I have already enquired about getting them off the mortgage, but because on paper I cannot officially afford the total mortgage (even though I am paying it all) I cannot have it totally in my name, which is crazy as I'm paying it already. I think I'm just going to have to bite the bullet and contact a solicitor. Never get involved with families and money!!
  4. The property is in his name also and his wifes name, but they stopped paying their share 2 years ago, I have been paying it ever since, but their names are still on it.
  5. Thanks for all the help, I will try that and see what happens. I'm just worried that if mor CCJs come through the door, there will be so much that it will force the sale of the house. As I said, I think he owes about 30 grand on Credit cards, and thats only the things I know about!!

  7. Myself, my brother and his wife are alll down as the legal owners of the house. If his debts are about 30 grand do you know if they can force the house sale? Even though I have been paying the mortgage on my own for 2 years, and have proof of it?

  11. I am paying all thr mortgage by myself now - the **** has left me to deal with all this. We officially bought the house from mum - her name has nothing to do with the ownership of it anymore. When my dad died my mum could not afford the mortgage so myself and my brother 'bought' the house from her and we were paying the mortgage, which is in my name, my brothers name and my brother's wife's name. My brother and his wife went to the USA 2 years ago and left loads of debt behind, the letters of which are all being sent to my mothers house.   14. Thanks for the support. I am in touch with the consumer council for NI, lovely girl called Alison Laird. She has just contacted me to tell me that the FSO is now going to deal with any bank complaints IMMEDIATELY - rather than the normal 6 month processing time, so I think I will submit a claim to them and see what happens. I am going to ring BOI and tell them this and see if they will offer full amount (not holding breath of course), so anyone else might like to try that themselves and see what happens. You're right - but my Banks solicitor has said that they are hoping the OFT will set a limit of around 20 pounds for bank charges, then they will only be liable to pay me the difference betweeen 20 and the 38 thay have charged me all along. I have pointed out to her that the 12 pound charge applied to credit cards was an upper limit and even then only to be charged in the most exceptional circumstances, but she just brushes me off everytime I mention it. She has also said that they will be factoring in costs for heating, electricity etc when working out how they arrive at their figure of 38
