  1. Hi wanted to give you a bit of a laugh also, I received my statement from the Lender today, funny as it is signed : For and on the behalf of the London Mortgage Company Ltd. Uhmm some needs to tell them that the London Mortgage Company Ltd was actually dissolved at company's house on the 12th January 2011. I have told them this now twice and in a letter on the 30th August they told yes it had been dissolved I was correct. Why do they keep sending me letters signed this. Southern Pacific Mortgage Ltd t/as London Mortgage Company in companies house, registered address 10-18 Union Street, London, SE1 1SZ, the company address of the liquidators for Lehman Brothers, Price Waterhouse & Cooper. It has 1 director Lee Brandon and has 2 mortgages to it's name. (19 in total, 17 Satisfied, 2 remaining)
  2. Good Evening All, Thought I would drop a note to say I now have my court date and information from the Court. Defense filed and served. Interestingly enough the lender has sent me a letter saying it's date is for repossession of my home again, nothing about the Property Chamber or what I served as my defense. The Court say it was a ruling to file and serve the claimants a fully pleaded defense Claim ajourned for Directions The defendant shall at the hearing produce evidence/correspondance relating to the timescales of the First Tier Tribunal as per my appplication dated 24/09/2013. I served both my papers on the lender as instructed but not signed for so today before 5pm I faxed them to the legal department of PW&C who said they would send to the 1 director left of the company, they only use PW&C as a registered address. IS IT ME hi I will need your services
  3. Good morning, I am now back in the land of the living after being away with work. I have a quick question this morning please and ask for your guidance. I have all my papers now ready to go, been hanging on for the deed copy fromHMLR which hasn't yet appeared. I have an official copy that I've had for 2 years it says it s an official copy and has a HMLR stamp on it, I think I may of got this via the lender a few years ago when I asked for t's & C's anyway but obviously photocopied from land registry. I also have all the information and papers to serve via the property chamber so do I add as a point into the prepared defence at the bottom and mark as exhibit D or just take these separately on Monday morning to the court to be stamped when I hand deliver. I will next day deliver to the lenders solicitors. Funny but if I send the chamber stuff as directed by the chamber this is not to the mortgage administrator or their solicitors addresses, 1 is the address on the mortgage deed copy the other the official registered office of PW&C London. After the hearing on the 2nd October I haven't had a letter back from anyone not even the court with the judges directions on, which I thought I should of have instructing me what I had to do as the outcome of his finding that day and filing my defence etc....   4. Quick question here my lender had sold the mortgage on and outsourced both mortgage administration and it's solicitors to third parties. The court directed me to file a defence so do I also send full copy and tribunal application and the info tribunal sent me also to the solicitors who attended court in he repo hearing?
  5. Good afternoon, I am now in receipt of my property chamber acknowledgement. I have been sent copies to serve on SPML @ registered offices @PWC and their old address to whom it may concern address on my deeds, all typed up for me. We have a date to do so and date for them to respond if unhappy. They tell me they have received a lot of these and also are being circulated on the internet so to save time and money and they have identified a number of cases for consideration. I have been sent an extract of the rules first tier and property chamber rules 2013 which are more common for ratification or setting aside certain documents and rules 108(2) and land registration act 2002. I have also been sent a short user guide for the property chamber and it clearly states notice of proceedings which outlines if any party starts court proceedings so I need to be clear what To send to them as they want to know about my ongoing case? As yet I have received nothing from the county court Thanks
  6. As far we were aware no one injured and all settled via company insurance over 2 years ago. I no longer work for the company that held the insurance on the company car and since the day of the accident have never spoken to or any correspondence with the claimant.
