  1. Hi - still nothing in the post today or by fax. What should be my next move? Any help would be much appreciated. Should I apply for the stay to be lifted or perhaps write to the Judge asking how they can ask for a stay AFTER the date has passed? Thanks guys!

  4. Hi - thanks for replying. I am currently in Australia so had my solicitor ready to represent me at Trowbridge. I called SC&M two days before as I had heard nothing; some pimply youth (sounded like!) told me that they had applied for a stay; being overseas I expected it to take a while to get to me. I then called the Court to be told that the judge hearing the case was on holiday returning the day of the case but in any case all the Lloyds cases had been put on hold. To date I have still not received ANYTHING to this effect in writing from the Court (despite redirections of mail etc) Does this help? I luckily have not had to pay my solicitor as she is very keen to help and dismissed the charges when I told her what had happened!
  5. Oh how tedious this is becoming! I h ad three claims in; the first two were settled relatively 'straightforwardly' (after about 6 months persistence). I received a letter from SC&M saying that they wanted to settle the third, could I answer some questions which I did. Then I heard nothing, until this morning (18th September). My court case was on 31st August; nothing happened. The Court said that a stay had been applied for but I had no knowledge of this. The SC&M letter this morning indicated that they were NOW asking for a stay (dated 12th September) and did I mind?!!? Huh???? Do I mind??? Of course I mind, but more importantly I fail to understand how they can do this AFTER the Court case was supposed to have been heard? I have sent both the court and SC&M a fax this morning saying that I will apply for the stay to be removed, however I have had NOTHING in writing from the Court. What DO I do now? Followed all advice to date and its worked! Ozgirl
  6. Any clues anybody?!!? I received a letter on 14th June (I originally had three claims into Lloyds, two of which were settled after about 6 months or so), asking for further information about the third claim. I immediately responded and have heard nothing back. My court date is 31st August. Having heard NOTHING back from SC&M I called them today and they said that they had applied for a stay and they were waiting to hear if the judge would allow it. I called the court and the Judge is on holiday?!!? What should my next move be? Shouldn't they have sent me their bundle within 14 days (17th August). If anybody has any clues I'd be happy to hear them? Thanks loads
  7. Hi -I have a court date of 31st August at Trowbridge which is on the small claims track and will take no longer than 10 minutes. I had received a letter from Sechiari Clark & Mitchell indicating that they wishes to settle on 14 June but nothing since? Am submitting bundle today. Lloyds have already refunded two previous claims for me totalling £8k.
  8. Hi I started this in January by asking for the bank statements, then wrote the first letter once I had done my calculations in February. It has taken WAY longer than I had anticipated. I am guessing that the bank are inundated with claims and for this reason they are having a tough time keeping up with the administration of it all. I was also passed around the houses by the solicitors and ended up responding to two different Lloyds solicitors (I had put in more than one claim). I had court dates for the end of August. Good Luck!
  9. :lol: :lol: They are settling all THREE claims which equates to around £11k!!! All interest paid, all charges back! I cannot begin to describe the utter sense of relief. They have however told me that all my accounts will be closed within 14 days. Hey ho - I had opened another account just in case. Will now only spend what I have and will NEVER go down the whole debt thing again. I feel liberated!!!! :grin: :grin:
  10. Bugger! I know that I only have weeks few left in the country but didn't need this hassle..... Has anybody else had this happen to them? Any advice - I also have a loan with them???
  11. Hi I have my court date at Trowbridge on 31st August and whilst I can put together the bundles (with the help of your site - many thanks!), I am actally emigrating in early July. Therefore I cannot possibly attend the court. ShouldI send everthing to all parties now and explain my position? I feel that if I do this then I am leaving myself wide open to them winning as I canot put in a defence. (I did state on the AQ that I ould be out of the country after the end of June?) I have court dates for 2 out of 3 of my claim. The other one they have settled aready? Any help much appreciated! Thanks Ozgirl
  12. Got back the whole claim for £2967! However, still have two outstanding claims which have been sent to other solicitors? Has this happened to anybody else? I don't know whether or not this is a good thing. Why not give them all to one solicitor? I actually emigrate at the end of the month and need to get this sorted -they still 'owe' me £7k which need to repay debt (incurred by bank charges - funny old thing!) Any help/advice much appreciated!
  13. Now I am really confused! I put in three different claims under £5k. Two of them have moved to a court near to me. The other one has remained in Northampton (miles away from here!) I heard from Lloyds solicitors and received Allocation Questionnaires for the two claims that moved nearer to me. I sent these back to the court yeserday and to the defence solicitors. Then received an email from them saying that they were only representing Lloyds on the one that remains at Northampton? I am supposed to send my AQ to the defence solicitor, but if hey are not it then who do I send it to? Are they putting in a defence at all? Am writing to bank, copying it to the court (both Northampton and Trowbridge) their solicitors and my solicitors. Don't know what else I can do? Any suggestions
  14. Thanks - I originally filed three different claims as each one would have taken the other over the £5k threshold for small claims. They have responded to two but not the other one; I am just going though all the paperwork to ensure that this is correct then I believe that I can ask them to pay up for not submitting a defence?
