  1. I have been unemployed for sometime now as I am Disabled. I reduced my payments to provident to a token payment. The Agent stopped calling as she said it was not worthwhile for her to pick up my token payment. So I arranged to send my agreed monthly token payment to my local branch, I have been doing this for over 2 year now. But over the last 6 month I have received letters from provident telling me I have missed payments on my account, These letters were signed by my local office but when I contacted my local office they said the letters are sent out automatically from head office. As I keep getting these letters I asked my local office to send out a statement of account as the letters were informing me I had missed payments. My local office did not reply so I rang them. I asked if they had received my letter, They said yes, I then asked if they were going to send out a statement of account as my payments were being called into question with there letters. They said no and told me to contact head office I rang head office to complain. I received a letter stating that I am paying much less than the original agreement. And so they are legally obliged to send out such letters every month. I said the letters insinuate that I am not making the token payments. Of which I have never missed. They said they would keep sending out the letters even though I have an agreemnet to make token payments. This just smells like harrasment to me, I wonder If anyone could suggest a letter I could send in regards to this thankyou.

  3. Hi I was just looking at the post Why is CAG running scared of pre-court CCA enforceability arguments? I have just received the following from moorcroft - shop direct after my cca request. I have claimed back all charges etc, But as clearly stated in FORM 1000 JPEG They have admitted they do not have an agreement for this account. There is no date names or any sigs in the forms they have sent.   5. 1K Funny how they say on the 27th july not going to persue this debt then on 28th send me reconstructed cca they havent even spelt my first name correctly.
  6. I am prepared to fight this in court if need be, and ready to inform them that I need confirmation as to whether they have an actual Agreement or not under CPUTR 2008 But would be gratefull for tips on a reply thanks.
  7. 2006 and no not signed a cca thats why they have not found one as letter 1 shows.
  8. As I said in my post I did not send a cca request With £1 I just asked, And no even if They repaid the charges the debt would still not be cleared I just Need advice on how to respond after receiving these conflicting replies thankyou.
  9. HI All I have a debt with shop direct litwoods. I have been paying a token payment for the last 2 year directly to litwoods ilness support team. But having received letters every month from NDR teling me I had either paid insuficient payment or late payment I was charged £12 a month. I therefore stopped paying the token payment and told shop direct to take me to court. As at least then There would not be any further charges. However they just kept charging the £12 untill finally assigned the debt to lowell. I then asked lowell for a statement of all charges and expected lowell to deduct these charges. But lowell just ignored this I therefore asked for a copy of my signed credit agreement. But did not send £1 I just asked for it.   10. Hi To cut a long story short I have gone overdrawn today by £16 on my yorkshire bank ready cash account. I have my dla paid into this account to pay my direct debts. I tried to get down today to pay in some cash but the weather was very bad so I was not able to I will be putting in the money on monday morning. My question is how much will they charge me for going overdrawn. Also is it worth pleading my case as a transaction I made on the 15th was not taken untill today the 17th. But i had thought this money had already been taken hence the short fall. I have my direct debits to pay this month and have enough money to pay these but if they charge me then I wont be able to meet my direct debits. Sorry for ranting on but I am very worried now. Thankyou for any help you can suggest.
  11. Then it must be absolute as the Lowell letter also comes with a letter from shop direct saying they have assigned the debt to lowell.Thanks again for your reply.

  13. I am not sure what the difference is and there is no mention in the letter, As to if it is equitable or absolute.
  14. Yes a shop direct letter was enclosed saying the account was legally assigned to Lowell.
  15. Hello I have an account with shop direct. I am now disabled and unable to make the required payments. So through the so called illness support team I was paying shop direct a monthly token payment, But every month I received a leter from NDR teeling me I had either paid my token payment too late or Insuficient funds,And I was charged a £12 Fee every month. I queried these charges with ilness support they removed the charge on some occasions, But the next month there was another charge of £12, I therefore took a stand and wrote to tell them I was not going to make any more payments. I have received a letter of Lowell today asking for the full amount or a offer of payment. And a letter of assignment. I am willimg to make a token payment once again but I need to know how much charges have been added. Can anyone suggest a suitable letter to send Lowell thankyou.
  16. I Started the £2 a month on september last year, There are charges for late payments but not sure how much. I have not been very well of late to question the charges, Thanks for your reply. They also do know my finacial situation, I have never missed a payment sice lewis took over this,

I have just received a letter from lewis debt recovey telling me they will no longer accept my offer of £2 per month, And they have asked me to fill in an evidence of means form, I am disabled and in receipt of benefit. I cannot afford to pay more than the £2 per month. They have requested I ring them if i cant afford to increse my payments but I dont intend to ring them. Can anyone sugget a reply in answer to there letter which is headed, Evidence of means Required to prevent court proceedings being instigated against you. The original debt was with studio catalogue they have yet to supply a signed cca agreement, But I have been informed they do not need an agrement with my signature on it. Thanks.

  21. I cca empire stores jan 2009 and after 2 months of letter tennis, With the usual threats lies and phone calls. It came to light that they did not have a signed agrement, I received a letter in march 2009 confirming that they will not be pursuing the account for the outstanding balance, Signed by Mark Warburton admin support team. But today out of the blue i have received a default notice on this account, And a letter telling me if i dont take action by a certain date, then court action may be started. and to contact them with a payment offer. can anyone suggest a suitable reply to this thanks.

Thanks for all your input I did apply online I have not signed and returned the form they sent me when I opened the account, Williams have not provided a screenshot of an online application showing the electronic 'tick box'. I am still confused as to the enforceability of what they have sent, I have been charged default fees how do I get them removed vjohn82 ? Also there is not a date on this form as to when the credit agreement was taken out.