  7. Help please. 2 years ago a member of my family was driving my company car and had an accident. They ran into the back of vehicle going through some traffic lights . Obviously we informed my company straight away and the claim was supposed of been sorted out via the insurance of my company .my company never came back to me and I worked for the, for 12 months more till 2012. Today we have received through the post a County Court Claim. The driver the claimant and through Judge & Priestley Solicitors is claiming £479.60 The claim says The Claimant claims damages due to the defendants negligent driving. Failed to take avoiding action, steering, swerving or otherwise, so as to avoid the said collision. The defendant collided with the rear of the Claimants vehicle causing damage . AND THE CLAIMANT CLAIMS 1. The sum of 2 Statutory interest pursuant to Section 69 of the County Courts Act 1984 rate at 8% from 8/9/11 to 2/10/13 It says Credit hire 342.86 This is the first we have ever heard of this claim or anything we had nothing, no correspondence or phone calls with them, not even after the accident, we naturally thought and of course it was settled via the company's insurance and its 2 years later now? Do I file a defence and if so what do I say. My family member is really upset about this and I am really mad. Thank you.

  9. Good afternoon Just spoken with the property chamber as instructed y the Judge, they have told me to tell the Court that this can take as long as a court case, days, weeks or months. I also look at my mortgage deed that SPML sent me and it actually says Land Registry Official Copy, this copy may not be same size as original.

No problem I have an account with the land registry, I will order both, I have an official land registry register date last December I did because I sent them a letter to ask if SPML had tried to register anyone else. The reply was no but they also said they didn't have to inform me either if they did apply. I though this strange as I believed I would have to sign something else.
  11. Yes please I would like HI IT'S ME to come along with me, On my deed I have a copy which is the copy I have always had, a copy submitted to the court last year. It has my signature on, my witness and the stamp by the solicitor with date on. No term or anything else. At the LR Office it's the same deed they have told me. SPML have point under title absolute that is a restriction saying I can't register any other charges. In the charges party they have Proprietor as name Southern Pacific Mortgage ltd This is interesting as at the time I had a secured loan with welcome finance but the registry says an equitable charge in favour of progressive financial services but this company actually went in to liquidation on the 13/03/13 so I have an application to send to remove this charge not sent yet. Thank you
  12. That sentence made no sentence sorry,, he said they may not grant a possession on that now separate issue it may be suspended at that hearing.
  13. Hi Apple Thank you. No to the date. Just the time to file the defence. The only thing that he wasn't pleased with was my letter as he said it was not laid out as a defence. He wouldn't advise me on anything he said. Only thing that really gave me hope was when he actually said that on the repossession next time the solicitor my Sk for one Nd they mY grant a suspended one as the solicitor kept asking for him to make an interim order on our payments till then. Yes he said the above . Thank you again , you have given me hope and I also think a lot of other people.
  14. Hi p.j. They were try for a repossession order today. This was stopped pending the deed issue and my submission/defence to be done within 14days. My deed yes stamped by my solicitor and signed by me and my witness, not in the presence of the solicitor just sent back by post. The solicitor acted for both parties it was part of the deal the broker did, so deed sent back with mortgage offer, I don't actually remember signing a lot so I may ask for a copy of the agreement it just refers to the terms and condition booklet and my son then 17 had to sign something also. I have a copy of the mortgage offer also .
  15. Hi Apple, Firstly thank you and I am happy to be stuck with you and IS IT ME. The Judge didn't introduce himself and to be honest I was so nervous I never looked at the list of who he was. He said he had never heard of the Property Chamber and told me I needed to speak to them to see how long this will take them as he was not going to let this meander Long. Hence 14 days for defence. The solicitor wanted him to read Paragon V Pender and pulled out the paragraphs he had highlighted. The Judge said no talk of arrears as this was now a separate issue and he would not make a summary decision in 10 minute hearing after I had bought this to light and he hadn't read it before hand. The possession was to be sort after if my claims were a red herring and not founded. Because their solicitor kept pressing He actually said that if the mortgage was indeed void and unenforceable then it would open up a lot of other things. Their solicitor was adamant that SPML had the right to be on my deeds and he tried to talk around securitisation which the Judge did understand about, so really the only point I raised was why had the new note holder or people that had my debt had not registered this,as an interested party, the solicitor said they didn't need to and so I told the judge perhaps it might be also as they weren't regulated by the FCA and if done would also need to give me new terms and conditions which they couldn't do. The Judge said he wouldn't rule today on something that may come back and make him look foolish. Thank you so so so much.
