  9. *does a little dance* I won! Just like to add my heartfelt thanks to my hubby Stonelaughter for helping me through all of this. Couldn't have done it without him.
  10. I received a letter from Barclays this morning. They still contend that I would lose the case if it should go to court, but taking into account the "small amount" of the claim and the time and money involved in going to court etc, etc. They made me a full and final offer of £1088, which I have accepted. They originally tagged on a confidentiality agreement as a condition of the offer. I faxed an acceptance letter to Keith Jeremiah this afternoon, stating that I did not accept the confidentiality clause. I've just had an email from him - they are prepared to forego that in order to bring a swift end to the case lol. Cheque's in the post lol. Just as well, we were going to court on Monday!
  11. That doesn't alter the fact that the RIGHT to silence has been taken away. You may be well advised to do as suggested and say nothing before speaking to counsel, but the right to silence was removed by the Criminal Justice and Public Order Act of 1994. There was a huge contoversy at the time, but the media focused mainly on how it would curtail the raves popular at the time.   12. Barclays have entered their defence, and I am completing the allocation questionnaire now (it has to be erturned by Weds 2 August). I don't know what to put in the "other information" area. Can someone tell me what I should write here? I've used the template to complete the rest, but this is the bit I need help with and it doesn't tell you what to put in there! *breathe* any help greatly appreciated.
  13. ok, bit of updating needed here. Wrote to TS in Bromley and Nottingham. Bromley came back saying they had no record of a company by that name in Bromley and as I had written to my local TS they would leave it at that. Nottingham came back to me yesterday and I've spoken to them today. They are not, at the moment, going to persue AK about not supplying the information, because as it stands the debt is uneforceable. If they go after AK and get the information supplied, then they can come after the debt again. However, that's not the end of it. I got my credit file from CallCredit last week and found a CCJ on there, which I believe is from AK. I never received any information about this, as it all seems to have gone to an address 2 years out of date. TS have suggested I start proceedings to have that set aside. They are not sure if, once that is done, AK could re-issue their claim. Obviously the debt is unenforcable at the moment, but could they reissue the claim on the basis that it was enforcable at the time fo the original claim - 2002? If they do try and re-issue, then I have to call this guy back at TS and he'll see what he can do then. I'm also still waiting on info from GE Capital to see whether I will have grounds to try and get the default removed from my credit file. If I do, and AK refuse, TS have suggested exploring the issue of AK being fot to hold a credit license. For the record, I was told that TS are not best pleased with the credit reference agencies either, as they are not fussy about the information they put on file - such as people being given "grey" marks for paying off agreements early - a flag to lenders that they won't make as much in interest out of this customer.

Stonelaughter, when's your meeting with the lovely Mr Geoffrey Hoon? Perhaps this should be added to the list of topics for conversation over Earl Grey and Rich Tea biccies.
  15. No, I don't think it is. Are you saying that the school should allow your son (or any child for that matter) to behave in way they want, and if it can be attributed to their difficulties say it's ok? I'm not trying to be difficult, rather trying to show how the school may view it.
  16. I think you need to be careful of making assumptions like this, mainly because it's likely to change the way you approach the meeting with the school and may not do you any favours. "Questioned for an hour" is unlikely to mean someone was actually asking questions for an hour and more likely to mean that your son was asked some questions and then left alone until he was ready to answer them. Without knowing any of the specifics, you seem keen to think the worst of the school, yet from your OP you seem to have been happy with the school until this point. I wonder then why you assume the worst?
  17. Usually your "behaviour" for the last 8 months is stored on your file. I'm not sure you could get that altered at all. Are you saying you've missed payments where the entire balance was made up of unlawful (note - not illegal) charges? It would be an interesting point to persue. If any of the outstanding balance was not due to the charges, then I can't see there would be anything you could do about it, because the CC companies have to report accurately, and if you missed a payment they have to say that.
  18. As a teacher in a school with a number of students with Aspergers, I can confirm that most schools will still expect similar standards of behaviour from these pupils. Your son attends a mainstream school, which I assume is your choice. Although there is help available in schools, very few can supervise a child all the time for the whole day. If your son's behaviour was below the acceptable standard, then exclusion may not be unreasonable. It's hard to say without specfics obviously. Exclusions such as this one usually do come as the result of one incident, so his report stating his good behaviour might stand you in good stead in terms of getting him re-admitted quickly, but not for arguing the exclusion shouldn't hasve happened. As for discrimination, the school is in a tricky situation here. If they have an expected standard of behaviour and usually exclude for this type of incident, then they would be seen by most parents to be being unfair in not excluding your son. I don't really think you can claim discrimination if your child is being treated in the same way as the others at the school.
  19. I have today received my credit file from CallCredit. Interestingly, there is a CCJ on there from 2002. I suspect this is from Aktiv Kapital, although there are no details there to confirm this. The CCJ does not appear on my file with Experian or Equafax. The reason I suspect AK is that in 2002 they told my husband, who was acting on my behalf, that they had obtained a CCJ against me. We received no paperwork at all about this, and when we asked AK to supply any documents at all dealing with it, they were unable to - couldn't locate the paperwork. My credit file today is the first evidence I've seen of this CCJ. Bearing in mind that AK have neglected to comply with my CCA disclosure request, can I get this CCJ removed do you think? There's a default on my Equafax and Experian files from AK, which doesn't appear on CallCredit. Ideally, I'd like to get both the CCJ and the default removed, although this might require GE Capital to comply with their DPA request too ....

  21. did you include the £10 payment? You could write back to them saying thank you for the info they've sent yu, but you're still waiting for [everything you asked for here] and they now have xx days left to comply. You can count their 40 days from the day they received your request and fee.
  22. how long is a piece of string? they have 40 days from the time they received the request and payment.
  23. Just follow the same process. You'll find it in the step-by-step thread in the FAQ. The process is the same in this case, no matter that they caused the charges. Good Luck!
