  1. am v happy today! 28 days till we go on holiday so it will b an even better one than usual
  2. WE WON !!!!! Recieved allocation form from the court today and also letter from Nationwide saying they have refunded in full. £1311.64 in charges £120.00 court fee £136.10 in interest. We have arranged to go and get the money Saturday morning, overdraft is paid now and they didint close the account although we WILL be doing it ourselves! Good riddence I say. I am so peed off that NW are allowed to drag out these claims and play the courts for fools. They never intend to go to court (of course we all have to presume we might be the one who will) and then pay at the last minute. This site is just amazing, I have had such good advice especially from MTM. It can be a very daunting prospect taking a large corperation to court but the support from here is very empowering and I for one wasnt gonna let the buggers beat us. Thank you guys, I am going to carry on coming in and trying to help others if I can. (end of Oscar style speech! turns to walk away clutching her Nationwide letter of repayment)

  5. Quicky update and so the saga goes on.................................................. It seems as my husband had contacted NW debt dept about the U/A they have set up an 'arrangement' for payment as he said he would pay a small payment on 1st July (men eh??!!) Secondly we recieved this email from Eversheds today Dear Sir, Regarding your claim, we at Eversheds have filed a defence at court on 21/06/2007 stating that our client Nationwide Building Society has denied your claim in the first instance. Our client is still investigating your claim and will update us shortly. If you have further enquiries, please do not hesitate to ask me. MTM you were right but they did it a day early!! I suppose I wait for the court to send me all the relevants now. Do I need to start preparing my court bundle do you think? I am swotting up on doing the Allocation form etc at the moment. It seems to be so unfair for the NW to draw this out with each claim when their intention in the main is to pay! Any advice appreciated. Jane
  6. Well a funny thing has happened................... I received a credit report alert today from Experian. As advised via this forum we checked our credit report online and felt we would subscribe to keep a check on things. Today I received an alert saying there was a change to my husbands report. When I logged on it said his unauthorised overdraft was cleared which I can only presume as we havent paid...............they have paid . So tomorrow we will be checking the balance of the account ( by going in) and fingers crossed it is all good Will update tomorrow x MTM Would never settle for less than we are claiming....court bundle is ready to go! I do still believe in giving them a chance ...extra time etc due to levels of claims after all that would go in MY favour in court. I appreciate all your advice and have taken every word (except for the hair colour thing ) very seriously and have learnt so much. Hey it aint over till the fat lady sings and that isnt me!!!!
  7. Right I phoned and confirmed with the court this morning that NW date was indeed up at 4pm yesterday. I sent an email to Catherine Price and copy to Stephen Price as these were the only email addresses I could find on here. Here is what I wrote ( taken from another thread on here and jiggled about a bit) I refer to my current claim against Nationwide Building Society who had until 4pm yesterday 20/06/07 to file a defence with Canterbury County Court. I am mindful of the vast majority of claims with which you are currently dealing and in order to more speedily resolve this matter, I am willing to accept the sum of £1567.74. I hope to hear from you by 27th June so that a reasonable conclusion to this claim might be achieved otherwise I will file a Judgement by Default. I am sure that the courts would approve of our settling this matter in a timely manner and without their further intervention. Hope it sounds ok?

  9. Quick update for all....... Recieved an Acknowledgement of Service dated 30th May and have been patiently waiting for NW to proceed. I rang the court today just as a matter of interest to see if anything had happened where I was told NW responded with an intention to defend the claim on the 23rd May meaning they have until 4 pm TODAY ! The lady at the court told me unless somone actually went to the court today and manually file a defence then I could enter a judgement by default tomorrow. I would like to give them a little longer as I have been watching other threads where people have given NW a few extra days as they are busy 'bless them' I would like to email Eversheds, also like others have done so can anyone give me the email address and advice as to what to write.   11. CONGRATULATIONS TRISTAR I am sooooooo pleased for you, it has given me a boost knowing someone in a similar situation has been refunded. Hubby put his cash point card in a machine ( was a silly thing to do I did tell him to ask over the counter) and had his card retained for 'unauthorised usage' and no checking online for us either. So maybe we will have to wait for a letter. Tristar have a great time with your winnings, wish me luck! Jane

Tristar I went 'a searching' within the forum in the Debt section and found this link Resisting harassment from creditors with the Wonga Wallah It states The laws that protect people in debt from unreasonable behaviour from creditors or their agents are: Section 40 of the Administration of Justice Act 1970 and specifically, The Protection from Harassment Act 1997. These state that it is a CRIMINAL OFFENCE if a creditor or their agent makes demands for payment in such a way that it causes alarm, distress or humiliation to a debtor or their family.   14. So glad I found this thread. I am also in the same boat. My thread is 'Longley v Nationwide' but I am sorry I dont know how to link to it! We also are dealing with KPR due to a £300 unauthorised overdraft created by our dear friends Nationwide...We filed in court via N1 and NW entered a defence to defend all of the claim on 30th May so they have till 27th June. We have toyed with paying off the U/O as I am worried it will affect our claim in court, however as the debt is made up PURELY of charges applied all except 54p I am feeling like I wont! Tristar what are your thoughts on this? Husband rang KPR and told them the amount was in dispute and so they cant collect on it and they have halted till July and a very snooty lady told him 'the courts are ruling in favour of the banks now dont you know' We dont use the account so it isnt a problem other than loosing the internet banking, so it isnt as easy to look at the balance. Also if we went into the branch they may take the cash card away (although there wouldnt be alot of point!!) Will they still pay into that account do you think WHEN we win?? It is a real headache but thank god we havent had letters like you have Tristar, how can they get a charge on your property if the debt isnt linked to it eg. a secured loan??? I didnt think that was possible. I was also shocked to know that KPR are the Nationwide. Hang in there Jane
  15. Thank you MTM for your advice...rest assured I trawl all threads here daily!!! its addictive! I just needed to clarify specifics relating to my claim This forum has taught me so much. The Flexaccount in question is not in use and is only a basic one anyway. Of course we can go and ask in the branch, I didnt actually think of that probably due to the fact we carry crucifixes and garlic round our necks to stop NW bleeding us dry at the moment! Jane

