  1. Hi Seancarp Yes i agree with mimi this is all about dragging their feet and trying to look scarey:mad: But dont let it work! Im at around the same stage as you i received a&l's defence on 6th june and from reading yours mine is exactly the same, but as ive already sent two copies to both the court, A&L and to Wragge and co i can not see why i need to send them again.But if you havent then send them a copy again (u may as well). I was told by some very helpful people here just to sit back and wait as thats the game at the min! However i would suggest read about the court bundle just to start getting your head around it just in case, theres a link for it on the main page Sorry i know this isnt much help but keep reading threads and u will find the answers;) Good luck Nicky:lol:
  2. Hi im at roughly the same stage as yourself, i received defence papers from wragge and co on 6th june and have heard nothing since. From what ive read some people also receive a copy of A&L's defence from the court too! Did you get a letter to say your claim had been transfered to your local court? Good luck anyway Nicky:lol:
  3. Hi everyone this was sent to me and thought it was really good!! sorry its long!! A 98 year old woman wrote this to her bank. The bank manager thought it amusing enough to have it published in The Times. Dear Sir I am writing to thank you for bouncing my cheque with which I endeavoured to pay my plumber last month. By my calculations, three nanoseconds must have elapsed between his presenting the cheque and the arrival in my account of the funds needed to honour it. I refer, of course, to the automatic monthly deposit of my Pension, an arrangement which, I admit, has been in place for only 38 years. You are to be commended for seizing that brief window of opportunity, and also for debiting my account £30 by way of penalty for the inconvenience caused to your bank. My thankfulness springs from the manner in which this incident has caused me to rethink my errant financial ways. I noticed that whereas I personally attend to your telephone calls and letters, when I try to contact you, I am confronted by the impersonal, overcharging, pre-recorded, faceless entity which your bank has become. >From now on, I, like you, choose only to deal with a flesh-and-blood person. My mortgage and loan payments will therefore and hereafter no longer be automatic, but will arrive at your bank by cheque, addressed personally and confidentially to an employee at your bank whom you must nominate. Be aware that it is an offence under the Postal Act for any other person to open such an envelope. Please find attached an Application Contact Status which I require your chosen employee to complete. I am sorry it runs to eight pages, but in order that I know as much about him or her as your bank knows about me, there is no alternative. Regrettably, but again following your example, I must also levy an establishment fee to cover the setting up of this new arrangement.   5. Morning everyone!! Well had nothing in the post for days now and its driving me insane:p Should i ring mcol and find out about the court it has been tranfered to or just sit back and wait? Seems to be taking along time now and i know im just getting inpatient but i can see a light at the ebd of the tunnel and just want to get there!! Reading some of the other threads always puts a smile on my face:D and keeps me going Nicky x
  6. Hi deb Look dont panic their are plenty of people on here who will give u brill advice just give them time honest!! Are u recieving any benefits such as working tax or child tax credits?? If u are then call the court and c if u are exempt from paying, not sure if u will be but its worth a try cus im a student too and it was nt til after i d paid out the court fee s that i read a thread saying that people receiving benefits even tax credits do not have to pay!!   7. Thanks Jen! Just read on a thread some where that i should get a copy of defence from the court too, is that right? Also what sort of time scale am i looking at now just so i can keep an eye on things! Should i recieve an AQ before or after court date is given? Its getting really complicated now trying to keep track of all the dead lines and i dont want to miss any as ive read that this can mess things up. Thanks for every ones support and advice could not of got this far without it

HI All quick update, just got in to find two letters waiting for me One. a Notice that acknowledgement of service has been filed from the court dated 05/06/07 (which i thought i already had, but that was from the sols and dated 01/06/07) Two. a five papered defence from wragge and co, i have read through it and it all appears jibberish to me. Two days ago i did send wragge and co a copy of the charges which im hoping was the right thing to do, Just not sure what to do now really???? According to my mcol it can go no further with them so do i just wait to hear from a court??? Should i start to get together a court bundle??? Ive kept copies of all the letters i have sent a&l and also all the letters they have sent me, but bit worried as ive read through most of the court bundles people have sent and NONE of it makes sense to me! REALLY NEED ADVICE NOW PLEASE...................................

Morning All Just wondering about time scales as im getting abit confused (which is easily done) My claim was deemed served on the 29th may and i recieved a letter from wragge and co on 1st june with acknowledgement of service and notice of intention to defend. Does this mean they have 28 days from the 1st june or 14 days? Also ive not recieved any defence papers yet is that fairly normal??
  10. Afternoon all Well ive done it, ive sent the cheque back with my thanks but stick it letter!! I was almost sick but then i thought NO ! why should i allow them to keep it when its mine and i cannot imagine them letting me off by half the amount if it was the other way round! Was expecting the defence to be on the door mat this morning but nothing yet. Plus im feeling lucky today picked up my exam results and ive passed thank god!!!! Lets just wait and see what happens now
  11. OH Jen i am pleased to hear you!! I used one of the template rejections letter but just altered it slightly, is that ok?? Well at least the offers are getting bigger I was wondering this court bundle business ive looked through them through a link on a thread i found, do we really need to know all of that stuff and will i be questioned on it or is it just to show them we mean business?? I have read the information given through the link above and i know this is going to sound really daft but do we really need to know all that stuff, are we going to be questioned about it or is it just to show the bank that we know our stuff??? Dear sirs Thank you for your letter dated 30/05/07. I respectfully decline your offer of Full and Final settlement and have included the cheque you supplied in respect of that offer. You may not have been aware that I commenced legal action against you for the amount of £5000.00 plus court costs of so far £120.00 on 29/05/07 and I would ask that you now refer this matter to your legal department for further instruction. I would like to bring to your attention that at this point I have not included the interest on the amount owed which if you check your records, as I have sent you a copy you will see that if this was to be included the amount would be almost £6500.00 without court costs. I did hope this would encourage a swift conclusion to this matter. I trust this clarifies my position. Yours faithfully

Well just to update you, i was expecting A&L's defence through the post this morning but instead i recieved a letter from them containing all the normal blah blah and a cheque for .......wait for it... £2563.50 which although feels good in my hands is infact only half of what those nasty people took from me. It is a vast improvement on the last offer which was just over £50.00 so at least its getting there! The cheque WILL be returned with a letter stating thanks but no thanks unless this is a down payment (dout it) Now feeling really nervous should i just cut my loses and accept it? am i being greedy? I have until tommorrow morning to decide :o

Im going to send wragge and co a copy of my charges but just wondered, when ive done them before ive just put amount and date but not what they were for, Should i re do them and include what they were for? Also although they actually owe me £5531.00 before interest i am only asking for £5000.00 plus court costs will this make a difference? Thanks N

  18. HELLO**** REALLY NEED HELP TO KNOW IF I HAVE TO GET A COURT BUNDLE READY OR NOT AND IF I DO WHAT THE HELL IT IS AND WHERE DO I GET IT FROM???????? ALSO JUST READ ON A THREAD THAT THERE IS A PROBLEM, IF THE MCOL IS IN ONLY ONE NAME BUT THE ACCOUNT IS IN JOINT NAME, ANY ONE HAVE ANY IDEAS ON THIS?

  25. Sorry i am being a real pain here just feeling a bit nervousnow never thought it would go this far! The acknowledgement of service was dated 1st June so does that mean they have 28 days to get together fence? and if so does that mean i hane to as well? and if so what the hell to i get together just copies of charges and letters sent? oh my god !!!!!!
