  1. Ok thanks for this. Do you know how to reclaim the interest at all? Im sure Ive paid it but Im not sure how to work it out? Is there an easy way?
  2. Hi, A & L made me an offer but it’s not the full amount in fact is not even half. They are trying to use the OFT's indication that £12 in relation to credit card charges is not an unreasonable offer - I disagree. On closer examination it seems that the BBC's 'The true cost of bouncing a cheque' item that the consumer action group have highlighted states that "based on the system the banking employee used, they worked out that the administration of bouncing a cheque was definitely no more than £2," I remember a while back that there was another more high ended study by someone else that came up with similar figures or perhaps a bit more around the £4 mark? Does anyone have any information on that study? Also, I need some help in writing the letter back to the Alliance & leister to decline their offer but giving them the opportunity to pay me £5000 instead. (They owe me £5799.50 excluding interest) This figure would degate the need for me to raise a small claims action against them which only goes up to £5000. My understanding is that raising an action against the bank for more than £5000 is best left to the professional lawyers? Although I have no indication of what the interest charges are that I have paid them or how to work them out or even request that the bank themselves make them available to me? Ive looked through the forum and templates section for help but I can’t find any templates that relate to declining a banks offer if it’s not the full amount anywhere - can anyone point me in the right direction please? Many Thanks.

  4. I spoke to as guy from the financial ombudsman today and related the story so far with the Alliance & Leicster closing my account as a result of my being £86 over the agreed overdraft limit, his initial thoughts were that he thought it would be something that they would take up on my behalf and that he would send out the paperwork for it to arrive at mine tomorrow. I asked him about whether or not the bank closing the account would have an effect on my reclaiming the bank charges that they owed me and he said that because I had been a customer, that they still had an obligation to answer my request whether or not they closed the account. I’ll keep you posted.
  5. Thanks - What a joke, I’ll be contacting the ombudsman tomorrow morning about it and will see what can be done, they owe me thousands, I wished Id seen this coming from them and I wouldn’t have given them the chance to close it. What a nightmare… the issue is highlighted even more when you understand that the account has been over the agreed overdraft limit by hundreds before and they never took action then? They’re taking it now because they know how much they owe me and there trying to cut their losses.
  6. I started the refund my bank charges process on the 19th April which gives them until the 27th May to send through my statements. My issue is that they had sent me a default notice on the 9th April because my overdraft was over the agreed limit by £68. My salary went in on the 30th April clearing the overdraft completely, however as the overdraft has approach its limit again this month, they have sent me a notice saying that because my overdraft is ‘still’ overdrawn that they have decided to close the account and that I should make arrangements to pay them the overdraft completely as soon as possible. I’m really annoyed with them because the overdraft when they sent me the default notice on the 9th was cleared on the 30th, but because it has strayed into the red again this month, they have sent notice to close the account based on the original default notice? Does anyone know if they can do that or should they have served a new default notice based on the overdraft having been repaid now being overdrawn again? Does this mean I can’t pursue them for the bank charges now? Is this the real reason why they have closed the account? Can anyone help? Thanks.
