I agreed to this. After just over a month I got my car back, I had a look at it when I picked it up, I thought everything was OK, but when I arrived home I took another look at my car and was horrified to discover quite a few thing wrong. 1. The door hadn't been fitted correctly, leaving a gap along the bodywork. 2. The rear bumper has a small crack at the bottom 3. The airbag warning light is now constantly on. 4. There are several new scratches to the bodywork (its obvious that they are new because rust is just starting to appear. 5 Some of the interior trim hasn't been fitted correctly. 6. A bottle of oil that I keep in a compartment in the boot has been moved to the boot area and has leaked onto the carpet. 7. Theres a small deep scratch to the drivers door window. Over all, I think Just Car Clinics are unprofessional and their quality control inspectors need to have their eyes tested, the quality of the work is extremely substandard and they have no respect for customers belongings.
