I was late paying my 18 pounds last month, so the bank charged me 35.00 straight away as i didn't have the money in my account at the time, then virgin charged me 3 times for the direct debit not going through plus a payment handling charge "23/09/08 D.D. The current months bill is £32.00.The total balance is £74.00. You can pay £32.00 before 02 December " so basically i have 2 days to cough up money i don't have or i get cut off i guess
  2. Hi, I've been through the stages up to sending off the LBA some time ago. My claim is in between 1000 and 1250. I'm opened the account in England, and have been resident in Edinburgh since 2004. I postponed dealing with this due to the stay announcement but have heard that cases are still going ahead in Scotland now. I now wish to move onto the next stage, probably with Edinburgh Sheriff's Court. I obtained a Summary cause, and because i am on Jobseeker's allowance, the waiver for the fee. I wonder if someone could advise me if there is anything specific that i need to include in a summary cause, whether this is the best next step, and also whether if i lose, i will owe money being on benefits.   3. Hi, I sent of an initial letter based on a template provided on moneysavingexpert. I didn't include statutory interest on my list of charges. I now am at the stage where i want to send off my LBA, and there is a mention in the template of 'which you have charged me in overdraft interest for the sum which you have taken'. Does this refer to the interest which i wish to charge them in the claim? or does it refer simply to overdraft interest? Also, in the template, it refers to '. I have already sent you a copy of this in my original letter', but being as i hadn't included interest on the original charge list, will this need altering. thanks
  4. Hi, I'm about to send off a Letter Before Action or LBA as advised on the website. The template listed has details such as using County Court etc. and i wondered if there are any adjustments that need to be made or whether there was a template specific to Scottish claims?
  5. Thanks for the replies. My account was opened in England, and most of my charges were applied there, however, i moved to Scotland 2 years ago, is this likely to make a difference other than only having 5 years ability to claim instead of 6 in England?
  6. Hi all, I've taken the plunge and sent off a claim letter along with spreadsheet to the Halifax for £1101. I recieived a letter on 25th April, saying they'd investigate and respond within 4 weeks. Today I received another letter apologising for not responding, but that they're still investigating and that i'll receive a response 'as soon as possible, but certainly no later than 20th June' i'd appreciate any advice.   7. gutted for you on the point about providing evidence, is there no way that CAG could get access to the Editors or reporters of the recent programme which they contributed to which had experts giving their judgement of the likely cost being as little as 2 quid to deal with an overdrawn item. Also, has any1 thought of some other form of protest if the courts decide it is legal. Just because something is legal does not make it right, perhaps other options could be looked into for e.g. mass withdrawal and changing of bank accounts with banks like Lloyds that don't listen. Just a thought.
