Having just had a letter through the post for my OH it basically tells me that since the Bank failed to respond to the notice put to them to cough up, they have sent a list of Sheriff Officers in the Edinburgh area. I have read the leaflet given and it says there is a fee for this, but fails to tell me. Does anyone know the fee? Furthermore, what exactly do i need to do. Im going to go and see one on Friday after work. But what exactly do they do? Is it basically like sending in Baillifs? Have i definately won now and will i get the money back? From the leaflet " A fee is payable at each stage of the enforcement process, is chargeable to the debtor and is recovered out of teh successful enforcement" Does that mean say they charge £10 per enforcement process and it takes 5 attempts they take £50 out of the money returned to me. So if i was seeking £150 i would actually get £100? Any help is appreciated. Thank-you PS I orginally went through the small claims with this. Do we use a different term now that officers will be involved (ie summary cause) and can i be liable for costs if something goes wrong?
  7. I handed my paperwork into the courts and the time lapsed yesterday. Upon calling them today there had been no reply from the bank.(They sent me a letter saying i had alreday claimed money back last year and that that was in full and final settlement, but i never agreed/sighned anything of the sort)So i am to send in the Minute for Decree. They will get back to me to say what my options are for getting my money, The man said something about Sherriff Officers. Is that like Bailliffs?? However, i took a loan out earlier this month and the money was to be in the account on the Monday but it was late in going in. As a result 2 things came out the bank, and i went OD - i have been charged almost £90. Should i call and ask for it? Or should i start a new claim when i get my money back for this one? Or am i just being damn rude and cheeky.
  8. Sorry i wasnt clear. It was a week past Friday that i handed my papers into court. On the Monday they served the papers, i then got a letter from the court but it says that i must call the court the day after the return date to see what the bank have done.
  9. Return date is 8 May 2007 with the calling date being the 15 May 2007. So if they do not refund the money by the 8 May. on the 9th im to call the court right? Just say they dont pay but they put in a defence, saying, they have paid once already and that the "new" charges are down to me, will i have to go before a judge?
  10. So do i just let it carry on until the day im supposed to call and see what happens? Do they expect me to call the court and cancel after this letter?
  11. The court served papers on them last Friday. I just had the following letter: Thank you for your recent letters, the contents of which i have noted. I would like to advise that following receipt of a county court judgement in made a payment of £831 to you in August 2006by way of full and final settlement. I therefore regret that we are unable to consider a refund of teh charges that you have recently incurred on your account. Ultimately it is your responsibility to manage your account. We stated in our letter dates Aug 2006 that if you were to incur any future charges the halifax reserves the right to withdraw your banking facilities. Anyways, these new charges were for the start of 2006 to the end of 2006. The successful refund i got last year was from 2001 to end of 2005 (just under £750 + interest + court costs) I dont know what to do. Have i lost the case then?? PS Its due up in court in April ( i think need to double check)
  12. I tried using the excel program for Scottish claims on here but for some reason it will not work on my PC.Dunno what im doing wrong. Someone emailed me one a while ago that worked. Unfortunately its on my email at home which i cannot get access to just now. I would like to ask if someone has a simple version for use in Scotland to email me at [email protected] Apologies if this post is deemed in the wrong place and needs to be deleted/moved.