Thought I would update on our claim ......a week ago the Nationwide removed my husbands account from internet banking without informing him and have sent the unauthorised overdraft they created to their collection company ( a Nationwide company) My husband rang and the y have delayed until july on the account as we informed them the amount is in dispute at the moment. Nationwide have until 27th June to do their bit and it seems we have several problems 1) We have no way of checking if the NW has deposited any monies in the account, in fact have they closed the account down?? Do you think a phonecall should be made? We have tried not to enter into any telephone conversations. My husband does have a hole in the wall card but I expect it would be retained if used. 2) Are Nationwide going to use this unauthorised overdraft against us in their defence, perhaps we should have mentioned it as it has been created solely by them for the sake of 54p. 3) Should we pay the U/A (its £300) before the 27th so they dont have a leg to stand on?? We would pay the money back from the money they have to give us anyway as it is included on the spreadsheet As you can see I am feeling a little anxious as the time draws nearer as NW are so unpredictable, am I being unecessarily anxious? Any constructive advice would be gratefully recieved Jane
  17. coulbymike We recieved Acknowledgement on 30th May and then on 7th June recieved the same letter as you. We have disregarded the letter as our claim is already within the court system, also remember that the brush off letter comes from Member Services in Northampton and the court claim is being dealt with by Eversheds. On the top of your Acknowledgement of Service it will say when the claim was acknowledged then lower down it says 'the defendant has 28 days from the date of service to file a defence' so you can work out your date. I also believe it is 28 straight days not working days unless there is a Bank Holiday. I hope someone else can confirm this? I have further confirmation of Nationwides cock eyed system when I recieved a letter offering me back my bank charges, I signed to agree and sent the reply.....3 days later I get another letter from a different department saying no way can you have money back!!!! after a phonecall they credited my Flexaccount with monies owed. It is nerve racking being within the court system, I am feeling jittery too but these are all tactics used by NW to put us off PLUS they dont know their bums from their elbows. Hope this reassures you a little. Jane
  18. Aninha NW files an Acknowledgement of Service in our claim on 30/05/07 so they have until the 27th June now. It is nerve racking going through the court process but if you read, read, read on here and look through the court bundle ( I am just passing on advice that others have given me!!! and I have still to do the court bundle) I think it is just a matter of research. Invariably it doesnt go to court but like everyone says ....you have to be prepared as you may just be the one. Nationwide will take your claim right to the last minute, they are even waiting until AFTER the 28 days are up (there are several threads here about 28 days up and Nationwide not paying) I am finding this very interesting as our court claim is for my husbands account, NW have now removed his account from internet banking without telling us, and passed his account ,which has an unauthorised overdraft made up of 100% charges imposed by them, to their collection company. We filed in court but it has been stressful. I complained to the Financial Ombudsman and got a full refund within 4 weeks and didnt have to pay anything out! the difference is amazing. Nationwide certainly are 'proud to be different' ......but not in a good way!!! Jane
  19. Acknowledgement filed on 30th May so I believe they have till the 27th June now. I must admit I feel jittery!!! A curious thing has happened aswell now. My husbands Flexaccount has been taken off of Internet banking without a word from them at all. So we can see if he has had any changes in his account! Can they do that without informing us?? I am a little worried about the games they play with us innocent lot. Well we will just have to wait and see.....just means a long trip to the cash point where I expect they will retain the card due to the unauthorised overdraft NATIONWIDE created to bleed us dry!!   20. The FO advised I sent a letter to outline my complaint and so I took the decision to send something formal and to the point ...the LBA seemed the most appropriate. As far as the 8% interest is concerned I feel it is a personal choice, of course it would have been nice to aquire itand you are entitled to it! but as I really did this route as a comparison to my husbands claim via court (he he I beat him!) The Squall - heres hoping you get a nice letter from Claire Gillingwater too soon. Jane
  21. On the 13th May I rang the Financial Ombudsman to make a formal complaint about the charges applied to my Flexaccount from opening in June 2002. The FO then wrote to NW telling them they had 8 weeks to investigate. My husbands claim for charges has gone to the courts and I was intrigued as to the difference in methods as the FO route has not cost a penny and I did not apply for my statements either (although I did have a record of the amount in total) NW replied on 21st May saying they now had the complaint and they had till the 10th July to reply. At the same time, and on the advice of the FO, I sent a letter almost the same as the LBA but changing the deadline to 10th July. Well guys today I recieved a letter from Claire Gillingwater who has offered me a full refund amounting to £1436.00 as full and final settlement on this account. They are NOT closing my account and it has taken is not even a month. The only thing is obviously there isnt the 8% interest added but I have recieved ALL charges applied to my account. If anyone wants the FO phone number its 0845 080 1800 a very happy Jane:)
