  1. Hi Tom I dont have the relevant account number anymore, i had a receipt for payment but have no idea where i have placed it. I emailed the council to see if they still have the reference number for the account. Yes it is just the one! I was thinking SAR and wording it for all accounts you have dealt with and using the vehicle registration, due to me not having the specific account number. They would still have a record on system wouldnt they with it been 2010? Thanks
  2. Thanks for that I was thinking along the SAR route as it is an account that was settled at the time. As i have become more aware of their practices i believe there are alot of charges that should not have been added and i want them back. I will try the letter first, failing that will send a SAR. Thanks
  3. Hi Would a SAR to a bailiff company produce the paperwork regarding accounts they have collected on Ie Statements of accounts and charges added etc? Thanks
  4. If the Council does not take any action against the bailiff company or suggests they are doing nothing wrong fire a complaint off to the LGO! (Local Government Ombudsman) They have issued clear guidance on how they expect the councils to behave in relation to their bailiffs and their actions etc If the council have done nothing about your complaint and the LGO see that and agree with your complaint they can award you compensation and fine the council. One day councils will get the message that they are responsible for the actions of their collection agents.

  7. If they do manage to Levy but the levy is based on the addition of charges to the original warrant that have been added unlawfully(ie not in schedule) does the levy still remain in place and valid?

Hi If someone is on maternity paid then decides to take the remaining maternity leave unpaid what is the consequences for an employer if they terminate your contract without even telling you while you are still legally on maternity allowance? The person in question was due to go back in August 2012 but took their remaining 3 months unpaid making a total of 52 weeks which is allowed. On a discussion with head office they have found that their place of work has informed head office that they will no longer be returning to work and their hours have been given to new employee. Not once have they suggested in anyway that they would not be returning but instead on each call they have made to work they have been ignored and calls not returned. I understand the statuary rights are that you are allowed to return to your job after 52 weeks but what can be done against the employer of they refuse to employ her. She is not part of a union at work. Thanks
  9. The court order the payment in a CCJ A magistrates court just issues liaibility orders on behalf of local authorities. The council then should arrange payment with you hence the inclusion of the income and expenditure. You have been mis-led by the council and they have to take responsibility for doing so. Also if you have been making the payments and the debt is decreasing i do not see their reasons for sending this account to the bailiffs. I would make a full complaint to the council stating the above. Also as mentioned in another post the levy is unlawful as he has done it from outside your house. He has to physically enter your property to make walking possession. He knows full well this procedure is not lawful so then you have grounds for a complaint against him. In the meantime just dont let them in!

  12. Enforcement action has to be put on hold due to the fact the OOT statement my be upheld therefore they may well have never had any rights to issue collection in the first place
  13. Why does it not? So if a car is essential for use in your employment or actually getting there, a bailiff can take it away then technically put you out of work?
  14. When you received the Liability Order you should have received income and expenditure forms that I believe should be returned within 14 days! This then allows the council to see what u can afford to pay! Did you receive anything like that?
  15. Will give you 2-3 weeks grace while it is processed The local authority in the mean time should order the clamp be removed as they have to suspend enforcement action while the OOT is heard!
  16. Doesn't have to be specifically business ie a taxi Regulations state for use personally in their employment! That covers those who without the vehicle cannot work whether that be carrying trade tools or getting there if its considerable distance

He should have levied on the vehicle prior to him taking it, what are the letters, if it has been levied on you should have been given a seizure notice and what steps you had to take Also as you use the vehicle for your employment it is exempt from seizure: Such tools, books, vehicles, and other items of employment as are necessary to the debtor for use personally in their employment, business and vocation
  19. Then you really have no idea about the industry at all then do you if that is what you believe. And before you starting pulling points about who is mature i was pointing out how your industry acts! The fact that they will only bully and abuse those they think they can get away with. Like i said you find me someone who has a nice thing to say about a bailiff and ill retract what i said! Pretty sure you wont! Your original point is crap, coming in here asking what a fair charge is then on the other hand saying you agree the proposed charges are fair.
  20. Well why are you here trying to push your ridiculous views on how you think these charges are fair then? Trawl across this site and you will see the misery and upset bailiffs inflict on people on a daily basis, not to mention all the well known news stories regarding bailiff actions. I have yet to meet anyone who has had experience of a bailiff with good intentions. Your comment about how they have to turn up in two's for their own safety is also laughable. IMHO if a bailiff turns up at your property, with total disregard to the law, your rights or the householders safety acting in an aggressive manner he deserves to get knocked clean out, and believe me their are plenty that will do it, then again if they see they are not vulnerable they probably wouldnt try it. Many wouldn't condone violence put some deserve it only language they understand. Sneaky, deceitful, aggressive sums up your industry to name but a few, so with your little experience of the industry if you start in that manner your on your way there.

  22. There is no need for bailiffs what so ever Its simple: working - attachment of earnings or benefits - attachment to benefits!! No way of non payment! Either way the debt is collected and people are not intimidated. The government should realise this and close down the industry. The world would certainly be a better place!

Thats it nothing, they are passed the warrant and believe £75 for sending a letter to notify you is fair. £13.44 to send a single letter is high in my opinion but if they include the admin time etc in there then so be it. Alot of companies charged so called HPI checks now, yet even if the car shows leased or outstanding finance they still send a bailiff who will levy on it. So apart from been an unlawful charge as it is not within the regulations what the hell do they do it for?

They get hundreds of pounds, extorting hundreds of pounds out of vulnerable people who unfortunately are that scared they pay up and then do not know the process of challenging them They certainly do not make millions in turnover by sticking to charging what they are allowed by law, but unless the government gets a grips and realised ow serious this is and stop been blinded by the waffle these companies come out with people will unfairly carry on suffering. Cant believe this guys even started this post in here, who gives a flying toss about his business or costs. They all fall under same category 'Societies filth'