  16. Just to let you know on the deed the solicitor told the Judge because I had signed it, witnessed and my solicitor had stamped that was all they needed. Plus I spoke with LR and they told me exactly the same. They said by law it wasnt up to my lender the onus was on me as a borrower. The Solicitor kept trying to get me to admit my debt and repeatedly told the Judge I had said I took a mortgage with SPML.
  17. Dear All, I have just had the worst 1 hour my life @ Court. I lodged the court papers last week as per the help of Apple but they werent on file them to hand they hadnt been filed and in fact he hadn't even received the letter from the claimants solicitors. The Solicitor for them tried to badger him into making a summary decision against us and repossenion order and thankfully he did not. The Solicitor kept arguing that if the Judge looked at Paragon vs someoon the legal deed issue he would see it's a nonsense and I have no grounds, the judge remarked we would see if it was a red herring and flawed argument. The Judge hadn't heard of Property Chamber at all. When I gave a copy of what I had filed th Judge said this was not a properly executed defence and I should of got a solicitor.So help help help help. I have been order to file a defence within 14 days on my grounds as per my application. I have been ordered to get in touch with the property chamber to see how long they will take to make a decision. The judge wouldn't discuss my arrears as this is now a separate issue but he also wouldn't give them a respossession order either. The costs were as to be confirmed not sure on that. So I need a solicitor eho can help me. Any suggestions .thank you so much
  18. Thanks Apple. We will see what happens @ 3.55 on Wednesday and what the Judge decides. Although if he goes down the route of the arrears and the information I received this morning from Lightfoots or Acenden which ever did this it's clear they can only base the information from May 15th 2010 as this is when Acenden took over as Mortgage Adminstrators. Well my £6458.00 was inadvertenly added in 2007/2008 when they added this amount and it's incorrect and I have disputed ever since. I also noted that on my account I have shortfall charges funny this year £808.00 before I even pay a penny of my agreed monthly repayments so arrears before I even make a payment as shortfall. I have now also found 2 letters both stating my mortgage has been pooled with other mortgages and the interested party is Eurosail-2007-6NC-UK PLC. They also keep signing my letters from Acenden on the behalf of London Mortgage Company Ltd. This company in High Wycombe was actually dissolved at companies house on 25/01/2011. They have even admitted that it is dissolved in my letter. Thanks again

I have my receipted letter from the property chamber saying they will contact me further when they need to and have noted my application. I have now got my official copy of the land registry, I note in B : Proprietorship Register Title Absolute 1. Proprietor is me 2. The price stated and paid in 2003 3. 23.07.2007 RESTRICTION: No dispostion of the registered estate by the proprietor of the registered estate is to be registered without a written consent signed by the proprietor for the time being of the charge dated 27 June 2007 in favour of Southern Pacific Mortgage Limited to the charges register. What does that mean?? Charges Register Note 4 (23.07.2007) Regisitered charges dated 25 June 2007 note 5 (23.07.2007) Proprietor : Southern Pacific Mortgage Limited (co. Reg. No 3266119) 1st floor , 6 Broadgate, London EC2M 2QS, trading as London Mortgage Company Can you clarify what this actually means to me. Thanks

I will tell him the truth, yes i mortgaged my house with London Mortgage Company but never knew they would sell mt mortgage 6 months later and then have to wait 6 years for them to tell me they had. I will also tell him i am happy to pay the company i now owe my debt to, but not SPML IR ACENDEN as they are ripping me off 6000 charges in 6 yeats mkbeyvtp pay
