  2. Hi all, I have had the usual letters from Cap One advising that they will only offer £226 instead of the £1200 claimed. Just wonderd if i could use MCOL for the next stage i.e N1 form? Thanks for any help guys.

  4. Hey All, i am pursuing a claim against Capital One and wondered if it was possible to claim late payment fees as well as overlimit fess?? Also i was asked to send the letter to Executive Office based in Nottingham. Is this correct?? Any help would do guys. Thanks

  7. Hi All, Had my Stay hearing yesterday @ Southend. Three cases were heard together (two Natwest and one HSBC). The judge was quite decent in that he let every case be heard and wanted to know what circumstances makes our case different from the OFT hearing. Gave it a bash, but dont think i convinced him. The judge reserved judgement on all our cases, but i presume he will stay the case..... just a question...the cobbets representative issued me with his skeletal arguement in the court, not 10 minutes before the hearing. Were they supposed to issue me with a copy much before that? The judge seemed to have a copy???? The judge did say the the OFT hearing is set for the january 08 for 8 days and that we should know then what will happen.
  8. Thanks hedgey, didn't realise that it was the statement i attached with my N244 form . It's just a skeletal argument then...i'm extremely worried about tomorrow. I was thinking of wiritng down my experiences with Natwest from the beginning of starting with my requests for statements.... and issuing this as my argument for the case...what you reckon?
  9. Sorry Zoot.... I have my hearing tomorrow and am quite scared that i may make a fool of myself infront of the judge and cobbets. What will happen if i dont have a skeletal arguement or witness statement?? Is it a necessity??
  10. Thanks steve, His mailbox is full unfortunately..... Does anybody else know what a skeletal argument and witness statement is. Also, is it worth putting my letters from Natwest offering a gesture of good will in the bundle??? regards

  12. Southend County Court has stayed all claims, howvever i put in my N244 form and have a hearing next tuesday (25th Sept 07). i confirmed with the courts yesterday that this is still the case. So looks like southend are responding to N244's.

  15. Hi Guys, i am trying to prepapre a bundle for the stay hearing next week and came across zootscoot's page which is great. Just wondered though...the litigation list for natwest only has two cases post 27th July 07 (20/8/07 and 21/08/07)and both are not concluded. Are these the only two available for natwest? Can i use these as they are not concluded?? Thanks
  16. Hobson, I think getting the stay lifted is a great achievement and hopefully the bank will settle before hand. Good luck with that. I have my stay hearing on the 25th Sept. Not sure how to play it really. Could i ask how you argued yours?
  17. Hey all, I have a hearing date for late September to have the stay lifted against Cobbets. I dont think i can argue hardship really so i have to take an alternative angle...any ideas??? I am hoping natwest settle before the hearing. Does anyone know of Cobbets attending a stay hearing yet?? I know Jansus states that she has settled before the hearing.....fingers crossed

  19. Hi All, I have had a letter from Southend County Court telling me that a hearing date has been set for 25th Sept 07 regarding the application for removal of Stay. I did tick the without a hearing box, but the court had crossed that out and ticked the "at a hearing box"!!!! I am cacking myself!! What do i do???

If sticky's comments about all MCOL claims are stayed and that we should pursue via the local courts, i gather that the N244 and £35 i issued will be a waste of time???? Any idea's as to what to do next. Also just thought i'd say that natwest has issued me with a new letter advising that all cases are frozen until the OFT case blah blah blah...and that they are offering me the gesture of good will for another two months for me to accept. Funny i thought....
  21. Hi all, Got the written confirmation that my case has been stayed, so will send in the relevant paperwork. Just as a sideline, i think i may have made a mistake on my POC. As i am claiming for more than six years, am i right in thinking that i shouldn't have reference the UTCC 1999??? My claim goes back to 1997....
  22. Sorry to be seem thick, but what do you mean i ahve to amned the statement to reflect that i want the stay to be set-aside, rather than opposing the banks application???

  24. Hello peeps... Just had a verbal confirmation that my case along with 700 others have been STAYED in Southend CC. Looks like the OFT haven't thought this through properly. Why can't they allow all claims to continue regardless until the high court ruling has been made. Very frustrating as i started my claim in March and looks like its going to take another year...if the OFT wins that is.
