    Hi all, Sorry if this is the wrong place to post message. Basically my monthly statement came in the post from Abbey. On the statement it states I have am being charged 16p in Instant overdraft interest although I do not have an overdraft. I 1st rang Abbey explained to them and asked politely why? They then hung up. I then rang a 2nd time the lady said I should not be charged and so will rectify. A week later the money had not been put back so rang again for the 3rd time. He said he will fill out a form and the money will be taken out of my account but will then be put back in the same day. Since then my money has still not been given back to me so I rang for the 4th time, explained and they hung up again. I know it’s only 16p but I don’t even have an overdraft and the money should not have been taken in the 1st place. It’s costing me more in phone calls and not getting anywhere. The customer service is useless. Just wondering if there is anything else I can do? Should I write a letter of complaint? Any help much appreciated. Many thanks
  2. Fingers crossed they do not appeal!! I agree, if it was not for this site many of us would not have been able to get so far in our claims so please everyone don't forget to donate!!!

In the witness statement what part of the court bundle exhibit is this: It is therefore impossible to envisage how the Defendant can incur costs of £35 by carrying out a completely automated process. Note that the letter received notifying of a charge is identical in every instance, and if multiple breaches occurred on the same day, a separate letter will be sent in each instance, in separate envelopes.   5. Please Please Please does anyone have the terms and conditions for 2000 and one for 2004 they can pm or post on this thread its really really urgent. I tried the abbey archives thread but i cant get any of the links to open. Just like a dead link. This is really really urgent please please help Help is so much appreciated

    please can someone help i really need terms and condition for around 31st june,july, august, sept or dec 2004 dont think it matters to much and preferably one for 2000 - 29 dec 2000 Any ideas?? Thanks

    Hi Please could someone advise…. I have had charges covering 2000 to 2004 so should I include one terms and conditions for 2000, one for say 2002 and one for 2004??? Also when I go on the T&C’s archive they have DD/MM/YEAR so should I pick one that is nearest to my charges or does the day matter as long as the month and year is the same?? I don’t know who T&C’s and sections to use….Please help Hope this makes some sense Oh forgot to add when I click on some of the links of the T&C’s archive its just a dead link. Thank you Hugo

    Hi Lula, Thank you so much for the reply. I didnt realise you could try and charge for the time taken to prepare the court bundle. What type of hearing is this? the letter says the estimated time is 90mins. I am really starting to have second thoughts about this now...I really dont think i can go to court and answer questions as i just don't understand enough at all even though i am really and continually reading through threads etc trying to learn the steps to reclaiming charges. This whole thing is starting to make me feel physically sick. If i done know when the account was opened what could i do regarding the terms and conditions of me bundle?     Hi, please can someone just give me abit of advice, really need some help :? I received my notice of allocation to the small claims track. The hearing is on the 30th Jan 08…so not long now. So I am right in thinking I have to continue preparing my court bundle and send a copy to both the court and Abbey by the 16th Jan 08. (Letter says no later than 14 days before the hearing) ? Received a letter from Abbey yesterday morning which included an application notice to stay the claim until the OFT test case is finalised. I have not heard anything from the court confirming this so assume my hearing date is going ahead. I am getting quite nerves now!!! Any help is massively appreciated Thanx Hugo

    Hi, received my Notice of Allocation to the small claims track this morning. The hearing of the claim will take place on 30th Jan 08 @ 14.00. Do i just start preparing for my Court Bundle? Should i write to Abbey regarding the hearing? LOL in the hope this might make me an offer which is highly unlikely i guess. Any advice much appreciated Hugo

    Please can somebody help me with my allocation questionnaire. I have filled in the form as per the guide on the CAG website, so is this below then correct? I would just prefer confirmation as I’m sure like everybody else on the site I don’t want to make a silly mistake. A Section G – other information on the form itself write: Please find the following attached to this allocation questionnaire; 1) Section G - other information 2) Draft order for directions This allocation questionnaire and its attachments were sent to the defendant on **/**/**. B Attach the passage for section G – other info to the AQ followed by the draft order. Then in the actual 'section G' box of the AQ write as above ( A ) C Then obviously send a copy of the AQ and attachments to the defendant as well as the court. Many thanks for all help
